The following document is a beautifully handwritten copy of the original will.

This is the last Will and Testament of me John Mitchelmore of Dartmouth in the County of Devon a retired Licensed Victualler made this twenty third day of December one thousand eight hundred and seventy one. Whereof I appoint Robert Lewis Fox of Dartmouth aforesaid Executor and Trustee. I direct my Executor on the day of my funeral to cause a Knell to be chimed instead of the passing Bell and to pay the sum of one pound for the same. I also direct my Executor to cause a brick tomb to be erected over my remains with a large flat cover stone to contain an inscription of my name and age. I give to my son Nathaniel Mitchelmore one feather bed tie all my wearing apparel, one arm chair and three mahogany chairs. I give my watch to my Grandson John Mitchelmore son of the said Nathaniel Mitchelmore. All the residue of my household goods and furniture plate linen and china I give to my daughter Patience Allen. All my monies securities for money real personal and testamentary estate and effects whatsoever and wheresoever I give and devise and bequeath unto my said trustee his heirs executors administrators and assigns upon trust immediately after my decease to make sale and convert such parts thereof as shall not consist of money into money and to stand possessed of the proceeds arising from the sale of such portions of my said trust estate and also of the moneys forming the other portion thereof upon trust to divide the same amongst my children Harriet Joslin, William Henry Mitchelmore, Ann Elizabeth Mallett and the said Nathaniel Mitchelmore and Patience Allen in equal shares and proportions. And I direct that the bequests in this my Will to my said daughters shall be to and for their respective sole and separate use and benefit independent of their respective husbands and so that the same shall not be liable to the debts control or engagements of such husbands. And that the receipts of my said daughters alone notwithstanding their respective covertures shall be a sufficient discharge to my said trustee for the monies payable to them under this my Will. I revoke all former Wills by me at any time heretofore made and declare this only to be my last Will and Testament. In witness whereof I have hereunto set my hand the day and year first before written.

The Testator John Mitchelmore was late of Dartmouth in the County of Devon retired Licensed Victualler and died on the 15th day of February 1872 at Dartmouth aforesaid

This beautifully handwritten document is stamped “Office Copy. Valid only if bearing impressed court seal”.

This is the last Will and Testament of me William Henry Mitchelmore of Dartmouth Devon Butcher. I give devise and bequeath unto my son William Henry Mitchelmore for his own use and benefit absolutely the Dwellinghouse and Shop under one roof in Lower Street Saint Petrox now partly occupied by me and the business of a Butcher connected therewith together with the cellars under my houses in Newcomin Road, but the Walls of such Cellars to belong to the walls of the houses in Newcomin Road. I also give to my said son William Henry Mitchelmore the sum of Two hundred pounds for his own use to be paid out of my residuary estate hereinafter referred to. I give to my daughter Caroline Pillar for her own absolute and separate use and benefit All my houses and premises known as the Island (late Lindsay’s) situate at Bearscove. I give to my daughter Eliza my two Dwellinghouses and premises situate in Newcomin Road Saint Petrox for her own use absolutely except the Cellars thereunder which I have given to my son William Henry Mitchelmore but I again declare that all the walls of the said Cellars are to belong to the houses now bequeathed to my said Daughter. I give to my daughter Kate All those fields and premises with the Slaughter house theirin [sic] called “Batt [?] Parks” for her own absolute use and benefit. I give to my daughter Edith for her own use and benefit absolutely the two houses in Carlton Terrace New Road Dartmouth which I lately purchased from Mr Ashford and I direct that the unpaid purchase money thereon of Three hundred pounds due to the Mortgagee shall be paid by my Executors out of my residuary estate hereinafter named. I give to my son Frederick for his own use and benefit absolutely my fields and premises called the “Ridges” in the parish of Tounstal. I give to my Wife Eliza absolutely All my household goods and furniture except the Shop furniture and materials theirin [sic] or otherwise in the said dwellinghouse used in my trade as Butcher which I have previously given to my son William Henry. I also give to my said Wife Eliza for her use absolutely All my shares and interest in the vessels the “Henry Anning” [?] the Brig “Tawn” [?] and the Pilot Boat “Rose”. All the rest residue and remainder of my real and personal estate of a whatever nature or description the same may be I give devise and bequeath unto my friends James Fairweather of Boohay Farm and Thomas Veale the younger of Bearscove Dartmouth Outfitter their heirs executors administrators and Assigns whom I hereby appoint Executors and Trustees of this my Will upon trust to call in convert and realise the same as and when in their [illegible] discretion they may think fit. And after payment theirout [sic] of my just debts funeral and testamentary expenses I direct them to pay out of such residuary Trust Estate First the said sum of Two hundred pounds hereinbefore given to my son William Henry Mitchelmore. Secondly the said sum of three hundred pounds in discharge of the unpaid purchase money now due from me in respect of the two houses in Carlton Terrace hereinbefore given by me to my said Daughter Edith. Thirdly the sum of Nineteen Pounds and nineteen shillings to each of my said trustees as a remembrance from me. And then to set aside the sum of Two hundred pounds which I hereby give to my son Charles for his own use absolutely to be paid to him on his attaining the age of twenty one years. And after such payments and provisions as aforesaid I direct my Executors to invest the remaining and principal monies of my said Residual Estate and pay Income Dividends and Annual Proceeds to my said wife Eliza for her own use during her life or so long as she may remain my widow she paying thereout the expense of putting my son Frederick to a good boarding school consistent with my position in life for the term of three years and on her death or marriage whichever shall first happen I direct my said trustees to divide the said principal monies of my said residuary estate among my six children namely Caroline Pillar, Eliza Kate Edith Charles and Frederick (leaving out my son William Henry Mitchelmore) but before such division I direct all the properties and legacies given to my last named six children to be made up in value to One thousand pounds for which purpose all the specific properties so given to them shall be valued and the deficiency in value if any made up to such legatee or legatees. And then if after such valuation and payments there be any over of my said trust estate I direct my said trustees to my said last named six children in equal shares. I expressly wish and I direct my trustees to employ as their Solicitor in carrying out the Trusts of this my Will my friend Mr William Smith of Dartmouth Solicitor and to pay him all usual charges and expenses in respoect of the same In witness whereof I have hereunto subscribed my name this seventh day of March One Thousand eight hundred and eighty one.

This is a Codicil to the last Will and Testament of me William Henry Mitchelmore of Dartmouth Devon Butcher which Will bears date the seventh day of March One thousand eight hundred and eighty one. Whereas in my said Will I have given to my son William henry Mitchelmore my Dwellinghouse and premises situate in Lower Street for his own use and benefit now I hereby charge the said premises with the payment of the sum of Thirty pounds per annum to my said wife Eliza in addition to the other bequests in her faver [sic] in my said Will the same to be paid to her by equal quarterly payments and if the same be not duly paid then I hereby give to my said Wife all the powers to recover the said sum of Thirty pounds or any part thereof by distress as if the sum were rent in arrears. I give to my son Charles my Gold Watch and Chain in addition to the sum of Two hundred pounds already given to him by my said Will for his own absolute use and benefit. I give to my sister Hannah Jocelyn the wife of [blank] Jocelyn the sum of Twenty Pounds absolutely. I also give the sum of Five pounds to the said Hannah Jocelyn for mourning. I give the sum of Twenty Pounds to my sister Ann Elizabeth Mallett absolutely. I also give to the said Ann Elizabeth Mallett the sum of Five pounds for mourning. I give the sum of Five Pounds to my sister Patience Allen for mourning and the like sum of Five Pounds for the like purpose to my brother Nathaniel. All these money legacies of Twenty Pounds Twenty Pounds Five pounds Five pound Five pounds and Five Pounds respectively to be paid out of my residuary Trust before the nett amount is ascertained for investment from which my Wife is to be paid the income for life or as long as she remains my Widow And in all other respects I confirm my said Will. In witness whereof I have hereunto set my hand this ninth day of March One Thousand eight hundred and eighty one.

The Testator William Henry Mitchelmore was late of Dartmouth in the County of Devon Butcher and died on the tenth day of March 1881 at Dartmouth aforesaid.

This is the last Will and Testament of me Nathaniel Mitchelmore of Dartmouth in the County of Devon Painter. I appoint my Wife Elizabeth Mitchelmore sole Executrix of this my Will hereby revoking all former Wills at anytime heretofore made by me I give my Watch to my Son Augustus John Mitchelmore for his own use absolutely I give my Watch Chain to my Son William Arthur Mitchelmore for his own use absolutely. I give my business and Stock in trade as follows namely: One third to my said Wife for her own absolute use and benefit, one third to my Son Charles Frederick for his own absolute use and benefit and the remaining one third to my Son Alfred Ernest for his own absolute use and benefit. As to all the rest and residue of my real and personal estate of whatever nature or description the same may be or wheresoever situate at my decease after payment of my just debts funeral and testamentary expenses (except trade debts which are to be paid out of my said business) I give devise and bequeath the same to my said Wife Elizabeth Mitchelmore for her own sole and separate use absolutely In witness whereof I have hereunto set my hand this ninth day of March one thousand eight hundred and ninety seven.

This is the last Will and Testament of me Elizabeth Mitchelmore of Dartmouth in the Country of Devon Widow. I appoint my Son Charles Frederick Mitchelmore and my daughter Emily Florence Mitchelmore Executor and Executrix of this my Will hereby revoking all former Wills at anytime heretofore made by me. I give unto my said Daughter Emily Florence Mitchelmore for her own sole use absolutely my leasehold Dwellinghouse and Shop situate at Hanover Square Dartmouth As to all the residue of my Estate real and personal I give devise and bequeath the same after payment thereout of all my just debts funeral and testamentary expenses unto all my children who may be living at my decease in equal shares absolutely as tenants in common. In witness whereof I have set my hand this 25th day of April 1899.
