Behind the Scenes of the Kobe Case
KF: Matt, I need to see you. Matt Herr: Not again. Will you stop stalking me? KF: But it's important! (starts crying) Matt: What's wrong. KF: I was raped by Kobe Bryant. Matt: Yeah right! KF: It's true! He's staying at our hotel tonight. Matt: Look, I have plans tonight. KF: You mean that skank girlfriend of yours? You're too good for her! Please come over Matt! I need you! Matt: Ok fine, I'll be right there. Ring, ring. Matt's GF: Hello. Matt: It's me. You'll never believe what happened. Kate called me up. She said she was raped by Kobe Bryant. Matt's GF: Yeah sure. First the suicide attempts, now this? She'll do anything to get your attention. Matt: Look if she was really raped, I need to see her. Later.... KF: Matt! Thanks for coming. Matt: Are you alright. KF: Oh Matt, it was horrible! He choked me and forced me to have sex with him! Matt: What can I do to help? KF: Have sex with me. Matt: What? KF: Do me now Matt! KF then text messages Matt. KF: Matt, I think they'll be able tell we had sex! Matt: No way! How? KF: With DNA tests! Matt: Duh.... DNA? What's that? --- Detective Winter's investigation. Pietrack: Yeah, I saw her afterwards. She was real upset and she said Kobe choked her. Winter: Ok, we'll be in contact. Who's next? Rich: The night auditor. -- Night Auditor: Yeah I saw her. She looked fine. Nothing seemed wrong with her. Winter: Yeah whatever. Rich: We should bring her in and find out what she knows. Winter: What for? Forget her. She doesn't help the case so let's just pretend she doesn't exist. -- Greg Crittenden: So are you going to press charges? Mark Hurlbert: Yeah of course. We don't get many BIG cases like this. Crittenden: But aren't you going to wait for the results of the DNA tests? Hurlbert: What for? Kobe already admitted he had sex with her. Two weeks later. Crittenden: Um... the DNA results came back. Hurlbert: Let me see....... WHAT? Someone else's semen was found on her panties? HALT all testing immediately! We have to keep this a secret! Crittenden: What if the defense asks for samples? Hurlbert: Well they can't have it! Don't worry, the rape shield will protect us. This evidence will NEVER come out. Crittenden: We have a weak case. We're not going to win this. Hurlbert: We're going to have to poison the jury pool. We need to leak out some damaging info on Kobe. Crittenden: I know! How about we say she was beaten up! She had bruises all over her neck! Hurlbert: Good idea! Crittenden: And she needed stitches! -- KF: Johnray, could you appear on tv and speak out for me? Everyone is writing bad things about me. I need someone to stand up for me! Johnray Strickland: I can't. Look, I want to help you but..... KF: I'll give you a blowjob. Johnray: Ok, done! Johnray's tv interview. Johnray: Yeah she attempted suicide twice. I just told the truth. -- The Preliminary Hearing. Mackey: We want the hearing closed. Hurlbert: Why? What are you scared of? We want it open so that everyone can see what a rapist Kobe is! Mackey: If you say so...... Later.. Mackey: Are they consistent with having sex with 3 different men in 3 days? Crittenden: OBJECTION! Closed Doors: Hurlbert: We want the rest of the hearing closed! Judge Gannett: I thought you wanted it open. After the hearing, Hurlbert addresses the media. Hurlbert: You have to understand. We didn't present the full case. We only presented the barebones minimum amount to bind the case over. Crittenden: Nice spin job. Think they bought it? Hurlbert: I don't know. We better get Norm Early to back us up. Crittenden: Yeah, we should leak out some more false info as well. Hurlbert: How about.... lets say that Kobe told her "No one will believe you over me". Crittenden: That's brilliant! Everyone will hate Kobe for that! No wonder you are the DA! -- The Hangman T-Shirts Hurlbert tells the media: I have no idea what you're talking about! I don't know anything about no t-shirts! Crittenden: I think they can track the shirts to us! Hurlbert: Damn.. wait... I know! I'll just say I threw the shirt away as soon as I got it! Crittenden: But you still have the shirt. Hurlbert: So? How would they know? -- Pre-Trial Hearings Hurlbert: Do you know how she wore her underwear? Dr. Johnson: What do you mean? Hurlbert: Well she could have wore it backwards, right? Dr. Johnson: I suppose so. Hurlbert: But you don't know, do you? Dr. Johnson: No, I don't know. Hurlbert: What's that? I didn't hear you. Dr. Johnson: I said I don't know. Hurlbert: No further questions. Crittenden: Great job! You sure showed her! Hurlbert: Thanks. I was great, wasn't I? Did you see that look on her face when I asked her that question? I had her totally confused! Crittenden: Yeah that was great! Dana Easter: (rolls eyes) -- Meanwhile.... Crittenden: The defense is going to want an expert present when we conduct tests. Hurlbert: Let's select a lab that doesn't allow anyone to view the testing. Crittenden: Won't that piss off the judge? Hurlbert: So what? We'll just blame it on the lab. Crittenden: Good idea! But what if he doesn't fall for it? Hurlbert: We'll just withdraw our request. No big deal. Crittenden: But don't we want to confirm the tests? Hurlbert: Don't worry about it. We can always claim the defense experts contaminated the evidence later on. -- Meanwhile..... Hurlbert: So what do you think of the evidence. This proves Kobe raped her, right? Michael Baden: It's inconclusive. This could have come from consensual sex. Hurlbert: Oh yeah? You sure about that? If you don't agree, I'm going to have to drop you from the case. Baden: That's my expert opinion. Hurlbert: Fine, you're outta here! Crittenden: What do we do now? Hurlbert: We'll have to find someone else. Weeks later... Crittenden: I searched and searched but I couldn't find any expert who would back us.... unless.... Hurlbert: Unless what? Crittenden: Well there is some sort of Fish expert who is willing to support us. Hurlbert: Well then hire him already! -- Judge allows DNA evidence in. Krista Flannigan: This ruling wasn't a surprise. We totally expected it. This doesn't change anything. We're still proceeding with the case and the victim is completely committed. She is so brave and heroic. I wish I had her strength. She is a role model to us all. Meanwhile in the DA's office. Hurlbert: This ruling is a complete disaster! Crittenden: What are we going to do now?! Hurlbert: Let's appeal to the Supreme Court! Crittenden: Yeah and time to leak more false info! Hurlbert: Get SI to release that story about the Orlando woman. That'll get everyone's attention off of this. -- Hurlbert: Damn! The Supreme Court won't review our appeal! Crittenden: What do we do now? Hurlbert: Let's ask for a continuance! -- Hurlbert: Damn! The judge ruled against us again! Crittenden: It's over. Hurlbert: No it's not! Remember my backup plan. We can still accuse the defense of tampering with the evidence! Crittenden: But can we prove it? Hurlbert: Who cares? We can delay the trial even further and poison the jury pool some more. -- Easter: We believe the DNA evidence may have been contaminated. Judge Ruckriegle: Can any of your experts confirm this? Easter: Yes they can. Ruckriegle: Who are they? Easter: Who? Ruckriegle: The experts. Identify them. Easter: Er....uh... well......um... we can't identify them at this time. They're top secret. We cannot allow their identities to be revealed. We believe their lives may be in danger from the defense, should they learn of their identities. Ruckriegle: Uh huh. I'll give you until next week to provide more details. -- Meanwhile... Clune and Wood discuss the civil case with Kate. Wood: There's no way the prosecution is going to win this case. And that'll weaken your chances of winning a civil trial so I would advise you drop out of the criminal case. Meanwhile I'll appear on tv and plant the seeds. I love being on tv. KF: But I'll still get his money, right? Wood: No, WE will get his money. Clune: I get to appear on tv too right? Wood: Yeah, you just sit there and agree with everything I say. Wood appears on tv. Wood: She needs to rethink whether she wants to go through with the criminal trial or not. The court has failed her and she may not want to proceed. Clune: Yeah, what he said! Flannigan: That's a lie! She is 100% committed to the case! She is so brave and strong!Nothing has changed! This case is going forward! -- Hurlbert drops the case. Hurlbert: Today I have reluctantly made the decision to dismiss the case. Even though we have a great case, a fantastic case, there was no way we would have lost this case with all the evidence we had, and despite the fact we can continue this case without her, we have decided to dismiss this case only because of the victim's decision not to proceed with the trial and for that reason alone. No other reason. Absolutely no other. I encourgage any victims to come forward. I have proven that I will fight for you! I have fought to the bitter end in not one but TWO rape cases and dismissed BOTH of them right before the start of the trial! Other DAs would have given up and not even pressed charges! And finally, I'd like to accept this award for the most incompentent DA of the year. Thank you for this award. I'd like to thank Sheriff Hoy for going behind my back and arresting Kobe. Without him, I would have never won this award. I'd also like to thank my sidekick Greg Crittenden who almost beat me out for this award. The two of us made an unstoppable team. I'd like to thank Detective Winters for doing such a wonderful investigation. Thank God he didn't check the entire crime scene, the bed, the chair, or the bathroom. If he had, this case might not have gotten this far. Thank you Detective Winters. The Aftermath. Wood and Clune appear on Abrams. Abrams reads Winters testimony from the preliminary hearing. Wood: No no no, his memory is wrong! Abrams: He's wrong? Wood: No! He just didn't have the complete story. Abrams: She has a different story? Wood: No no no! Her story is just more detailed! Abrams: Different? Wood: No no no! That's not it. Just more complete! Clune: Yeah, that's right! Abrams you heard him! -- Interview with Dana Easter Easter: After she left Kobe's room, she made a beeline to leave the lobby. Winters: No she didn't! Easter: Yes she did! Winters: No she didn't! She told me she stayed at the front desk to count the money from the cash registers! Easter: Oh yeah? You didn't have the complete story! Winters: Oh ok. Easter: She also said she didn't know who Kobe was. Winters: No she didn't! Easter: Yes she did! Winters: No she didn't! She told me she was excited to meet him! She was supposed to leave at 7pm but wanted to stay so she could meet him! Easter: Oh yeah? You didn't have the complete story! Winters: Oh ok. How come she never tells me anything? She told someone else about the tattoo on her back but only tells me about the ankle tattoo. She tells the nurse about the oral sex but wouldn't tell me about it. What's going on here?!
