Last Will & Testament of James Jeffress

The following material is the Will of James Jeffress as copied from Lunenburg County, Virginia Will Book Number 9, pages 408, 409 and 410. David Jeffress obtained a copy of this will from Grace T. Marshall, Deputy Clerk CIRCUIT COURT CLERK'S OFFICE LUNENBURG, VIRGINIA ON 29, AUGUST 1987. [From the research of DJ Camden]

In the name of God amen, I James Jeffress of the County of Lunenburg do make and ordain this to be my last will and Testament viz:
Item 1st, At my death I give and bequeath to my daughter Jane C. McCutcheon and her heirs forever one negro woman named Jenny and her three children named Richard, Branch and Patrick. Also one negro named Dale, and a girl named Lucy, with the future increase of the females, one horse saddle and bridle which she has now in her possession. Also one Yoke of Oxen, and two cows and Calves, one black walnut folding Table, and one walnut Cubbard (sic), two feather beds, Steads and furniture one large and one small.
Item 2nd, The negroes and other property heretofore given to my daughter Sally Sneed, as also the other property I have heretofore given my other married children, I hereby confirm such gift to them and their heirs forever.
Item 3rd, At my death, I give to my son, Thomas H. Jeffress, my still and all the books of mine which he has in his possession.
Item 4th, I lend to my beloved wife Nancy Jeffress during her natural life, all my lands, Plantation, utensils and Houses, on which I now live, also my slaves and other property not heretofore mentioned. I also give and bequeath to my wife Nancy Jeffress one negro woman named Siloy.
Item 5th, At my wife's death, I give to my daughter Jane C. McCutcheon two hundred acres of land whereon I now live, including the houses I now live in.
Item 6th, At the death of wife Nancy, I give the residue of my land to be equally divided between my two daughters, to wit: Prudence R. Blackwell and Polly G. Norment.
Item 7th, At the death of my wife, I give to my son, Thomas H. Jeffress and my daughter Narcissa W. Hatchett all the land that falls to me in Nottoway County left me in my Father's Will, if recovered, Otherwise, I will that my Daughter Narcissa W. Hatchett should share equally in the land given to Prudence R. Blackwell and Polly Norment.
Item 8th, At the death of my wife Nancy, I give all the property heretofore lent her to be equally divided in Seven Shares, to wit: William B. Jeffress, one share, Thomas H. Jeffress, one share, Prudence R. Blackwell one share, Polly G. Norment one share, Narcissa W. Hatchett one share, and Jane McCutcheon one share and Nancy Roberts children, one share to be divided equally between them, to them and theirs forever.
Lastly. I nominate and appoint as executors to this my last will and testament my brother Richard Jeffress, and my two sons in law John A. Hatchett and Alexander McCutcheon. In testimony whereof, I have hereunto set my hand & affixed my seal this nineteenth day of January, One thousand Eight hundred and twenty nine.

In Lunenburg County court, the 13th of April, 1829 The Last Will and Testament
of James Jeffress deceased, was proved by the oaths of Jordan W. Jeffress and James Baker witnesses thereto and is ordered to be recorded. And on the motion of John A. Hatchett one of the Executors therein named, who made oath thereto, and together with Chapman Blackwell, Jordan W. Jeffress, Thomas H. Jeffress, Alexander E. McCutcheon, Armstead Bruce and Francis Carter his securities, entered into and acknowledged a bond in the penalty of Thirty thousand dollars, Conditioned as the Law directs, Certificate is granted him for obtaining probate(e) of the said will in due form, liberty being reserved to the other Executors named in the said will to join in the probat(e) when they shall think fit.
