Castle Wooten, Company B

I am posting the military/pension/widow's pension records of my GGGGrandfather Castle Wooten (various spellings) in hopes that they help preserve his legacy, help other researchers, and hopefully help me connect with other descendants of his. He was born in Lawrence County, Ky and first married my GGGGrandmother Keziah Justice. He second married Elizabeth Mills, widow of Martin Mills. After the war he moved to Wayne County, West Virginia where he spent the rest of his life. (Donna Hamm).


DECLARATION FOR ORIGINAL INVALID PENSION

State of West Virginia, Wayne County, SS:

On this 30th day of July, A.D. one thousand eight hundred and eighty three personally appeared before me, a Dept. Clerk of the Wayne County Court, a court of record within and for the County and State aforesaid, Cassel Wooton aged 53 years, a resident of the Town of Fry, county of Wayne, State of W.Va, who, being duly sworn according to law, declares that he is the identical Cassel Wooton who was enrolled on the 19 day of Nov, 1862, in Company B of the 39 Regiment of Kentucky commanded by D. A. Mims and was honorably DISCHARGED at Louisville, Ky on the 15 day of Sept, 1865; that his personal description is as follows: Age 53 years; height 5 feet 10 inches; complexion, light; hair Dark; eyes Blue.

That while a member of the organization aforesaid, in the service and in the line of his duty near Big Sandy River, in the State of Kentucky on or about the 1st day of August, 1863, he received a severe rupture by being thrown by horse on forepart of saddle on the left side.

That he was treated in hospitals as follows: Was not treated by Regimental Surgeon.

That he has not been employed in the military or naval service otherwise than as stated above.

That since leaving the service this applicant has resided in the County of Wayne in the State of West Virginia, and his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a Farmer. That he is now partially disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States.

He hereby appoints, with full power of substitution and revocation, Stoddart & Co., of Washington D.C., his true and lawful attorneys to prosecute his claim. That he has not received but has applied for a Pension. That his post office address is Fry, county of Wayne, State of W.Va.

Roll to April 30/63. sick in Gen'l Hos. Ky. May & June 1863. present, and is reported to June 30, 65. (last on file). Return for July 1863. does not report him absent. Return for July 1865. (last on file) does not report him absent. He is also borne as Cassell Wooten. Co. Return for Apl. 1863, shows him sick at Ashland Ky. Nature of sickness not stated. Regimental Hospital Records not on file.

Sir: I have the honor to request that you will furnish from the records of Cassell Wooton, who , it is claimed, enlisted Nov. 19", 1862, and served as private in Co. "B" 39" Regt. Ky Inf.; also in Co. "B". 39" Ky Inf and was dischared at Louisville Ky Sept 15, 1865.

While serving in Co. "B" 39" Regt. Ky Inf. he was disabled by rupture of left side about Aug 1" 1863 at or near Big Sandy River Ky and was treated in hospitals of which the names, locations, and dates of treatment are as follows:

Not treated for rupture of left side.

Please search the regimental hospital records and forward the papers to the Surgeon General USA for evidence of treatment in general hospital Ky.

Declaration for Invalid Pension

Act of June 27, 1890

Note- This can be executed before any officer authorized to administer oaths for general purposes. If such officer uses a seal, certificate of Clerk of Court is not necessary. If no seal is used, then such certificate must be attached.

State of West Virginia, County of Wayne, SS:

On this 21st day of July, A.D. one thousand eight hundred and ninety personally appeared before me, a Clerk of the County Court within and for the County and State aforesaid, Cassel Wooten aged 59 years, a resident of Adkins Mills County of Wayne, State of West Virginia, who being duly sworn according to law, declares that he is the identical Cassel Wooten who was enrolled on the 19" day of November 1862 in Company "B" of the 39th Regt. Ky. Vols. as a private commanded by Capt. Wm. Ford in the war of the rebellion, and served at least ninety days and was HONORABLY DISCHARGED at Louisville, Ky on the Fifteenth day of September, 1865. That he is Partially unable to earn a support by manual labor by reason of Deafness (result of Measles) rupture and loss of right eye.

That said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief permanent. That he has applied for pension under application No. 491.892. That said application is still pending and refers to the proof filed with said calim and ask that it be read in support of this application.

That he makes this declaration for the purpose of being placed on the pension-roll of the United States under the provisions of the Act of June 27, 1890. He hereby appoints SOULE & CO., of Washington, D.C., his true and lawful attorneys to prosecute his claim, and he directs that the sum of ten dollars be paid for their services.

INABILITY AFFADAVIT

In the matter of Invalid Pension Claim, No 1833 of Cassel Wooten Late Pri Co "B" 39 Reg. Ky. Vol

On this 21st day of July A.D. 1890, personally appeared before me, a Clerk of the County Court in and for the aforesaid County duly authorized to administer oaths, Cassel Wooten a resident of Adkins Mills, in the County of Wayne, and State of W.Va whose Post Office address is Adkins Mills Wayne Co. WVa, well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to the aforesaid case as follows: That he is unable to comply with the requirements of the Pension Office as to Medical evidence. That he was treated by Drs. Weis and Miller while in the service but does not know where they are now and that he has been treated since his discharge some 2 or 3 months by Dr. Johnson who is dead.

That he is unable to prove his condition from date of discharge up to the year 1890 by medical testimony for the reason that Dr. Johnson who treated him a short time is now dead and that he has not been treated by any other Physician since his discharge from the U.S. Army.

He respectfully requests that the testimony of Thos. F. Napier, F M Wooten & Allen Wooten be accepted in lieu of the Physicians above named.

On this 23 day of January A.D. 1897, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to adminster oaths, Cassel Wooten a resident of Dragg in the County of Wayne and State of WVa whose Post Office address is Dragg WVa well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to the aforesaid case as follows: That he is unable to comply with the requirements of the Pension Office as to Medical tesitmony for the reason that he was never treated by a physician since he received the said rupture for reason that he did not deam it nessesary.

That he is unable to prove his condition from date of discharge up to the year 1880 by medical testimony for the reason that he was never treated by medical treatment; affiant further say this affidavit was writen in his presents by Stanly Chaffin and only from his own oral statement maid then and there and he was not aided or prompted by any written or printed statement in no wise.

He respectfully requests that the testimony of C.D. Jordan and Allen Wooten be accepted in lieu of medical testimony.

In the matter of Cassel Wooton (myself) Pension Claim No. (Blank) Private in Co B 39" Ky.

On this 7" day of June, A.D. 1897, personally appeared before me, a notary public in and for the aforesaid County, duly authorized to administer oaths, Cassel Wooton a resident of Dragg in the County of Wayne and State of West Virginia whose Post Office address is the same, well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to the aforesaid case as follows: That he is unable to comply with the requirements of the Pension Office as to furnishing the testimony of any Commissioned officer or Orderly Sergeant or Regimental Surgeon for reason that they are all dead as he is advised and believes. That he is unable to prove his condition from date of discharge up to the year of 1896 by medical testimony for the reason that the physicians who treated him for rupture from discharge up for several years are dead.

He respectfully requests that the testimony of neighbors be accepted in lieu of surgeon and commissioned officers. The affiant further says that he is still suffering from the rupture and that it is growing worse every day.

In your reply please be as specific as possible in respect to dates, and describe, as clearly as you can, the nature, symptoms, and extent of the disability.

DECLARATION FOR PENSION

On this 15 day of April, A.D. one thousand nine hundred and 7, personally appeared before me, a notary public within and for the county and State aforesaid, Cassel Wooton, who, being duly sworn according to law, declares that he is 76 years of age, and a resident of Dunlow county of Wayne, State of WVa; and that he is the identical person who was enrolled at (blank) under the name of Cassel Wooton, on the 19 day of November, 1862, as a private, in Co B 39 Regt. Kentucky Voleneers (sic) Mounted infuntry (sic) in the service of the United States, in the Civil war, and was HONORABLY DISCHARGED at Louisvill (sic) Ky, on the 15 day of September, 1865.

That he also served (blank).

That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follows: Height, 5 feet 10 inches; complexion, Fair; color of eyes, Blue; color of hair, Dark; that his occupation was Farmer; that he was born December 28, 1830, at Lawrence Co. Ky.

That his several places of residence since leaving the service have been as follows: in Wayne Co, WVa

That he is (blank) a pensioner. That he has (blank) heretofore applied for pension.

That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the act of February 6, 1907.

That his post-office address is Dunlow, county of Wayne, State of West Virginia.

On this ___ day of A.D. 1916, personally appeared before me, a Notary Public within and for the County and State aforesaid, Elizabeth Wooten, who, being duly sworn by me according to law, declares that she is 83 years of age, and that she was born December 25", 1833, at Floyd Co. Ky.

That she is the widow of Cassel Wooten, who enlisted Nov. 19th, 1862 at Peach Orchard (partially erased and other letters written over it), Ky, under the name of Cassel Wooten, as a Private Co. B 39" Ky. Vols. and was honorably discharged in Louisville Ky, 1865, having served ninety days or more during the Civil War.

That he also served__________________________________(blank - not necessary).

That otherwise than as herin stated said soldier (or sailor) was not employed in the United States service.

That she was married to said soldier (or sailor) Jan 13" 1892, under the name of Elizabeth Mills at Webb WVA by Rev. Jacob Markum, that she had previously been married.... She had been previously to Martin Mills, who died----18 late Soldier had been previously to Kezzie Justice who died 18--See evidence on File......; and that neither she nor said soldier (or sailor) was ever married otherwise than as stated above.

That said soldier (or sailor) died Aug 7", 1014, at Webb West Va; that she was not divorced from him; and that she has not remarried since his death.

That the following are the only children of the soldier (or sailor) who are now living and under sixteen years of age, namely:

That she has heretofore applied for pension, the number of her former claim being not known that said soldier (or sailor) was a pensioner, the number of his pension certificate being 55491.

DECLARATION OF A WIDOW FOR ACCRUED PENSION

State of West Virginia, County of Wayne, SS:

On this 23r day of No, A.D. one thousand nine hundred and 14 personally appeared before me, a notary public, in and for the county and State aforesaid, Elizabeth Wooton, aged 80 years, a resident of Felix, W.Va, County of Wayne, State of W.Va, who being duly sworn according to law, makes the following declaration in order to obtain the pension which had accrued to her husband, named below, at the time of his death.

That she is the widow of Cassel Wooton who served as private and musician in Co. B. 39 Regment (sic) and who was a pensioner of the United States by certificate No. 552491, on the roll of the Pension Agency at Washington D.C.; that the last payment of his pension was made to the 4 day of June 1914, that he died on the 7 day of Aug. 1914.

That she was married under the name of Elizabeth Mills to said pensioner at Dragg W.Va. on the 13 day of Jan, by Jacob Marcum; that there was no legal barrier to the marriage; that she had yes been previously married; that the soldier had yes been previously married. "I do not recolect what the date was."

That her post-office address is Felix, W.Va., County of Wayne, State of W.Va.
