Sub:   Green Channel facility for exports made by 100% Export Oriented Units and simplification of export procedure at Calcutta Port.

        All 1005 Export oriented Units are hereby informed that exports made by them will be allowed Green Channel facility in the manner as laid down below. 

1.                Those Hundred percent export oriented units who pay a duty of Rs. 10 Crores or more (i.e. where the duty of excise on the export product and the duty on DTA sale together is estimated to be 10 Crores or more) and covered under the self-certification procedure contained in MF (DR) Circular No. 98/98-CUS. Dated 8.12.98 will be allowed to export goods under self-certification without further examination at Calcutta Port provided that the packages/ containers are sealed in the manner as laid down below. This Custom House shall accept a certificate to this effect issued from the Office of the Jurisdictional Development Commissioner.

2.                  When an EOU of the above category opts for clearance under green channel, the export goods in container may be allowed to be moved from the manufacturer’s premises and after sealing by the exporter himself. In the case of containers the exporter shall seal it with tamper proof bottle seal and in the case of packages, each package must be individually sealed with lead seal. The EOU shall declare the number of the bottle seal on all relevant documents and make an endorsement on the back of packing list and invoice pertaining to the shipping Bill. This endorsement shall be signed in all cased by the authorised signatory of the EOU and shall read as follows :

3.                  “ I have examined the goods and the same are found to be as per the declaration. The goods are stuffed in the container/package and the container was sealed with bottle seal/ the package was sealed with lead seal under my supervision. The bottle seal no. is _______. I undertake full responsibility for a any; difference in description, quality or quantity of the goods."

4.                  Such goods of the above mentioned EOUs i.e. those coming to the Docks under self-certification and self-sealing shall not be reopened for examination unless the seals are found to be tampered with or when there is specific intelligence/reasonable doubt and/or a specific order is obtained from the A.C./D.C. Docks before examining the container/consignment.

5.                  The EOUs opting for green channel facility shall not normally be allowed to switch over to the system of examination and sealing by the Customs/Central Excise Officers.

6.                  In partial modification of P.N.130/99 dated 14.12.99 such EOUs will now be required to fill in annexure C-2 (instead of annexure C-1 earlier) as annexed with this P.N.

7.                  The other EOUs also have the option of examination of the goods at the factory premises/warehouse. The goods can be examined and the officers of Customs of Central Excise. In such cases the container/packages are required to be individually bottle sealed or lead sealed. In these exports the declaration in Para 3 will be signed by the supervising officer of Customs or Central Excise as the case may be. Para 4 shall apply to such goods mutatis mutandis

8.                  It is reiterated that wherever the goods are examined and sealed under self-certification or by the officers of Customs or Central Excise at the place of despatch, they shall not be further examined at the place of export by the officers of Customs save and except what has been stated in Para 4 above.

9.                  In the case of EOUs which are neither under self-certification not under the procedure laid down in Para 7 above, the export goods will be examined at the Docks.

10.              This P.N. is not applicable to the exports made through FEPZ, as the FEPZ is not covered under the EDI System. This P.N. applies mutatis mutandis to exports made through Calcutta Airport, for which Commissioner (Airport) has also concurred.
