The Petition of Milton Richard Brown, of the Village of Appin in the County of Middlesex, cheesemaker, Edwin Arthur Brown of the Township of Bayham in the County of Elgin Farmer, Fred Joseph Brown of the Township of Dereham in the County of Oxford Farmer and Carrie Josephine Jackson of the Village of Union in the County of Elgin Married Woman.
Humbly showeth that Enoch Burdick Brown
late of the Township of Dereham in the County of Oxford Farmer,
deceased, died on or about the 27th day of May at the Township of Dereham in
the County of Oxford and that the said deceased at the time of his death had
fixed place of abode at Township of Dereham in the County of Oxford.
That the said deceased in his lifetime duly made his last Will and Testament bearing date the Fourteenth day of April in the year of our Lord one Thousand nine hundred and two.
That the said deceased conveyed during his lifetime all his real estate itemized in his Will except that mentioned in the Inventory and Valuation and ... (five cars of a pool?)... to his son Fred Joseph Brown all the household furniture disk implements as mentioned in this will.
THAT your petitioners are the executors named in the said Will of said Enoch Burdick Brown deceased except Walter Williams Brown who has surrendered his right to probate and executor to said Will.
THAT the value of the whole property of the said deceased which he in any way died possessed of, or entitled to, and for and in respect to which PROBATE of the said Will is to be granted is under the value of Twenty eight thousand five hundred
THAT there are no personal estate and effects.
AND of the real estate is under Twenty eight thousand five hundred.
And that full particulars and appraisement of all said property are exhibited herewith and verified under oath.
WHEREFORE your petitioners pray that Probate of the said Will of the said deceased may be granted to them M R Brown, F. J. Brown, Carrie J. Jackson, E. A. Brown

This petition is filed on behalf of the applicants by Ball and Ball their solicitors.
Know all Men by those Present that I Enoch Burdick Brown of the Township of Dereham in the County of Oxford in the Province of Ontario, Farmer, being of Sound Mind Memory and understanding do make publish and desire this to be My last Will and Testament revoking all former Wills.
First - to wit I give Devise and bequeath to My Son Milton Richard Brown the sum of one Dollar I having given him his portion before.
Second - I give Devise and bequeath to My Son Edwin Arthur Brown the sum of one Dollar I having given him his portion before.
Third - I give Devise and bequeath to My Son Walter Williams Brown his heirs and assigns forever all and Singular that certain parcel or tract of Land and premises situate lying and being in the Township of Dereham in the County of Oxford and Province of Ontario constraining by all measurement two hundred acres more or less being composed of Lot Number twenty-five in the Eleventh concession in Township of Dereham aforesaid excepting this out - so much as have been sold to the Canada Southern Railway and subject to two Mortgages which Mortgages he is to pay and a legacy of two thousand Dollars to My younger Son George Lish Brown to be paid in the following manner without interest that is to say two hundred Dollars one year after My Decease and two hundred Dollars each and every year until the whole two thousand Dollars is fully paid and that the above legacy of two thousand Dollars shall be a on the above mentioned lot - if Land Number twenty five in the Eleventh concession of the Township of Dereham aforesaid until the whole two thousand Dollars is fully paid and satisfied.
Fourth - I give Devise and bequeath to My Son Fred Joseph Brown his heirs and assigns forever My homestead known as Swansa Hill all and singular that - certain parcel and tract of Land and premises Situate lying and being in the Township of Dereham in the County of Oxford and Province of Ontario being composed of the South half of Lot-Number twenty two in the tenth concession in the Township of Dereham in the County of Oxford and Province of Ontario being composed of Lot - Number twenty two in the tenth concession of the Township of Dereham aforesaid one hundred acre more or less excepting the without - so much as has been sold and conveyed for Village Lots and School site or may be sold before this will takes effect.
Fifth - I give Devise and bequeath to My Son Fred Joseph Brown his heirs and assigns forever all and singular that certain parcel and tract of Land and premises situate lying and being in the Township of Dereham aforesaid containing by admeasurement about Eighty Six acres more or less being composed of the south half of Lot Number twenty in the twelvth concession of said Township Subject to a Mortgage which he is to pay.
Sixth - I further will and Devise that Fred Joseph Brown on account of him getting the homestead he shall pay my three Daughters the sum of Eleven Hundred Dollars to each one Anna Maria (wife of Elgin H Foster), Ida Rebecca Elizabeth (wife of Rev. C W Brown), and Carrie Josephine (wife of Dr George H Jackson), in the following manner without interest that - is to say one hundred Dollars to each one, one year after my decease and ond hundred Dollars to each one, each and every year until the whole these legacies to my three Daughters amounting to three thousand three hundred Dollars shall be fully paid and that - the legacies to My three Daughters shall be a lien on the south half of Lot - Number twenty - two on the tenth concession of the Township of Dereham, County and Province aforesaid until the whole amount of the three legacies to My three Daughters shall have been fully paid.
Seventh - I further will Devise and bequeath to my Son Fred Joseph Brown all of my live stock, horses, cattle, hogs, sheep and poultry. My farming implements machinery harness waggons, carts, Pheaton Buggies and cutters and all of the household furniture excepting the silverware which is to be divided between My three Daughters.
Eigth - I further will Devise that my Son Fred Joseph Brown on account of getting the homestead, live stock, and household furniture, shall pay all of my just debts and Funeral charges and expenses and that he shall have my casket and body bricked in by the side and in the same manner as his Mother's and that he shall have My name the date of My Birth and Death inscribed on the Tombstone.
Ninth - I will Devise and bequeath to Isaac Joinis Village Lots Number seventy seven and Seventy Eight - as now fenced in together with the house and barn in the Village of Brownsville containing about one half acre more or less during his natural life in lieu of any wages he may claim he may claim after My decease I further will and Devise that Fred Joseph Brown shall give him a good and comfortable home and what spending money is necessary for him during his natural life or as long as he keeps in his right mind and to give him a decent burial when he dies after his Death the above mentioned Lots shall belong to Fred Joseph Brown.
Tenth - I will and Devise that Fred Joseph Brown shall give Miss Abagail Josiphine Williams a good and comfortable home as long as she wishes to stay with him and this - each one of my sons pay her five Dollars per year after my decease as long as she stays here with him for helping to make the old home comfortable homelike and pleasant when they come home to visit.
Eleventh - The rest and residue of my real and personal property and estate of which I may be possessive of at the time of my decease or of which I now own consisting of about nineteen acres of land in the Town of Fort William on Island No one being composed of the east half of Lot No three about - seven and seven tenths acres and teh west half of Lot No two about ten and eleven twentieth acres all in con 5 and water lot about one half acre together with my personal property that I may have and as Notes of Land Bonds or Stocks which I have not heretofore bequeathed shall be sold by my executors hereinafter named to the best advantage and after my decease shall be equally divided between all of my eight children or their heirs with the exception of Milton Richard Brown, who has had his full share before but if he will pay the taxes on the Fort William property for three years for the years 1902, 1903 and 1904 and pay Fred Joseph Brown fifty Dollars toward my funeral expenses he then shall be entitled to an equal share with the rest of my children to share and share alike and if the Fort William property is not sold before that term all of my sons shall pay an equal share of the taxes until it is sold and in case any one fails to pay their share of the taxes the amount so paid for taxes shall be deducted from out of their portion with seven percent interest per annum.  When the property is sold and the proceeds is paid over to each one of my children or their heirs or solicitor.
Twelfth - And lastly I nominate and appoint Milton Richard Brown, Edwin A. Brown, Walter Williams Brown, Fred Joseph Brown and Carrie Josephine (wife of Dr. George H Jackson), executors of this my last will and testament in testimony whereof I the said Enoch Burdick Brown have hereunder subscribed my name and affixed my seal this Fourteenth day of April in the year of our Lord one thousand nine hundred and two at Swansa Hill.
