Subject : Transfer of imported goods for re-warehousing from major ports to Inland Warehousing Stations: need for adequate security for Customs Duty - Regarding.   

    Attention of all Importers, Clearing Agents, Trade & other concerned  is drawn on the above subject. In the present context as a measure of further relaxation, it has been decided that the following procedure shall be followed while relaxing the requirement of 50% Bank Guarantee in permitting transfer of imported goods in-bond for rewarehousing to inland warehousing stations.

    (i) PSUs/State/Central Govt. Undertakings, 100% EOUs and Units in EPZ, Manufacturing-in-Bond Units and importers of shipstores may furnish a B/G equal to 15% of the duty amount alongwith on the condition that the rewarehousing certificate in respect of the consignments so cleared are produced within four weeks of despatch, failing which next consignments would be allowed only upon furnishing of a transit bond supported by 100% Bank Guarantee until the receipt of the rewarehousing certificate along with the reasons for such delay in writing.

    (ii) Regular importers who have an unblemished record and have not defaulted in producing warehousing certificates in the  past, shall be allowed to furnish B/G equal to 25% of the duty amount alongwith transit bond in the same manner as mentioned above.

    (iii) In the case of regular importers of large consignements of containerised cargo or bulk cargo, Commissioner of Customs would consider individual requests on merits for accepting  a standing running Bank Guarantee on annual basis. The quantum of such B/G will be based on the quantum of previous two(2) years performance and the present year's projection of clearance / transfer of goods for rewarehousing. This B/G would be treated as security for all the transfers that are likely to be made during the period of validity of the B/G. This facility shall be subject to the production of rewarehousing certificate within 4 weeks from the date of despatch and any default in this respect shall be treated in terms of para (i).

    (iv) In respect of importers of goods having any kind of restriction in policy and/or attracting highest rate of duty or goods in respect of which this Custom House has received an alert from any intelligence agency or another Custom House, the quantum of Bank Guarantee shall be determined by the Commissioner of Customs depending interalia upon the reputation of the importer and his previous track record.

    All Bank-Guarantees shall be filed in terms of this Custom House P.N. No. 22/98 and the validity period of Bank Guarantee shall be got renewed properly before its expiry.

    This Public Notice comes into force with immediate effect.
