Public Notice No. 31/2000

1.    It is notified for information of Exporters, Trade, Clearing Agents and all other concerned that under G.S.R.-78 the Central Government  has prohibited the export otherwise than by post, of all goods, either directly or indirectly, to any place outside India other than Nepal and Bhutan, unless the exporter furnishes to the prescribed authority a declaration form (GR) supported by such evidence and particulars as may be prescribed.

2.    It has also been provided under the GSR that the above prohibition shall not apply to the export of - 

   (a)    Trade samples supplied free of payment;

    (b)    Personal effects of travellers, whether accompanied or unaccompanied;

    (c)    Ship stores, transhipment Cargo and goods shipped under the orders of the Central Government or of such officers as may be appointed by the Central Government in this behalf or of the Military, Naval or Air Force authorities in India for Military, Naval or Air Force requirements;

    (d)    Goods despatched by airfreight and accompanied by a declaration by the senders that they are not more than ten thousand rupees in value and that their despatch does not involve any transaction in foreign exchange;

    (e)    Goods despatched by airfreight and covered by a certificate issued by an authorised dealer that their export does not involve any transaction in foreign exchange;

    (f)    Goods export of which in the opinion of the Reserve Bank do not involve any transaction in foreign exchange, and which the Reserve Bank has, by a general or special order permitted to be exported without furnishing a declaration as provided.

    (g)    The following goods which are permitted by the Development Commissioner of Santacruz Electronics Export Processing Zone, Kandla Free Trade Zone, Noida Free Trade Zone, Falta Free Trade Zone, The Madras Free Trade Zone or the Cochin Export Processing Zone, as the case may be , to be exported without furnishing a declaration as provided for herein, namely - 

        (i)    Imported goods found defective, for the purpose of replacement by the foreign supplier or Collaborators;

        (ii)    Imported goods which were imported from foreign collaborators on loan basis;

        (iii)    Surplus goods which were earlier imported from foreign suppliers or collaborators free of cost, after production operations.

3.    On a reference having been made by this Custom House, the Reserve Bank by its letter No. CA.EC.G. - 13/05.30.0001/99-2000 dated 23.3.2000 has now adviced that G.R. waiver is not required in the case of Import/Exports covered under Para 5.7 of the Exim Policy 1997-2002. Para 5.7 of the said policy provides for the importation of new or second hand Jigs, fixtures, dies (including contour roller dies), moulds (including moulds for die-casting), patterns, Press tools and lasts, construction machinery, containers meant for packing of goods for export and other equipments on export basis, without a licence on execution of Legal Undertaking / Bank Guarantee to the satisfaction of the Customs authorities.
