Mr. Willie Siu 3118 Monticello Avenue Oakland, CA 94619 September 18, 2001 URGENT DEMAND LETTER RE: "The White House Market" Dear Mr. Willie Siu, This is a demand letter from more then thirty individuals in the neighborhood surrounding your property 2630 Kingsland Avenue in Oakland. we have tried to work with you in the past on the many problems that stem from the liuor stroe "White House Market" which occupies your property. While you have appeared to cooperate with us at times in the past, and even managed to clear up some of the problems for a few short weeks, the problems soon reappear and have now been ongoing for more then a decade - this, despite any efforts on your part and even ownership changes in the store. neighbors witness and are subjected to: Ongoing drug activity in front of the store, loitering, public drinking, urination and littering. Neighbors who have complained to your tenants are quickly retaliated against. They have their tires slashed or other property damaged. We don't feel safe in our own homes and we are tired of it. We do not want to be subjected to an illeagal and dnagerous environment in our community any longer. We hereby demand that you serve eviction notice to the tenants of the White House Market within 10 days of receipt of this letter. You must send us a written response with proof of your eviction action by certified mail within 15 days from the post date on this letter. If these tenants have not vacated your property in 40 days we will file suit agains you in small claims court and you will face major financial cousequences. Each of us plus each affected member of our family is allowed to sue for damages of up to $5,000. Our case is well documented by both private and public records. We expect to win a combined judgment against you well in excess of $150,000. We hope you will make the right decision to avoid this litigation. Further, if any person involved in this action is retaliated against, both you and your tenants will be held responsible. If any one of us experiences any tretaliation whatsoever - including but not limited to property damage or verbal threats you tenangs names will be added to this suit and they will be subjected to the same financial consequences. Walid, This is a letter to notify you that we are about tho take legal action against your landlord for maintaining a nuisance property in this neighborhood. For years we have been subjected to loitering, littering and many illegal activities in and arround your business "The White House Market". We have been verbally attacked, threatened and had tires slashed as retaliation for our complaints to you and people who work for you. We are suing your landlord so that he will take the appropriate action to evice you and close the store which is detriment to our community. Oru law suit will be pursued by over thirty individuals in small claims court and will amount to damages in excess of $150,000. At this time we have not named you nor other related parties in connection with this legal action. HOWEVER, should any person in the surrounding neighborhood experience any threats, property damage or any kind of harm whatsoever, your name will immediately be added to this law suit and you will be subjected to the sameserious financial consequences.
