Alder Hey Litigation At the case management conference in March, the trial judge "stayed" the litigation to see if the case could be resolved by mediation - where an agreement is reached between the hospital and the families rather than having to go to court. If successful, mediation will resolve things quicker than having to go to court, and can reach other outcomes rather than just compensation. Trying mediation may also reduce the chance of costs being awarded against people who do not have Public Funding (Legal Aid). At the end of May the lawyers have to go back to court to let the judge know if any progress with the mediation has been made. As you may already have heard, Alder Hey have brought Liverpool University into the litigation. This means that the hospital would be seeking a contribution from the University if compensation were to be paid out. The University are considering their position and may join in as another defendant.
