The Timisoara’s First Court ruled a few days back on the issue
of the sale of the apartments of the ex-Comtim’s block of apartments to their
tenants. This ruling comes after two
years before they were promised that the liquidating company will sell to them
the apartments. Then the people have
paid part of the requested amount, which was eventually reimbursed. This autumn the tenants requested from the
Court to rule on the possibility to purchase the apartments in which they are
tenants. On the first Court date the Judge Mircea Todor ruled in
favor of the tenants. In other words PriceWaterCoopers,
Comtim’s liquidator, is required to sell the apartments to the 79 tenants. The liquidator can appeal, as in its quality
PriceWaterhouseCoopers is mandated to sell as many and as dear as possible
Comtim’s assets in order to cover the debt of the company. It is
interesting, however, that precisely on the day of the trial the company has
decided to announce the public auction of the block of apartments. The tenants assert that this public auctioning
on the same day of the Court trial was an action through which the managers of
the Comtim’s liquidating company intended to bully them. Radu Bufan, director of
PriceWaterhouseCoopers, told us that the company that he represents has placed
the block of apartments on public auction “as an alternative if we win the
trial.” He added that the company will
appeal the First’s Court decision and he expects a positive reaction. “Up to this moment we didn’t negotiate the
sale of the block of apartments with anyone.
We only discussed it with the tenants.”
