2.1 |
At the AGM of the KwaZulu Natal Swim Board, the management Board of Nine members shall be elected. Approximately 50% of the elected members shall be from the previously disadvantaged sector. |

Should there not be a sufficient number of nominations, then additional member/s may be elected from the floor. |
2.3 |
The Board may co-opt additional members and appoint "ad hoc" committees provided they have obtained permission at a Forum meeting. |
2.4 |
Immediately after the KwaZulu Natal Swim Board AGM, the elected members and nominated members shall choose a convenor and a deputy. These shall be elected in terms of the guidelines laid down by Swimming South Africa. The convenor shall have a casting vote in all matters and shall chair the meetings of the Executive, Council and Forum. Should the convenor not be present, the authority and voting powers will pass to the deputy convenor. |

The KwaZulu Natal Council shall comprise of nine Management Board members, plus the nominee of the various Associations and Primary, High and a Tertiary Education School representative. |

The KwaZulu Natal Forum shall comprise of the management Board plus the nominated members making up the full Council plus two representatives nominated from swimming clubs registered with KZNAA. |
2.7 |
All meetings convened by the Management Board shall have a quorum of four members present in person. |
2.8 |
All meetings convened by the Swim Council shall have a quorum of five members present in person. |
2.9 |
All meetings convened by the Swim Forum shall have a quorum of forteen members present in person. At least four of those in attendance must be from the Managemnet Board. |
3.1 |
The Board shall produce a budget for the year and run the financial affairs of swimming. The budget shall be presented to KZNAA for inclusion in the overall budget. |
3.2 |
The Board shall organise all matters related to swimming and shall act as advisors to the KZNAA on technical matters related to swimming. |
3.3 |
The Board shall advise on laws and duties to assit officials and if required by KZNAA, constitute an examining body for swimming officials. |
3.4 |
The latest edition of the FINA Handbook shall be an Annexure to these Bylaws. |
4.1 |
Any Management Board Member failing to attend three consecutive Board meetings shall, at the Boards discretion, be deemed to have vaceted the office automatically. |
5.1 |
The Board shall with the help of the Swim Selectors, Officials Society and SCAN set criteria and will be responsible for all teams and the managemnet support team, which includes coaches and officials. This will include swimming teams for Overseas participation, Senior Nationals, Development Nationals, special squads and any other Provincial or President's teams chosen to represent KwaZulu Natal Aquatics Association. |

The Swim Board Selection Committee will select the teams, management, coaches and captains according to the laid down criteria. They will submit their teams and any additional recommndations to the Board for ratification. |
6.1 |
Unless specifically stated to the contary, the general criteria for selecting Provincial teams will include both short course and long course times. Teams selected to swim at a Provincial swim meet before 1 December will include the previous season's best times. A Provincial team selected to compete at a later date will include only times achieved from the beginning of the current swim season (1 May). |

All selections will be based on merit but where ever possible at least two Affirmative Action swimmers should be included provided the rules of the Tournament so permit. |

Should South Africa lay down the rules of the Tournament and they differ from our Provincial criteria for that specific Tournament will be set out by the Board and the criteria circularised to all clubs |
7.1 |
The swimming year shall start at the 1st Day of May and end ofn the 30th day of April the following year. |
7.2 |
The swimming year shall be divided into two seasons. Summer and Winter. The winter swimming season shall start on the 1st day of May. The summer swimming season shall start on approximately the 1st day of October and end on the 30th of April the following year. |
7.3 |
The Board shall determine the programme and contents for both seasons after clubs and other interested parties have submitted written recommendations and suggestions. The closing date for these submissions shall be the end of December for the winter season and the end of April for the summer season. |

Clubs to be advised of the Boards final programme and invited to make written application to host the swim meets. |

The order of priority for KwaZulu Natal swim meets shall be:

8.1 |
The Board shall from time to time call announce the date for clubs to submit applications. All such applications for swim meets shall be submitted in writing. |
8.2 |
Any club hosting a Special Sponsored event falling under the auspices of KZNAA and imposing a competitiors fee, shall first discuss and obtain permission from KwaZulu Natal Swim Board with regard to the programme, entry formalities and fees etc. |
8.3 |
Should permission be granted, then the host club shall be levied and amount of ten percent per entry provided the fee per event exceeds the minimum amount set down by Swim Board. Fifty percent of the amount received will allocated to funds set aside for the previously disadvantaged. |
9.1 |
On receipt of the applications to host swim meets and after the closing dates for applications, the board shall immediately draw up the swimming programme for the season. |
9.2 |
The Board shall, at its own discretion, allocate any swim meet, to any club or combination of clubs who have not made application to host a swim meet, or to clubs who have not been successful with the application for a specific swim meet. |
9.3 |
In the event of a duplication of applications, the Board shall decide on the club to be awarded the swim meet. Should a dispute arise in the event of two or more clubs making application for the same swim meet, and the matter is not resolved satisfactorily, the Board shall refer the matter to KwaZulu Natal Aquatics Association, who will make the final allocation. |
9.4 |
Any club/s being eliminated shall be given first preference when dates are allocated the following year. This will not apply to a club that applies for more than one swim meet. |
9.5 |
There are number of successfully established special sponsored events and the host clubs will be given first refusal to stage such swim event. |
9.6 |
Unless a club states otherwise in its application to stage a swim meet, all swim meets shall be declared open. This does not apply to Level 1 Division swim meets, which are closed. |
9.7 |
An open swim meet is defined as one in which members of more than one club are eligible to compete. Swimmers may come from clubs outside the Province or Country, provided they have the necessary clearance and pay the participation fee. |
9.8 |
Special Inter-club invitation swim meets may be held, provided they do not clash with KwaZulu Natal meets. The necessary permission should be obtained from the Board. |
9.9 |
The Swim Board reserves the right to set standard times for various swim meets to be staged throughout the season. |
9.10 |
The Board may stage swim meets on any suitable vacant dates appearing on the programme. |
9.11 |
The proposed dates of swim meets together with both the Developement and the KwaZulu Natal Championships, shall be submitted to KwaZulu Natal Aquatics Association for approval. |
10.1 |
All legs of the Natal Swimming Championships are declaed open events. |
10.2 |
The Chamionships shall be staged in a 50m pool, with electronic timing. |
10.3 |
All events shall be staged according to the Championship programme. |
10.4 |
Local times submitted for entry into a championship event must have been recorded in an official swim meet, or at an approved time trial. |
10.5 |
Time trials, may only be swum, at the discretion of the Board and or the Technical Committee. Applications for a time trial must be in writing, setting out the reason for requesting the time trial. Such Application shall be made at least three days prior to the event. |

An event entrant fee. determined by the Board, will be levied. This will include relay events. |
10.7 |
Entries for the KwaZulu Natal Championships close approximately fourteen days before the staging date of Leg One. The Board shall determine the precise date. The age of the entrant will be as at the 1st day of the championship. |
10.8 |
Only registered KZNAA level 2/3 Division swimmers may enter. This rule does not apply to vistors. |
10.9 |
All KwaZulu Natal Championship entries must state the entrant's fastest time of the CURRENT SEASON for the event concerned and the entry shall be made on the supplied by KZNAA. For the purpose of this Clause, the CURRENT SEASON shall be any official swim meet or time trial staged after the 31st of April. Entries with no times will not be considered. Local entries will be captured through the KZN database. |
10.10 |
Times other than those mentioned above shall only be accepted on the approval of the Board. If such times are submitted to the organising body they shall forthwith be advised to the Chairmen of the Boards Competition and Planning Committee, who in turn will obtain a ruling from the Board. |
10.11 |
The KwaZulu Natal Swimming Championships shall be conducted on a basis of qualifying heats and finals. Distance events may be run as timed finals. The Board shall stipulate the Competition Organising Committee shall seed the method of conducting heats and all entries. |
10.12 |
A registered KwaZulu Natal swimmer may only win trophies. Medals shall be awarded to the first three KZN swimmers and this includes members of the relay teams. Should a 'vistor' be places he/she shall receive the appropriate vistors medal. |
10.13 |
Record certificates shall be awarded to a competitor or relay team equalling or bettering an existing KwaZulu Natal Record which shall be signed by the President and Honorary Secretary of KNZAA. |
10.14 |
No registered KwaZulu Natal Level 1 Division swimmer may participate. This rule included relay events. |
10.15 |
The member's names of a relay and order of competing must be submitted thirty minutes before the start of the session. Substitutions may only be made in the case of a medical emergency. (Documented proof is required) or at the discretion of the referee. Failure to swim in the order listed will result in disqualification. All age group relay teams must comprise swimmers in their respective age groups. Should a club not be able to make up a relay team, they may call upon swimmers of a younger age group to fill the team. The younger swimmer/s may not compete at a later stage in a relay team in their own age group. This concession will not apply to a club with two teams entered in the same age group relay event. Any swimmer may compete in an open relay team. |
10.16 |
Scratching: Swimmers who qualify to swim in a final, but wish to withdraw, shall within fifteen minutes of the last events of the heats, advise the recorders in writing of their intention to scratch from a final. Swimmers who do not turn up or scratch will not be allowed to partake in any individual finals in that session. A fine will be imposed on the swimmers club. A swimmer need not scratch from heats or timed final events that are not deemed fast finals. i.e. if the fast timed final is swum with the normal finals programme. |

The level 1 Division Championships are closed to KwaZulu Natal Level 1 Division swimmers only. |

The Championships shall be staged in a 50m pool, with eletronic timing. |

The fastest entry time allowed would be the same as that set at the speed limit for entry to Development Nationals. The swimmer must meet the standard of the set qualifying times. |

The Championship will be a pre-entry swim meet. |

All level 2/3 Division meets are open and the hosting club is required to run and stage the meet under the KwaZulu Natal Swimming Laws. Swimmers from outside the Province of KwaZulu Natal may compete, provided the competitor's Home Province or Country has granted the competitor. Seedings shall be divided into four age groups. 11and under, 12 and 13, 14 and 15 and open. Clubs wishing to include relay events in a set programme may aply in writing to the Board at least four weeks before the date of the meet. |

All clubs staging a level 2/3 Division swim meet, shall submit a completed programme dodger to the Board and clubs at least two weeks before the date of the event. |
12.3 |
Closing date for entries for level 2/3 Division swim meets shall be seven days before the actual swim meet. An entry fee (determined by the Board) for swimmers registered outside our Province is required. |
12.4 |
Only level 2/3 swimmers may participate. |
13.1 |
The Board for swim meets shall decide the set programme. |
13.2 |
The events shall be swum in the order of the programme. |
13.3 |
Once the programme has been approved, changes may not be made without the approval of the Board. |
13.4 |
No fees for scratching may be charged for the final, where the fifteen minute rule applies. The hosting club has discretion to keep part or the full amount of the entrant fee. |

A donation of ten percent per entry is payable to KZN Swim Board by the host club, 50% of which shall be used for the development programme should the entrance per event exceed R3.00 per event. |
14.1 |
The age group swimming programme as laid down by the SSA shall apply to KwaZulu Natal Swimming. Sub-Unions are entitled to make their own domestic rules, provided that such rules do not contradict the SSA or KwaZulu Natal rules. All level 1,2 and 3 swimmers may compete. |

Any competitior, who has preseason time faster than the standard qualifying time for Level 2 Nationals must register as a Level 2/3 Division swimmer. |

Only Level 1 Division swimmers may participate. |

Level 0 Division swim meets shall be staged monthly during the summer swimming season. |

The swim meets are part of the development project to recruit, identify talent and introduce the very young swimmers into competitive swimming. |

Clubs must submit a schedule of the names of swimmers who will be taking part at these meets and pay the necessary administration fee. |

Five swim meets will be held during the summer swim season. The final swim meet will act as a Championship event. |

Relay League swimmers who have not registered, as Level 1,2 or 3 Division swimmers must follow the same procedure and register through their club on a schedule. |

At aal open and Level 1 Division swim meets, no matter under which staging body, the referee, chief judge, chief timekeeper, chief electronic recorder and the starter, shall be appointed for such duties by the technical Committee. |
17.2 |
In the event of any senior official not being available, the assistant may replace them. Officials appointed to the above posts in other centres should not be debarred by reason of their being domiciled in another centre. |
17.3 |
In the event of any senior official not being available, the staging body shall report to the chairperson or deputy of the Officials Society, who will nominate a replacement who may act at the swim meet for which he/she alone is appointed. |
17.4 |
Officials for swim meets shall be in terms of Fina rules. |
17.5 |
Officials for Level 0 Division swim meets will be nominated by the Official's Society and this Division will be used to train new and up-and-coming officials. |

Number 1 lane; shall be on the right side of the pool when facing the course from the starting end. |
18.2 |
Assignment of lanes shall be by placing the fastest swimmer or team in the centre lane in pools whith an odd number of lanes (eg. 9 lane pool) and in lane 5 in a ten lane pool. The swimmer having the next fastest time is placed on his left and alternating the other to right and left in accordance with submitted times. Swimmers with identical times shall be assigned their lane position by draw within the aforesaid pattern. the seeding shall be carried out by the organising body under the supervision of the Board or a person or persons nominated by the Board. |
19.1 |
The provisions of the SSA Constitution as amended from time to time shall apply to all applications for Affirmative Action, KwaZulu Natal and South Africa records. Application for KwaZulu Natal records shall be approved by the Records Clerk and ratifies by KwaZulu Natal Swim Board. |
19.2 |
All applications for records shall be made to the Board on the prescribed form supplied by SSA, not later than fourteen days after the date on the event in which the record was broken. The Records Clerk shall have the right to submit records in his own capacity. |
19.3 |
The Board, together with the Records Clerk, shall have the power to accept or reject the application at itsd meeting immediately following receipt of the application. |
19.4 |
A registered member of KwaZulu Natal Aquatics, who establishes a KwaZulu Natal record in an event in an official swim meet recognised by FINA, staged outside the Province, shall have such record recognised by KwaZulu Natal provided:

KwaZulu Natal swimming records shall be divided into two categories:

20.1 |
Senior Colours are automatically awarded to any swimmer who is selected and swims for South Africa at any International Open Competition. |
20.2 |
A swimmer who is selected and represents KZN on three occasions will be awarded Senior Colours. |
20.3 |
All swimmers selected and who comete at the South African Senior National Championships will receive a credit irrespective of age. Swimmers who are 15 years and older and represent KZN in age group events against another Country or Province in any special swim meet will alsoreceive a credit towards Senior Colours. |
A Swimmer who represents South Africa at an Age Group International event will automatically receive Junior Colours provided that they have turned 12 years of age.
21.1 |
A swimmer between the ages of 10 years and 14 years, who represents KZN at an age group Provincial swim meet will receive a credit towards Junior Colours. After three representations a swimmer may be awarded Junior Colours. |
22.1 |
A swimmer who represents the Province once at the National Development Championship will be awarded Development Colours. No badge or scroll will be issued but tracksuits and shirts may be used to acknowledge that Development Colours have been awarded. |
23.1 |
All swim meet programmes shall be circulated to clubs by the staging body, at least fourteen days before the event and all events on the Preliminary Notice (dodger), shall be submitted in programme order. No late entries will be accepted at all/any swim meets. |

All preliminary notices shall indicate clearly the "pre-entry" closing date adn rules and conditions should they vary from the general swimming rules. |

KwaZulu Natal swimmers may only enter a "pre-entry" swim meet through their club and only on the entry form supplied by KZNAA. Such entries must be in the hands of the staging body on or before the closing date of entry of the swim meet. |

No late entries will be considered. |

In the case of KZN Championships, a swimmer may scratch from the finals without penalty provided they follow the laid down procedure. |
25.2 |
Any application for the relaxation of the Scratching Rule or fee must be submitted in writing to the Board for consideration. In the case of illness, it must be accompanied by a Doctor's Certificate. |
25.3 |
A penalty amount per swimmer will be imposed on the Club, should any of their swimmers fail to start at a pre-entry swim meet where no entry fee is charges. The Board shall review the amount of the penalty at the beginning of each swimming year. Swim Board will recover these fines from the clubs concerned. |
25.4 |
All "Fines" imposed on Clubs or its members must be paid within thirty days of the date on which the penalties were imposed. Failure to make payment timeously will result in the suspension of the swimmer/s or club concerned. |
26.1 |
At all events on the KwaZulu Natal Calendar, an emergency committee shall exist to attend to any matter requiring a ruling or an interpretaion. |
26.2 |
Such Committee shall consist of the Referee and Board members or the appropriate committee. A quarum shall be three members present in person. |

Natal Schools shall comply with the basic FINA requirements. Times recorded by registered KZN swimmers will only be registered by KZNAA if the school swim meet is run under FINA swim rules and the results are open to the public. |

The Officials Society although falling under the auspices of the Swim Board will have its own constitution and run its own affairs and will have representation on the swimming Council Board. |

No affiliated club member may participate at any level 1,2 or 3 Division Swim Meet unless he or she has registered with KZNAA and Swimming South Africa and be in possession of a computer generated SSA registration number. This applies to officials, coaches or club administrators who wish to be active on the pool deck or are involved in the running of swim meets. |
31.2 |
Members are required to register each season. The season run from the 1st of May to the 30th of April of the following year. Registration fees for both the Province and SSA are required. |
31.3 |
Swimmers who participate in Juvenile Relay and level 0 swim meets must register with their club. Clubs must provide KZNAA with a schedule of these swimmers together with a predetermined Provincial registration fee, before the compete. There is no insurance cover for these swimmers. |
31.4 |
Any member transferring from one club to another within KZNAA must first obtain clearance from his club. The clearance and the new registration form must be submitted to KZNAA. No clearance fee will be levied if the swimmer has not competed in the new season. The South African and KwaZulu Natal registration fees need only be paid once a season. |
31.5 |
A club may not withhold or delay a vlearance unreasonably. Should any problems involving clearances arise they must be immediately reported to Swim Board in writing. |
31.6 |
A member transferring to another Province must obtain a clearance from both the club and KZNAA. Similarly KZNAA require a Provincial and club clearance for any meber transferring to KNZAA. The full Provincial registration fee must be paid. |
31.7 |
A member from KZNAA, wishing to compete in another Province or Counrty, requires a clearance to compete. This clearance msut be obtained prior to the member competing. Should a swimmer compete at a National Tournament or his province or Country, no clearancee is required. |
31.8 |
Swimmers may only compete for his new club once the clearance has been obtained and the swimmer is registered with his/her new club. This applies to all swimmers changing clubs even if they have not participated for a lengthy period. the member concerned will remain registered with their previous club until the clearance is granted and registration takes place. |
Should a swimmer considerably improve times during the season and in doing so qualify to swim at the National Prestige Age group or Senior Nationals, he or she may apply for an upgrade. The swimmer concerned must pay the full 2/3 level fee to the Province and SSA and will forfeit any previous registration payments made during the season. |
