For initiative of the Consortium of the Mediterranean and the Federation
Internationale des Droits de the Homme (Non Government Organ of the Suggestion
of Europe of the O.N.U and the UNESCO), you/he/she is constituted an association,
with the denomination European UNIVERSITA' Of Culture, headquartered in
Messina, the city where had his native, in 1955, during the European Lecture,
that the history remembers like the Lecture in Messina and that it gave
life to the European Community. It was in that occasion that a group of
men of culture, participants to the European Lecture, together with the
well Minister of him Foreign, Gaetano Martino, promoter of the aforesaid
Lecture, had idea to constitute a University, that advocated the European
ideal and European culture, with the same sincere Europeanism and with
the same tenacious spirit that the history remembers like the spirit in
Messina. They were them same to give life to the first embryo of the actual
University of European Culture. The activity of the University of European
Culture unwinds within the general directives of the O.N.U., of the suggestion
of Europe and the UNESCO, organisms to which it sticks what Organization
Not Governamentale (O.N.G.). The board of directors can found other centers,
departmental, founded, dependences, filial, offices, representations, embassies,
either in Italy that abroad. This so much for the representation, how much
for the operatività, either for teaching that for the search, also
in accord with other university, academic, cultural or scholastic, Italian
and foreign institutions, operating in mutual assistance. For the realization
of his activities the University of Culture European usufruirà of
the mutual collaboration and you/he/she can use, over the proper structures,
those of the associates and eventually also of institutions third. The
duration of the University of European Culture is boundless.
Art. 2 - purposes
The university of European Culture doesn't have ends of profit. It
has the purpose to spread in the world the European ideal and the new ideas
of cooperation, of solidarity and of brotherhood between people, as well
as the intention to promote initiatives and cultural and tourist demonstrations,
fit and to illuminate the millennial tradition of civilization of Europe,
the manifold historical circumstances which you/he/she has participated
in the centuries, the notable contribution given to the spiritual and intellectual
patrimony of the world, the development of his languages, that you/they
have always given life to famous literary masterpieces, the development
of his economy and above all of his traditions, so dear to the mind of
his people, that in it transfuses own feelings, the own beliefs and her
continuous of generation in generation as the most conspicuous and most
jealous patrimony of the stock. The university of European Culture also
has, the purpose of: - to effect projects of formation, connected or not
with programs of cooperation interazionale - to take care of safeguard
and the increase of the social, cultural and occupational levels; - to
practice actions of formation and professional orientation, of promotion
of the occupation, of assumption and wage support, of new setup and partner-professional
integration, also in the picture of geographical mobility, of performance
of social and relief services and technical consultations destine to the
creation of places of employment; - effecting politics intended to furnish
the necessary professional qualifications to manpower to get a stable occupation
and to develop the occupational possibilities, to the integration socioprofessionale
of the young people and the disadvantaged workers, to the adaptation of
manpower, to the development of the market of the job and the technological
mutations, nochè to the reduction of the regional and international
unbalances of the markets of the job; - to defend the laws of the Man and
to protect the free development of human personality; in first place in
the respect of the Convention of the Laws of the Man of the Suggestion
of Europe, in practical line of the defense and in the guarantee of the
laws of the individual and people to life, to liberty, to the social and
economic comfort, to health, to culture, to the quality of life, in every
contingency that puts them in danger or hinders the promotion of it.
Art. 3 - realization
For the attainment of the social purposes above described, the University
of European Culture intends; to) the institution and the management of
schools of every order and degree; of seminars of study; of courses of
formation, of qualification and of retraining, of apprenticeship and of
professional qualification; b) it stipulates it of conventions with Public
and Private Corporate body, National, International or Foreigners. c) the
institution and the management of centers of assistance for the guardianship
of the law of the single ones and for the restoration of the laws violated
by public corporate body and from private; d) the acquisition, the use,
the management of social centers and for professional formation, of hostels,
colleges, villages, scholastic buildings, operational centers, houses for
students, houses albergo,case of rest, gerontocomi, museums, historical
and monumental buildings; and) the diffusion of studies of searches, through
publication of books, magazines, bulletins, or through institution and
management of broadcasting stations radio or television; f) the realization
of all the operations mobiliarie, immobiliarie and financial, necessary
and useful to the attainment of the social object.
Art. 4 - in partnership
You/they can be ordinary or adherent partners of the University of
European Culture the men of culture welcomed with unquestionable judgment
of the board of directors, as well as Moral Corporate body, Foundations
and Associations, all not perseguenti I sweep of profit or thin political,
that has connected ends with the social purposes of the University of the
Nations. To be admitted to partners, the organisms of which above, debbono
to forward an application signed by the legal representative of the Corporate
body, equipped by copy of the statute, from the action of foundation and
from the deliberation of the competent organ that has decided the adhesion
with the person's nomination designated to represent the Corporate body
in sense to the University. Deliberative activities are reserved to the
ordinary partners. The adherent partners don't participate in the meeting
and, therefore, you/they are exonerated by every managerial responsibility.
Art. 5 - charges and conventions
The University can receive charges of study, of searches, of assistance,
of services, of management, of promotional actions, of consultations, of
formation from the Public Administrations, of the Corporate body of Italian
State or Foreigners, of the C.E.E., of the European Social Fund, of the
Regions, of the Communes, of Public and Private Corporate body either Italians
that Foreigners. This also in strength of special conventions to stipulate,
for brief or long periods.
Art. 6 - financial means
University draws the necessary means to its operation: 1) from the
proceedses of the taxes, laws and contributions owed by the affiliate,
whose diversified amount is established by the board of directors and you/he/she
is notified annually; 2) from the contributions of the Chivalrous Orders,
of the Governments, of the Regions, of the European Social Fund, of the
C.E.E., of the Communes of the Provinces or other public and private corporate
body, Italian or foreigners and from extraordinary donations of and of
private corporate body for the normal activities of university, for purses
of study and for others specific thin; 3) from possible proceedses of publishing
didactic activity, managerial, cultural, and others.
Art. 7 - meeting
The maximum organ of the University of the Nations is the meeting of
the associates. You/they participate in the meeting, with deliberative
vote, the ordinary members of the board of directors, the partners ordinary
physical persons and the representatives of the corporate body ordinary
partners.
Art. 8 - board of directors
The organ that governs the Institution is the board of directors, constituted
from three to seven members: a president, a vice-president and an adviser
constitute the structure of base of the Suggestion. If the number of the
members was increased, the positions covered in excess would be of Assistant
Adviser. The Assistant Adviser has alone advisory vote and you/he/she introduces
specific professional competence, whereas the members of the Suggestion
required the comfort of it. In the intent to maintain with the maximum
proximity with the own Founder, the University of European Culture it maintains
the reserve of 2/3 of the positions of the board of directors to the Consortium
of the Mediterranean, for the whole period of legal efficiency of the same:
only with the cessation of the Consortium of the Mediterranean it decays
such obligation assumed mainly to assure a continuity of address to the
education. The board of directors has faculty to introduce all those changes
to the statute, in observance to the norms of law, necessary and useful
to the managerial finalities of the Universitàdi Culture European.
The sessions of the board of directors can be remunerate through attribution
of tokens of presence to the single members, in the measure to establish
in budget. The board of directors has the administrative government and
the Economic-property management of the University; particularly: to) it
approves the budget and the advisory account; b) deliberation on the norms
and on the inside rules of the University; c) nomination the Rector; d)
nomination the General Manager and the General Secretary; and) she/he confers
the charges of Teaching, felt seeming some Rector; f) it determines the
remunerations in favor of the personal teacher and not teacher; g) it determines
the measure of the taxes and the contributions owed by the affiliate; h)
you/he/she can grant delegation to the Rector for conclusive periods and
for defined subjects; the) you/he/she can grant all that required powers
to the President to assure the administrative government of the University.
The board of directors lasts incumbent four years. Of the board of directors
you/they can do part the Rector and the General Manager.
Art. 9 - president and deputy-president
The President represents the Association for the execution of every
and any ordinary administrative action; that you/he/she protects the prestige
and the decorum. The President has legal representation of the Universitàdi
Culture European. He is responsible some activity of the Association towards
third, therefore every action must bring its signature of it or of whom,
to the moment it does some the places or it is delegated of it. The Vice-president
coadiuva the President in the accomplishment of his funzionies, if the
President is Prevented, you/he/she does the places of it.
Art. 10 - general manager
The General Manager governs the Association in the circle of the general
directives received by the board of directors and you/he/she represents
the maximum hierarchical authority after the same Suggestion and the President.
Its charge is only of technical and organizational nature; therefore you/he/she
can not assume responsibility of administrative nature. Such loaded you/he/she
can also have covered from an Adviser.
Art. 11 - general secretary
The General Secretary provides to the organization of the Reception
office to the controls and the government of the personnel. She/he takes
care of the relationships, the conventions and the services. It holds the
register of the property consistences and the inventory of the good of
the Association. E' directly chairman and proponent toward the board of
directors. Such loaded you/he/she can also have covered from an Adviser.
Art. 12 - auditors of the accounts
The Auditors of the Accounts are in number of two, more one limb substitute.
You/they must verify the regular estate of accounting and you/they must
compile a relationship on the annual budget, to confirmation of happens
him control. You/they can also be chosen by the outside of the Association
Art. 13 - committee of cultural consultation
The advisory Organ of the University of European Culture is the Committee
of Cultural Consultation, constituted by personality of I detach in the
field of the international Culture, that they will be select between those
signalled by varied international cultural organisms or that you/they will
be selected however by the board of directors. Within such committee, the
Suggestion will designate a coordinator referente.
Art. 14 - teachers
The didactic Activity is organized and realized by teachers and not
teachers. You/they must have origin from qualified cultural condition,
with professional experience, to level of Italian or Foreign Institutions,
equivalent to the program of teaching. study or search of the content of
the course. The charges are assigned from the Suggestion to determined
time. Every single teacher can be associated, for every didactic session,
in associate's form in share, as contained in the norms of the Italian
Civil Code.
Art. 15 - college teachers of the course
Teachers and technical of every course they constitute the College
of the Teachers of the Course. The College of the Teachers of the Course
organizes the didactic programs and she/he takes care of the layout and
the publicity of it. A Teacher or a Technician you/he/she can do part more
Colleges of Teachers of Course. Each remains incumbent during the whole
necessary period to organize, to dispatch and to close the relative Course.
To the College of the Teachers of the Course you/they can participate qualified
observatories of other private or public, Italian or foreign Institutions.
Art. 16 - the Rector
The Rector is named by the board of directors and you/he/she is select
between eminent studious or personality of recognized national or international
prestige. The Rector lasts incumbent a triennio and you/he/she can be reinstated.
to) The Rector summons and he presides the Academic Suggestion and you/he/she
can belong to the board of directors; b) you/he/she directs the operation
of the University in didactic, scientific and cultural subject; c) introduce
every year to the board of directors, a relationship on the state and the
development of the activities of the University, relative a departed Academic
year, and, felt the Suggestion Academic formula proposals for the activity
of the following year.
Art. 17 - Academic suggestion
The Academic Suggestion is composed by the Rector, that presides it,
from the ordinary Teachers or associated provosts to the Courses, from
the President of the board of directors, from the General Manager and from
the General Coordinator of the Committee of Cultural Consultation. The
Academic Suggestion reunites, in the ordinary street every three months
and ogniqualvolta the Rector thinks it necessary or when is done motivated
required from at least a third of the members. It defines and it effects
the line programmatic dell ' University in the cultural, scientific and
didactic field.
Art. 18 - purses of study - attested - titles - honors
The University of European Culture can found and to promote the concession
of Purses of Study for the frequency of the proper courses or the financed
courses or for the execution of particular studies or searches. Other certificates,
diplomas, titles with legal correspondence, degrees or degrees honoris
causes you/they can be conferred, according to the norms of law of the
single interested countries, or through the realization of special delegations.
The University will be able, also, to found and to confer honors or special
prizes.
Art. 19 - patrimony
The patrimony of the Association is fully grown: to) from mobile and
immovable good and from the values that, for acquisitions, legacies donation
or for any other title, comes in ownership of the same one; b) from the
sums set aside for any purpose, until you don't disburse. Of the Patrimony
of the Association a special register of inventory must be kept, and the
relative data must be brought to budget.
Art. 20 - breakup
If the Directive Suggestion recognized necessity to loosen the institution,
felt to seem some Auditors of the Accounts, you/he/she can deliberate in
such sense, a liquidator naming and giving the public opportunity of law.
Good and the funds devolved to other Institute or Corporate body without
thin of profit, avente I sweep and thin similar.
Art. 21 - norms of delay
As far as foreseen not by the Fit present, the dispositions of the
Civil Code are worth in subject of Associations.
