In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, and in supersession of Public Notice No. 3 (PN/97-02) dated 31.03.97, as amended from time to time, the Director General of Foreign Trade hereby amends the policy/procedures for the import of car and automobile vehicles, effective from 01.04.2000, as under:-

Passenger cars/jeeps/multi utility vehicles etc. which are in the restricted category may be imported without a licence on payment of full Customs duty by the following categories of importers:

Individuals coming to India for permanent settlement after two years' continuous stay abroad;

Resident Indians presented with a car as an award in any international event/match/competition;

Legal heirs/successors of deceased relatives residing abroad;

Physically handicapped persons;

Companies incorporated in India having foreign equity participation;

Branches/offices of foreign firms;

Charitable/missionary institutions registered with the Ministry of Welfare and the Ministry of Home Affairs, Government of India

Honorary Consuls of foreign countries on the recommendations of the Ministry of External Affairs, Government of India.

Journalists/Correspondents of foreign news agencies having accreditation certificate with the Press Information Bureau, Ministry of Information and Broadcasting, Govt. of India.

All the above categories shall be entitled to import only one vehicle except categories (e) and (f), which shall be entitled to import maximum of three vehicles. Persons in category (d) shall be entitled to import only specially designed vehicles suitable for use by handicapped. All such imports shall carry a "NO SALE" condition of two years which shall be endorsed by the Customs authorities on the passport/ registration documents at the time of import and by the Regional Transport Authorities when such vehicles are presented for registration in India. All such imports, except by the physically handicapped persons, shall not involve any foreign exchange remittance from India directly or indirectly. The DGFT may, however, permit relaxation of these conditions or imports by any other category not listed
in this Public Notice in special circumstances.

All bonds/ bank guarantees executed by importers of cars/two wheelers etc. prior to 31.03.97, where the vehicle has not been transferred, shall be deemed to have been discharged with the issue of this Public Notice.

This issues in public interest.

Proforma of medical certificate to be issued by State Civil Surgeon or Head of concerned Wing in a Government Hospital dealing with nature and extent of disability

i) Eye Examination
a) Vision........... Right eye, left eye.
b) To specify if any colour blindness which makes him unsuitable for driving

a) Normal
b) Sub normal
c) Any mental illness

iii) Hearing
a) Hearing in the right ear
b) Hearing in the left ear

iv) Nature of disability
a) State whether the applicant is suffering from any of the disabilities mentioned below:

1. unilateral / bilateral amputees of the lower Limbs excluding below knee unilateral amputees;

2. Unilateral below elbow or above elbow.

3. Traumatic / permanent paralysis which cannot be surgically or medically treated;

4. Permanent paralysis of one upper limbs or both lower limbs due to any reason or hemiparesis; and Grossly deformed limbs due to trauma, arthritis or congenital but having at least one upper limbs normal.

If so, specify the disability out of 6(iv) (a) (1) to 5) above and percentage of impairment as per Mebride Scale.

ANNEXURE - II

SPECIMEN BOND FORM TO BE EXECUTED BY IMPORTERS OF CARS ETC.

KNOW ALL MEN BY THESE PRESENTS that we (i) ...................... of .................. (hereinafter called the importer which expression shall where the Context so admits include his/their representative heirs, executors, administrators and legal representatives/successors and permitted assignees) and (2)................... of .......................... (hereinafter called the surety which expression shall where the context so admits include his/their representative heirs, executors, administrators and legal representatives / successors and permitted assignees) are held and firmly bound jointly and severally unto the President of India to pay to the President of India through the Joint / Deputy Director General of Foreign Trade .............. for the time being on demand without demur the sum of Rs......... for which the payment will and truly to be made, we bind ourselves firmly by these presents.

Whereas the Joint / Deputy Director of Foreign Trade, Government of India.

(herein referred to as the said Joint / Dy. Director General of Foreign Trade with expression shall include the person for the time being performing the duties of the Joint / Dy. Director of Foreign Trade .......................) has permitted clearance of .................................. more fully described in the Schedule hereunder written, imported in India by the importer. Now the condition of the above written bond or such that :-

1. If the said importer re-exports the car at the time of his leaving from this country or had taken prior permission of Director General of Foreign Trade Organisation for leaving the car in India while proceeding abroad for a period exceeding six months and

2. If the said importer shall not sell, pledge, mortgage, hypothecate or part with the possession of the said car or otherwise dispose of the car, then the above written bond shall be void and of no effect otherwise the same shall be and remain in full force and virtue. And it is hereby fully agreed and declared between the parties as follows :-

(a) That the above written bond shall remain in full force and effect for the period of .............. years from the date of importation the said .................. and shall be deemed to be renewed for such further period as the Joint / Dy. Director General of Foreign Trade may require any time before the expiry of the said period;

(b) Any forbearance, act or omission on the part of the President of India to enforce the bond against the importer (whether with or without the knowledge or consent of the surety) shall not in any way release the said surety from his liability under the above written bond;

(c) That this bond is entered into under the order of the Central Government for the performance of an act in which the Public are interested.

(d) The importer shall produce evidence that the car is in his / her possession and ownership whenever demanded by the Director General of Foreign Trade or any licensing authority; and

(e) The importer shall not leave the car in India while going abroad except on short visits for which permission from the licensing authorities shall be obtained for leaving the car with the close relation;

(f) Any breach of terms and conditions of this bond will render the importer liable to the penalties as provided under the Foreign Trade (Development and Regulation) Act, 1992 and the Rules issued thereunder, over and above his liability for payment of the amount of the bond.
