Hardin Warner State of North Carolina, Moore County On this 27th day of January One thousand Eight hundred and forty six 1846 Personaly appeared in open court Richard Warner a resident of said county aged fifty six years 56 and being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefits of the pensioner made by the act of congress passed the 4th of July 1816 that he is the son of hardin Warner who was a soldier in the Revolutionary War in the Continental line of North Carolina that his said Father enlisted for the term of the war and served three years and six months in Colonel Sheppard Regiment under Capt Blount as he heard him say the number of the Regiment he does not recollect and that not long after the close of the war he sold his bounty land to one Philip Hodges as he sold him many times. And he further saith that his said father and mother was married in Greene County North Carolina and that his said father Hardin Warner died in the month of April 1833 and was at the time of his death about seventy five years old 75 and that his said mother Elizabeth Warner remained a widow from the time of his fathers death as above up to the day of her death which occured on the 26th day of November 1842 and that she left surviving heirs five children namily Wincy Warner, the oldest child who married William Sears. Polly Warner who married Holden Cox. Nancy Warner who married Thomas Grayham myself Richard Warner and Hardin Warner Jr and he further saith that his mothers maiden name Elizabeth Turnage and that at her death she was about eighty years old and he further saith that he has no family bible or other evidence of the marriage of his said father and mother but well remembers to have heard them say they were married before the last period of his service in the war and that they had one child born before the close of the war and he further saith that his said Father and Mother had three children older then himself and that there was two years and a half between the births of each child and he further saith that he supposes the reason his said mother never made application for a pension was she did not know she was intitled as he never heard her speak of it and that he himself did not know until recently that the heirs of a soldier was intitled to a pension and that ? his assertained the fact he has made application for what was due his said mother at the time of her death for the service of his deceased Father Hardin Warner and he ? more for himself Brother and sisters ? ??? State of North Carolina, Moore County This day personaly appeared before the subscriber a Justice of the Peace in and for said county wincy Sears a resident of said county aged sixty five years, 65 and being first aduly sworn according to law deposeth as follows that she is the daughter of Elizabeth Warner who was the widow of Hardin Warner deceased who was a soldier in the Revolutionary war in the Regular service as he told her and that he sold his bounty land to one Philip Hodge of Cumberland County North Carolina and she further saith that her said Father Hardin Warner was about making an application for a pension before his death and that Mr Cornelius Dowd was his agent in fixing up his papers and that before his papers were ready to send to the War Department her said Father died and she further saith that she has often heard her said Mother talk of the great hardships and inconviences she suffered while her said Father was in the service and she further saith that she has often heard her said Father and Mother say that she herself was born while he her said Father was in the service of the United States in the war of the Revolution and she further saith that there is no family bible or other record of the marriage of her said Father and Mother or the ages of the children but that she was always told by her Father and Mother that she was born in the year 1781 and further this despondent saith next sworn to and subscribed before me this 28th January 1846 Wincy (her mark) Sears sworn to and subscribed before me J Bean JP I Jesse Bean The magistrate do herby certify that I am well acquainted with the above applicant Wincy Sears and she is of reputable character and good standing. State of North Carolina, Moore County This day personaly came before me Jesse Bean a Justice of the piece in and for said county Benjamin Phillips a resident of said county aged fifty nine years 59 and being duly sworn according to law deposeth as follows That for many years he was well acquainted with Hardin Warner and Elizabeth Warner his wife the Father and Mother of the children who are now making application for a pension and that the said Hardin Warner lived before his death a near neighbor to the desponant and he frequently heard him the said Hardin Warner speak of his services as a soldier in the Revolutionary war and such was his general character and he further saith that the said Hardin Warner sold his Bounty land to one Phiip Hodge as he was told and he further saith that the children of the said Hardin Warner who are now making application for a pension are all his close neighbors and that he believes Mrs. Wincy Sears who is the oldest child of the said Hardin Warner to be at least sixty four or sixty five years old 64 or 65, Question, Why do you believe she is that old, Answer The length of time since I first became acquainted with her and the size she was then makes me position she must be at least that age...and the desponant further saith that in the late war he was a drafted soldier and it was at that time as well as many others he heard the said Hardin Warner speak of the great suffering he underwent in the War of the Revolution and he also heard him the said Warner tell a soldier of the last war that he should not have minded the hardships that they might suffered as it could be nothing like his in the Revolutionary war. sworn to and subscribed before me the 31st January 1846 Jesse Bean Benjamin Phillips I Jesse Bean the above Justice of the Piece do certify that I am well acquaninted with Benjamin Phillips, the wittness desponant and he is a man of Respectability and truth and a man in good and fair standing in society given under my hand this 31st day of January 1846 J Bean JP State of North Carolina, Moore County I Alexander C Curry, Clerk of the Court of Pleas and Quarter Sessions in and for the said County bere by Certify that the name of Jesse Bean whose name appears as on attest to the foregoing affidaviat of Benjamin Phillips and Wincy Sears as well as to his own certificate to a affidivait is genuine In testimony where of I have hereunto affixed my Seal of Office and Subscribed my name the 5th day of February AD 1846 A C Curry, Clk |
