Get News by Email Print this article Email this article Psychiatrist struck off for professional misconduct From AAP 29nov01 A SYDNEY psychiatrist who allegedly urinated on a former patient with whom he became sexually involved has been ordered struck off the register by the NSW Medical Tribunal. The woman had been receiving treatment from the psychiatrist, both of whom cannot be named for legal reasons, between July 1997 and April 1998. She developed a relationship with him from April 1998 to about July 1998. She alleged while she was being treated by the psychiatrist he engaged in inappropriate physical conduct including touching her head, mouth, arms and legs as well as holding her hand during consultations. A few days after her last consultation on April 24, 1998, the woman alleged the psychiatrist attended her home and brought a bottle of Scotch whisky. She said the man gave her a massage, urinated on her and had sex with her. The woman later complained to the Health Care Complaints Commission (HCCC) about his behaviour. The doctor denied having inappropriate physical contact with the woman, and also denied entering into a personal and sexual relationship with her. He said he had attempted to discourage her from putting her arms around him at her home saying "not to be so silly". He said he ended contact with the patient altogether when it became clear she would not return for treatment, had feelings of rejection and anger towards him, and wished to have a personal relationship with him. Today Judge Ronald Solomon, the tribunal's deputy chairman, said the tribunal was satisfied the psychiatrist had engaged in inappropriate physical conduct with the patient during treatment, and that he entered into a personal and sexual relationship with her for about three months. The tribunal also found the psychiatrist inappropriately sought to continue his treatment of his patient after he had sex with her, and failed to refer, or assist her in obtaining a referral to another psychiatrist, after she finished their professional relationship. Judge Solomon said the tribunal found the doctor had exploited the woman and breached her trust. "The respondent abused his position of power over the patient who suffered from a significant psychiatric disability in order to obtain gratification for his own needs," he said. "The respondent's actions have had a deleterious effect on the patient's health and wellbeing. "The respondent shows no contrition in relation to his actions." The tribunal found the man's behaviour constituted professional misconduct, and ordered his name be removed from the register. He will not be allowed to apply for reregistration for three years.
