When you register as a member with Nocs, you must submit your name and address so that we have another way of securing your identity. We do not want any mistaken identities. Your demographic information is the key to making you as a consumer happier and the advertiser more focused. In addition, we require user-specific information such as interests, gender, age, household income and education, which is used to build a profile of your interests and activity so that your can receive tasks accordingly. We will ask for this information when you register as a member. The only other piece of information that we require for signing up is your email address. The information we request is needed to verify your identity and protect against fraud. Surveys and other information. Demographic and profile data collected at our site may be used to tailor your experience at the site, show you content that you are interested in, and display the content according to your preferences. This information is shared with advertisers on an aggregate basis. What this means to you is that we will not disclose your name, email address or any other personally identifiable information to anyone without your consent. Technology. When you log in to your Nocs' account, we place a text file called a "cookie" in the internet browser directory of your computer. The cookie enables our software to follow your activity at Nocs member area and while completing the assignments. However you activity remains confidential and is only read by our software, not even for our staff. Our software uses cookies to identify the members who cheat by creating multiple accounts or entering bogus information when signing up for programs indicated in the assignments. Therefore there is a rule: Members have to have their cookies enabled and are not allowed to delete or refresh them. If a member does not follow this rule, this may well be a reason for the account termination. Security. This site has security measures in place to protect against the loss, misuse and alteration of the information under our control. All systems are maintained with the latest updates of operating systems and software, including security. We use industry standard procedures and processes to safeguard the confidentiality of your identifiable personal information. Policy on Spam DON'T SPAM!! If you spam your membership with us will be terminated, all monies accrued up to that time forfeited and you may have to pay a fine. Policy on false advertising You must in no way advertise in such a way as to exagerate earnings, or any other activity in regards to Nocs in order to obtain more referrals. This is fraudulant behavior and reason for canceling your account. Cookie Policy Nocs members have to have cookie support in their browsers and are not allowed to delete them permanently. Users found to be deleting cookies will be subject to the following: 1. Account termination 2. Freezing of account or suspension (from new tasks or referral credits). Contacting Us. We value your trust and we are committed to your privacy. If you have any questions about this membership agreement, Nocs.com practices, or feel that your privacy has been compromised in any way, please do contact our online support or the abuse department. Modifications to terms of Membership Nocs may change the Membership Agreement and Policies of membership from time to time. It is your responsibility to check this document periodically for any changes or modifications as there will be no individual notices to Members regarding such changes or modifications. Your continued use of Nocs constitutes an affirmative acknowledgment by you of the Membership Agreement and Policies and any subsequent modifications made to them and your agreement to abide and be bound by them. Requirements for Membership in Nocs To maintain a membership at Nocs, you must meet the following basic requirements: Age requirement. You must be over 18 years of age. You must have a good command of the English language. One Account Per Member. You may only maintain one membership account at Nocs. You may not have simultaneous multiple accounts. If you establish duplicate accounts, we have the right to terminate all of your accounts, resulting in the loss of accumulated credits for each terminated account. Only 1 account per home address is permitted. You must always use your computer to access Nocs and not let others complete tasks for Nocs using your computer as you cannot use other computers to access Nocs. Accurate Information. You must provide Nocs with valid contact and residence information and promptly update that information if it changes. If you impersonate or misrepresent your identity, Nocs may terminate your membership and you will forfeit any earned credits. Nocs may terminate any membership, containing any untruthful information. Legal Compliance. You agree to comply with all local, state, province, country or regional laws that may be applicable to your use of the Internet and your membership at Nocs. Canceling Your Membership. If you wish to do so you may cancel your membership at any time by logging into your statistics and choosing to delete your account. If you decide to cancel your membership and later wish to re-enroll, you will be assigned a new account number. You will not receive credit in your new account for referrals or money made using your previous account. Termination of Accounts. Nocs.com may refuse to accept any application for membership for any reason or for no reason. We may terminate this agreement and your membership without any notice or good cause, and we may at any time terminate your membership by giving you prior notice. Good cause may mean: a. violation of any provision of this agreement b. aiding in or promoting circumvention of the Nocs Service c. acting against the business interests or reputation of Nocs d. otherwise acting in an unlawful manner in relationship to Nocs, the Nocs website, the Nocs Service, or any Internet service provider e. breach of our spamming policy f. any other reason in the sole discretion of Nocs. We reserve the right to terminate member accounts at our sole discretion and may terminate the membership of anyone who fails to meet the above requirements. Your Relationship with Nocs By filling out the registration form you are applying to receive a service. No employee-employer relationship is created by your use of the Nocs web site and its services. Nocs has no obligation to offer our service or other promotions to you. Using the Nocs Service Compensation: Subject to the terms of this agreement, you can earn money or other compensation for completing tasks. Credits will be earned in your account according to the following limitations: No Tampering. You promise neither to simulate, to fake, or to falsify your presence or activities in order to earn money or other compensation or rewards from the Nocs. Simulating, faking, or falsifying your activities may include, among other things, creation, distribution or use of service or other devices that respond to prompts in your absence. You also agree not to tamper in any way with the proper functioning or tracking of the completed tasks. Nocs will terminate your account if you engage in any such simulating, faking, falsifying, or tampering. By completing tasks you are representing to Nocs that you have not engaged in any such activities designed to thwart the purpose of this agreement, such as simulation, faking, or falsifying your presence or assisting others in doing so. Guarantee of Accuracy. You agree and understand that although Nocs will make reasonable efforts to fairly and consistently monitor your actual activities, we can not fully guarantee the precision of the process. You will only be credited for completing tasks which we can verify that you have completed. Paying Rate May Change. The amount of credits that you earn for using the Nocs services, or for use by your referrals may vary. Nocs will compensate you according to the then-current rates for your tasks. All the updates will be sent to your e-mail and you will always be able to see them on our website. The Referral Program If you are accepted as a member of Nocs you may earn credits for the activities of members that you refer to join, or "your referrals," and activities of members referred by your referrals. The Referral Program is subject to the following terms: One Referrer Only. Each new member may only designate one referring member at the time he/she becomes a member of Nocs. You do not get paid for bringing a referral. Referral Levels. You will receive credits only for the usage of Nocs' services of FIVE (5) levels of referrals. Current rates are always posted on the Nocs site. Those are the rates that you will receive. If Nocs for any reason changes payout rates those will be posted on the site and e-mailed to all the members. Referral Limit. You may refer up to 100 direct referrals. Anti-spam Policy. Nocs strictly prohibits the sending of unsolicited mass e-mails of any kind. We will not tolerate spam and will terminate any member who violates our anti-spam policy. Your account will be closed, your referrals will be lost, and you will forfeit any unpaid monies on your account. Furthermore, all members up-line from you will lose the benefit of your referrals. If one of your direct or indirect referrals sends spam, their account will be cancelled. You will lose the potential benefit of having him/her as a referral. Marketing Claims. You agree that you will not make any misrepresentations to any of your referrals or potential referrals about compensation typically received by Nocs members or about compensation that potential members are likely to receive, and to fully comply with all applicable laws related to online "paid to do" companies. Payment Issues Monitoring Your Account Balance. You may view your account balance and the number of referrals that you have accumulated at the Member Area in Nocs. If you have a question about your account balance, contact our online support. Payment Procedure. When you have $500.00 in your account you request payment. Payment methods and instructions are to be found in FAQs. Payments will be made according to the principle of one after the other and after accounts are thoroughly checked for irregularities. Payment is within 8 weeks after the end of the month payment was requested in, unless circumstances dictate otherwise. Account Termination. If your account is terminated you forfeit all credits accrued to your account prior to termination. Your Relationship with Advertisers If you choose to deal with or enter into a transaction or relationship with merchants or advertisers found on the Nocs website (including purchasing goods or services, responding to promotions or discounts or entering contests, and any of the associated terms and conditions), those dealings are solely between you and the merchant or advertiser. By completing tasks sent on your e-mail, you are authorizing the advertiser to share information with Nocs about the promotion, products or services that you obtained from them. Nocs will use this information to help improve the compensation, promotions and discounts offered to Nocs members. You should only join companies that you really want to belong to. Nocs Trademark Usage Policy and License Nocs grants active members a limited license to use the Nocs name, logo and banners. If a member displays Nocs marks on a website that contains content that may tarnish the reputation of Nocs or is otherwise objectionable to us, we may cancel that member's personal account. Material that Nocs considers objectionable and which may not be displayed with the Nocs' marks includes, but is not limited to, content that: 1. Violates the intellectual property rights or other personal or proprietary rights of any third party. 2. Contains or promotes defamatory, obscene, fraudulent, profane or harassing communication. 3. Replicates or "mirrors" all or parts of the Nocs web site. 4. Promotes violence, drugs, militant or extremist views. 5. Promotes discrimination based on nationality, disabilities, race, sex, religion or age. 6. Depicts or promotes sexual acts, nudity, partial nudity or gross depictions. 7. Contains or promotes any unlawful activities or materials. Disclaimer of Warranties MEMBER EXPRESSLY AGREES THAT USE OF THE MEMBER PROGRAM IS AT YOUR SOLE RISK. THE MEMBER PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Nocs EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Nocs MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE MEMBER PROGRAM OR ANY TRANSACTIONS ENTERED INTO THROUGH THE MEMBER PROGRAM. Limitation of Liability TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER Nocs NOR ANY OF ITS PARENTS, MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
