This is the last will & testament of me Major Edward WITHERS of Napier in the
Province of Hawkes Bay, NZ. After payment of my just debts funeral &
testamentary expenses
. I give advise & bequeath unto my wife Fanny WITHERS [m3 of 21] 1 section of
my land in the parish of Kopura in the county of Hobson in the province of
Auckland NZ numbered 3 in the tracing on my crown grant containing [c] 48 acres
together with my presentation tea & coffee set (silver) & my furniture pictures
etc
. also to my d'r Charlotte PURCELL [211] (widdowed) Section 4 in the aforesaid
tracing containing c40 acres together with the bible presented to me by the
congregation of St Peters Church Well'n
. Also to my son Wm [213] Section 30 on the aforesaid Tracing containing c56
acres
. also to my dr Mary Jane [214] the wife of Capt H GREATWOOD Her Majesty's 1st?
Regt Section 29 on the aforesaid tracing c59 acres together with the bible
presented to me by the choir of St Johns Church of Napier
. also to my son Thomas [215] Section 31 on the aforesaid tracing containing
c59 acres together with my silver baton presented me by the Musical Society of
Napier.
. also to my son Edward [216] Section 11 of the aforesaid Tracing containing
c40 acres together with my silver cup presented me by the Officers of the 65th
Regt
. also to my son Alfred [218] Section 39 on the aforesaid Tracing containing
c52 acres together with my 2 marinets A & B; also my NZ Medal
. also to my dr Elizabeth Ann HALL [217] Section 5 on the aforesaid tracing
containing c40 acres with the cask presented to me by the Napier Rifle
Volunteers
. & of the residue & remainder of all my real & personal estate I give &
devise & bequeath the same to my dear wife
. & I hereby appoint Edward LYNDON?, Frank E.., Wm GARNER or the survivor of
them executors of this my will
as witness my hand this 8.10.1875 Edward WITHERS Senior
Attestation
signed & acknwd by the said Major Edard WITHERS as the testator as & for his
last will & testament in the presence of us being present at the same time who
at his reuest in his presence & in the presence of each other have hereby
subscriged our names as witnesses.

CODICIL
I Edward WITHERS late of Napier but now of Auckland NZ do make this addition
to my last will & testament.
. I bequeath to my beloved wife Fanny WITHERS [m3 of 21] in addition to any
other property left her in this document, all that piece of land being x
section numbered 8 on the plan of the township of Woodville containing 1 acre
& 1 rood
. & to my son Charles MacGregor WITHERS [21(11)] I bequeath all that piece of
land being Rural Section numbered 177 on the plan of Woodville containing
36 acres.
. to my dr Kathleen Frances WITHERS [21(12)] I bequeath all that piece of land
being Rural Section 20 on the plan of Woodville containing 40 acres.
in proof witness my hand this day of Feb. 1879.
