John E. Mayton Will

In the name of God Amen
I John E. Mayton of the county of Wake and State of North Carolina being sound in
mind and memory for which I thank God yet calling to mind the mortality of my body and
knowing that it is appointed to all men to dec. in consequence of which I do make and
constitute this my last will and testament in manner & form as follows (ie). First I
recommence my Soul unto the hand of God who gave it hoping for a joyful resurrection at
the last day through the merits of my saviour Jesus Christ, and my body I wish to be
buried in a decent and christian like manner.
Item first my desire is that all my just debts be paid & satisfied.
Item second after my just debts are paid I give unto my wife Esther Mayton all my estate
both personal and real for her support and benefit during her lifetimw or widowhood.
Item third after the death of my wife Esther Mayton if there should be a sufficiency life
I give & bequeath unto David T. Mayton, John W. Mayton, Gilly Howington, Queen Esther
Tilly and James E. Mayton (or their lawful heirs) the sum of fifth cents each to their use
and benefit.
Item fourth after the above disposetion of property It is my will that at the death of my
wife that all the balance of my estate both personal & real be equally divided between
my daughter Mary Mayton and my son Leonard C. Mayton either by sale or otherwise.
Item fifth notwithstanding the above items it is my will that twenty acres of land (the
place whereon David T. Mayton formerly lived) be equally divided between John H. Mayton
& Elizabeth Mayton children of David T. Mayton.
Lastly I accoumicate? and appoint my worthy friend Robert Halliburton of Wake County, with
my wife Esther Mayton my whole Sole executors to this my last will and testament, hereby
making null and viod all other wills by me made declaring this to be my last will and
testament entered on one sheet of paper this eighteenth day of January in the year AD.
Eighteen hundred forty two.
