City of Oakland's request for imposition of conditions per Business and Professions Code section 23800(e) To Whom It May Concern: After a review of this property, the City of Oakland hereby requests that conditions of operation be imposed on the ABC license for the above location upon transfer. The location has been a thorn in the side of the neighborhood for many years. The proposed, transferee, Walid Thabet Aldafari, has been managing the store for a number of recent years and has been the subject of numerous neighborhood confrontations and complaints. These conditions are needed overall, but especially if he becomes the licensee. This location has a history of loitering and has been the center of public nuisance activity in the surrounding neighborhood. The community has expressed this in numberous letters, which are attached to this letter. 1. Hours of Operation - The hours of operation shall begin no sooner then 8:00 a.m. and end no later then 8:00 p.m. Monday through Saturday. Hours of operation shall begin no sooner then 8:00 a.m. and end no later then 6:00 on Sundays. These are the current hours, which the establishment is voluntarily operating under, according to potential transferee, walid Thabet Aldafari (who is currently managing the store.) 2. Security Guard - A uniformed sucurity guard, licensed by or registered with the California Department of Consumer Affairs, shall be provided by the Licensee between the hours of 6:00 p.m. until thirty (30) minutes after closing each day of the week in order to maintain order at the premius and prevent harassmsnt of pedestrians and prevent activities which would interfere with the quiet enjoyment of the property by customers, nearby residents, and owners and occupants of adjoining properties. 3. Exterior Lighting - The sidewalks adjoining the property shall be equipped with lighting of sufficient power to illuminate and make easily discernable the appearance and conduct of all persons on or about said premises. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences. 4. Litter Cleanup - The Licensee shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control. 5. Video Camera System - Within 30 days of the transfer, the Licensee shall install a video camera monitoring system with interior and exterior cameras, with at least one camera monitoring each perimeter front door. The video monitoring system shall be activated during business hours and shall include a videotape recording during those times. Recorded tapes shall be kept for at least a ten (10) day period and be made available to law enforcement and ABC upon request. Sighs with block lettering at least three (3) inches tall shall be posted inside and outside the premises stating "YOUR ACTIVITIES ARE BEING VIDEOTAPED."
