The women-protective laws have become so widely misused that it not only
questions the efficiency of our legal system but also the credibility of
women in the society.
A minor girls elopes on her own accord with her boyfriend and her parents
files abduction and rape case against that boy and he gets convicted and
sentenced to seven years imprisonment. Only because these kinds of
incidents are getting more common, the court decided to make the marriage
of a minor girl legal on which women’s organization have condemned the
decision and deliberately failed to consider legal protection to the
accused boy. There is not legal protection provided to that boy who hasn’t
induced the minor girl to eloped from her house but still has to face
false abduction and rape case. Is being a man attaches with itself a
deprivation of human rights?
A father is unable to adjust with his nagging wife, gets accused by his
daughter of rape on the instruction of her mother. The father – even when
innocent – is sentenced with rigorous imprisonment of five years only to be
acquitted later when his daughter says that he is innocent. Not only
police investigation deserves a strong criticism for failing to unearth the
truth but also the daughter and the mother should be severely
punished. Why these incidents won’t become a cause of fear in fathers when
they have a
girl-child ? These are some of the reason why our country
has a skewed sex ratio. Giving susceptible laws to protect women’s rights to an extent that
they begin to misuse it, it is enough to question women’s credibility now.
A husband is falsely accused of dowry harassment because he didn’t throw his
parents out of the house as demanded by his wife. Without sufficient
investigation, he and his family are immediately arrested and he is forced to
pay huge sum of money to his wife only to settle the case. NRI too are the
victims of such malpractice who are looking for an Indian traditional
bride. They come to India to get married and end up in jail for false
dowry harassment. Are not the statistics enough to re-think the protection
given to these unscrupulous women?
It only remains to be seen how the Supreme Court and the Legal Specialist will
seek a balanced and equitable laws to protect both the genders. It has
become vital and most essential to understand the concept of protective laws
for women in the advent of rampant misuse of these laws. The women-
protective laws can’t be used as a weapon to torment and harass a man
legally, which is the case now. What more is to be seen before we begin to
question women’s credibility? Is it not clear from such thousands of cases
of misuse of women-protective laws that now women have lost credibility
and should be presumed guilty until proven innocent just like men ? As
long as these women-protective laws are not added with a strict punishment
when misused, these horrific incidents will continue to flash on the
headlines and fear of false accusation will continue to grow in the
society.
I was following this bill which was presented in lok
sabha and was passed by upper house too, and I was wondering
about the consequences this bill is going to have on
citizens of India, this bill states that reservation
in schools and colleges be provided to people from
backward class, SC, and ST’s, sounds good. This would
mean that now schools like DPS, Doon school and any
other private school will have to provide reservation
at nursery level, which means for a child to get
admission in nursery in any school of India he should
be born to parents which the govt. has declared
backward, no matter if father is IPS officer or CEO of
a company or engineer or doctor, following is the
stats
With the existing 20 per cent reservation (it is 25
per cent in case of schools who have bought land from
the Government at a subsidized rate) for the poor and
now a 50 per cent quota imposed for Scheduled Caste
(SC), Scheduled Tribe (ST) and Other Backward Classes
(OBC), the total percentage of reserved seats could
rise to between 70 to 75 per cent. The percentage
among the three socially backward classes has been
fixed as 15 per cent (SC), 7.5 per cent (ST) and 27.5
per cent (OBC).
Which means only 25-30% seats will be available for
children’s of Indian national who do not belong to a
certain cast.
Moreover out of these 25-30 % available seats they are
in open category, i.e if child born to a certain
parents get through the cut off for this category he
will be considered as open seat, which means effective
only 10% place is left for people belonging to so
called upper cast.
May GOD bless children only to the privileged who can
get their children admitted into school. some of the

As a matter of fact no school in india will be left
unaffect, until it is a religious minority school such
as a Madrsaa, which will be only place left
unreserved.
After viewing the video footage on TV about misbehavior by UP police, i feel
deeply hurtled on the condition of people living in India,
Story goes like this, Heavy police force fully armed with guns, pistoles, lathis and other
equipment, reached a park situated in the heart of Meerut City, which is in
western Uttar Pradesh, a state ruled by samajwadi (socialistic) party,
Police was given orders by higher officers that they should crack down on
roadside romeo's who are involved in eve teasing and punish them, Indian
law has Section 354 of the IPC which deals with this crime, but what
happened in the park was most surprising, lady police officers start
beating female and married couples who happen to visit that park, females
who were being assolted by police force were shown on TV and almost entire
country watched their faces, This is the situation of indian citizens
being governed by Congress led government.
EVEN in this 21st century, we see police treating common people with brutality, still we keep quite and
wait for our turn, so that we can open our mouth to protest. Violence in any form cannot be justified, there is law for everything,
and no country and any civilized society can justify people in uniform beating people just because they are in park,
what is the difference between the worlds largest democracy and a
Taliban government? In both places people are not allowed to move freely in town.
Boyfirend/Girlfriend concept is not acceptable to UP Police it seems, What made the police think that they have the right to beat people and publicly insult citizens for being present in a park in broad daylight, which law in india stops boy and girl to meet in a park?
With right to information act in place people can ask for information about action
taken against the concern police personals and what action are taken
by the government to stop such kind of uncivilized behavior from
repetition by administration.
