JOHN MAYTON WILL
In the Name of God Amen This third day February in the year of our Lord one thousand seven Hundred and Sixty one I John Mayton of Amelia county Being very sick & Weak In Body But of perfect Mind and Memory thanks be to God for the same and Knowing Thou(?) that it is appointed for all Men once to Die, Do make and ordaine This my Last Will and Testament that is to say principally, And first of all I give and Recommend My Soul to the hands of God that gave it. For my Body I Recommend to the Earth to be buried In a Christian like and Decent Manner at the Discretion of my Executor Nothing doubting but at The General Resurrection I shall Receive the same again by the mighty Power of God & as touching such Worldly Estate Wherewith it Hath pleased God to bless me in this Life I give and Dispose of the same in Manner & form following(.) I order that In the first place all my just Debts & Funeral Charges Be paid and Satisfied. Then I give and Bequeath unto my three sons John Robert & William all my Land to be Equally Divided when they come of age John to have the Plantation Where I now dwell William to have the old Plantation. And Robert the upper part joyning Henry Jones and my Desire is that if either of my three sons Dies Before they arrive at the age of twenty one their part shall be possest By my son David if he lives till twenty-one years of age—to them their heirs and assigns. I give & Bequeath unto Thomas Booth & John Booth & my Dearly Beloved Wife Ann Mayton twelve Pounds Current Money—to be raised levied out of my Estate to give my three sons Robert William and John schooling. Item All the rest of my Estate to be Equally Divided Between my three children Mary, Martha and David. I desire that my Estate shall not be appraised. I leave Thomas Booth John Booth and my Wife Ann Mayton my only & sole Executors of this my last Will and Testament. I do hereby disallow revoke & disannul all and every other former Testament Wills and Legases & Exd. By me any Ways before this Time named Willed & Bequeathed ratifying and confirming this and no other to be my last will and Testament. At a Court held for Amelia County the 26th Day of March 1761. This Will was proved by the Oaths of John Booth and Thomas Clay two of the Witnesses thereto sworn to by Thomas Booth one of the Executors therein named and ordered to be recorded and on the motion of the said executor who entered into and acknowledged bond with John Booth his Security as the Law directs Certificate was granted him for obtaining a probate in due Form Liberty being reserved to the other extrs. To join in the probate upon they shall think fit. Griffin Peachey, Court Clerk ---------- An inventory of the estate of John Mayton of Amelia County Deceased—one Negro Man named Glasgo Cash (L) 6 7 3 Two mares and 17 head of cattle 15 sheep 3 sows and 10 pigs 5 shoats 3 feather beds and furniture & ticks and feathers 4 bed sheets and Cords 1 chest 2 tables 3 iron pots and hooks 3 narrow axes 2 weeding hoes 2 hilling hoes 2 grubbing hoes 2 plane hoes a set of shoe makers tools 1 frying pan 1 gimblet 5 pewter dishes, 1 bason, 1 porringer, 9 plates 1 dozen of spoons 1 pepper box, 1 mug, 1 butter pot 3 water pails, 2 washing tubs, 2 meat tubs 1 gun, 1 box trim and headers (?), 1 pair fire tongs 3 rawhides, 4 sides of tand leather 1 mans saddle & bridle, 1 horse collar, 2 pair of hames 1 block knife and staple 6 knives and forks 2 augurs, 1 drawing knife, 1 broad chisel, 1 gouge, 3 shoe lasts 2 glass bottles 600-6d nails 6 pounds of wool flax 1Hh(hogshead?) tobaacco and parcel 1 great coat, 1 close Body’d coat, 1 jacket and breeches 1 grind stone, 1 pair spectacles 2 reaphooks, 1 Raser Horse fleams and Lancet 1 loom and slay 1 pair of stirrups irons 2 iron wedges 2 wooling wheels, 2 pair cards, 1 iron spindle 1 pair doe skins. February 28th 1761 At a court held for Amelia County the 26th Day of November 1761. This inventory of the estate of John Mayton deceased was returned and ordered to be recorded. --- Some few articles lest out of the inventory of John Maytons Estate . 2 or 3 old baskets 1 piece of a hammer 2 pair of old scissors 4 old books 1 hone Thomas Booth, Exr. --------------- In Complyance with the above Order to us directed we have Divided the estate of John Mayton deceased agreeable to the Last Will and Testament of the said John and we do allot unto the plaintiff Mary Seventeen Pounds One Shilling and Eleven Pence Current money in full for the said Plaintiff part in the estate of John Mayton dec’d .
