"The Deal" - summary by Christie

We begin with Bobby and Ellenor walking into the offices of Donnell, Young, Dole and Frutt. They are in the middle of a conversation. Ellenor asks Bobby what's the concern. Bobby says if she's planning to take a full maternity leave which she knows by law he is not only required to support but applaud, he would just like to... Ellenor asks is Lindsay. Bobby says probably yes which means if she also plans to I have to think about hiring. Lucy is on the phone talking to someone. She is saying that they ordered 2 inch. She has a ruler and is measuring a binder. She tells the person on the phone that she's measuring 1 inch so... A man walks into the office, comes up to Lucy and introduces himself as Francis Lupino. He says he's got to see Bobby. Lucy, still on the phone, tells him 1 sec. Annoyed, he says its urgent. Lucy points to the phone to indicate when she gets off. Francis leans forward grabs her hand that's holding the phone and hangs the phone up. Very emphatically he says he's got to see Bobby and its important. At this moment Bobby comes out of his office.

Bobby and Francis go back into Bobby's office. Bobby shuts the door. Francis says the cops came to his house and that yesterday there was this car following him. He says he thinks he's taking a surveillance. Francis is pacing. Bobby says look, ok... Francis yells that its not ok, that he needs his advice. He asks if Bobby's been watching the news, the kidnapping, the little girl.... Bobby thinks for a second and says the Engel girl, Trevor Engel's kid, the ransom, that little girl? Francis looks at him and says he knows something about it. Bobby looks at him suspiciously and asks him what he knows. 

Francis says he knows where she is. Bobby doesn't looks terribly surprised, but he does look upset. He asks Francis where she is. Francis says locked up. Bobby is trying to keep it together. He asks him if she's alive. Francis says should be. Bobby takes a deep breath. Bobby says ok, he can contact the FBI, Francis won't have to contact them himself. Francis says Bobby will keep his name out of it, right? Bobby says he can't promise that. Francis gets angry. He says Bobby CAN promise that, that's what he came in here for. Bobby yells at him and says he can't blow in here, tell him this and then start tearing into him like that. Francis thinks for a moment and then says what if he takes him to where she is and lets him take over from there. Bobby just stares at Francis.

Opening credits.

Bobby is in Eugene's office. He has filled him in on everything. Eugene tells Bobby he can't go with him. Bobby says he knows but this is a little kid, what's he suppose to do. Eugene says this is not what lawyers do. He says best case he's a witness against his own client, worse case the cops sees them together and they arrest you on conspiracy. Bobby says she could be alive. Eugene says he won't tell you where she is? Bobby says he's been grilling him for 10 minutes, he won't give anything up. He says to Eugene you know Francis, he has to be in control. Eugene says if he won't cooperate with him he can withdraw and let the cops handle it. Bobby says that's not going to help that girl and..... 

From outside Eugene's office you can hear a commotion - Francis yelling, Lucy saying what are you doing. Bobby goes out to see what is going on only to find cops arresting Francis and Richard Bay observing, telling them to Mirandize him. The cops are giving him his rights as they lead him away. Bobby says to Richard that he has no right to bust in here like this. Richard says he has no right to harbor a kidnapper. Ellenor is yelling at Richard that he hasn't got a warrant, Richard is telling her not to lecture him. Bobby says to Richard to just give him 10 minutes to talk to him. Richard says he can talk to him at the arraignment and tells the cops to get going. Bobby yells to Francis not to say anything, that he'll meet him at the courthouse and to not say a word.

As the cops and Richard are leaving, in walks Scott Wallace. He seems very agitated. He asks Bobby if he can see him. Bobby says he's actually in... Scott says they fired him. Bobby asks who. Scott says Harry Duvall. Eugene is going back to his office to get his coat and yells to Bobby that they will arraign him as soon as they get there. Bobby says to Scott can they talk later. Scott sounds panicked. He says he's been there for 18 years... Bobby says he wants him to talk to one of his partners. Scott says no he wants him. Bobby tells him he has an emergency, to go into the conference room and a partner will be right with him. Scott nods his head and starts back to the conference room. Bobby tells Ellenor and Jimmy to go talk to Scott and give him whatever he needs. Bobby and Eugene leave.

The phone rings and Lucy answers. They pass Lindsay who has been watching everything unfold. Lucy turns to her and asks her if she's here for William Hinks. Lindsay can't believe it. Lucy says he's on two. Lindsay just stares at her for a moment, shocked. Finally she says she's not here. Lucy nods, gets back on the line and tells him she's unavailable and can she get back to him. There is a pause and then Lucy says no she doesn't know when she'll be back but the best thing he can do is leave a number and she'll have Lindsay call him back. She writes down a number and hangs up. She hands the paper to Lindsay who looks at it as if it will bite her. Finally she takes it, looking more that a bit unnerved.

In the conference room, Scott is telling Ellenor and Jimmy his plight. He is saying don't they have to have cause to fire him. He says he's a partner and he wasn't even afforded due process. Jimmy says you were voted out by the other partners. Scott says evidently but they're like sheep, that Harry calls all the plays. Ellenor asks what the reason was that they gave him. Scott says its that its not working out, after 18 years that's all they gave him, its not working out. Ellenor says that without having read his partnership agreement, if its anything like a law firm agreement partners pretty much have blanket discretion, if they don't like you they can.... Scott says no, no, no, this just... Ellenor tries to interrupt him but he says let's face it, no other brokerage firm is ever going to hire him, that to the outside world he is a murderer with a good lawyer. He says he needs to keep his job here. Ellenor says then they will try and meet Mr. Duvall and his attorney and see if they can work something out. Scott says fine.

At the courthouse, they are about to arraign Francis. Bobby and Eugene arrive on the scene. Bobby says Bobby Donnell for the defense, waive reading, plead not guilty. Richard says Richard Bay for the Commonwealth, oppose bail, ask for a finding of dangerousness. The judge asks on what basis. Richard say this was a heinous crime, that 3 days ago the defendant kidnapped a 7 year old girl and has been holding her for ransom, she may still be alive. Bobby says he would like the court to ask what evidence Mr. Bay has to justify arresting my client in the first place. Richard says the defendant is a career criminal, he's spent 15 years in prison. Bobby says old news. 

Richard says his van matches one seen speeding away from the Galleria parking lot just after Alyssa Engel was kidnapped, a security camera puts the defendant at the mall 10 minutes before the girl was taken. Bobby says he understands the gravity of the charges but the Commonwealth has no case against his client. He says the van could match thousands, shopping in a mall is not a crime, and his client's priors are inadmissible at trial. The judge says this is pretty thin, Mr. Bay. Richard just stares at the judge. The judge says he will make a preliminary finding of probable cause, he's held without bail pending a dangerousness hearing 3 days from now. He goes on to the next case. Bobby goes over to Francis and tells him he'll meet him downstairs in half an hour.

As he leaves the courtroom, Bobby is besieged by reporters. They are yelling questions at him as he walks through the crowds. All of a sudden a blonde woman runs up to him. She desperately wants to talk to him. Bobby recognizes her as Mrs. Engel, the kidnapped girl's mother. She tells Bobby to look at a picture of her daughter in what looks like a lion costume which she holds up in front of his face. Bobby says he is truly sorry about her daughter but... The mother says her name is Alyssa. Bobby says he understands how she's feeling but... Eugene says to let's go. The mother is saying that she's in the 2nd grade, that she's in a school play today but they had to cancel it because she's not there. She pleads with him that if he knows where she is to please tell her. Just then her husband comes up to her and asks her what is she doing. As he tries to pull her away Bobby and Eugene start walking away. But she continues saying that they made that costume together and she keeps pleading to him. Bust Bobby has to just walk away.

Back at the office, Lindsay sits working at her desk. The phone rings. She starts to answer it but her hand stops short of picking up the receiver. Lucy sees this and asks her who has her private line. Lindsay says Bobby. Lucy smiles and says then why aren't you answering it? Lindsay says because... but apparently she can't think of any reason. She smiles and picks up the phone and says with a smile in her voice "Hi.". But the voice on the other end is not Bobby's. The voice says hi. Upset, Lindsay asks who is this. The voice says its William. Are you available now? Lindsay, practically stuttering, says well, actually, I... What is this about? William says he's been thinking about the verdict and he's decided he wants to appeal. Lindsay says you were acquitted William. William says yes, he would like that overturned. 

Lindsay says she doesn't handle acquittal appeals so he'll have to get another lawyer for that. She says I'm sorry and quickly hangs up the phone. She looks very upset and nervous. She says ok, that was weird, gets up and grabs her coat. Lucy asks her where she is going. Lindsay says to see Jeannie, that this getting just a little out of control. She opens the door and standing on the other side is William Hinks holding a cell phone. Lindsay screams and jumps back. He looks at her with those creepy bug eyes, flips his cell phone shut and asks is now not good? Looking quite terrified Lindsay asks him what he wants. He says he has some probate work and she's his attorney. She hurriedly says she's a criminal defense lawyer, she doesn't do probate. Hinks says what are you saying? That our relationship is in jeopardy unless I commit a crime? Lindsay just looks at him, totally creeped out.

Commercial.

Eugene and Bobby are in a room after the arraignment. Bobby is upset. He's telling Eugene he could have found the girl, he could have had Francis take him to her. Eugene says then he would be downstairs in lock-up with Francis. Bobby says the girl could still be alive. Eugene tells him his only obligation is to Francis now. Bobby asks how could he look at it that way. Eugene says they have to look at it that way, and he doesn't need to tell him that.

Richard and Kate are talking. Kate is asking if he questioned Francis. Richard says he lawyered up immediately. Kate asks how that happened - "maybe because you arrested him in his lawyers office?" Richard says it was an emergency, he ran in there and they figured he must have made his tail. Kate asks what about his house. Richard says they are getting a warrant and they'll be searching it by the end of business. Kate says they better get her back alive and that's all she can say. Richard says that Bobby will be in here in 5 minutes to work out a plea. 

As if warning him Kate says if she's dead... Richard says to stop with the threats and offer some tactical advise. She just stares at him, arms folded. Richard slumps back in his chair. He tells her if she wants to help him here she should give him Helen Gamble. Kate shakes her head and says she doesn't want Helen. Richard says she's the best D.A. they have to negotiate with this firm. He says setting aside office politics or recognizing that her politics are best served by getting that girl back alive, she should give him Helen Gamble.

In a conference room at Scott Wallace's brokerage firm, Ellenor, Jimmy, along with Scott Wallace, are meeting with Harry Duvall and his lawyer. Harry's lawyer says does Scott say his firing was unlawful? Ellenor says they are investigating the circumstances of the discharge at the moment and their hope is they can work something out. Harry says that Scott's position was tenuous even before the death of his wife and he was told that. Scott says yes, but finally now he has the chance to improve upon his job performance and he's being denied that chance. Harry says to Scott that he is his friend. Scott snickers and says no he isn't, he thought he was but the minute he got arrested he became a pariah and he was the first one to presume his guilt. Harry says that isn't true. 

Ellenor tries to get the meeting back on track. She says that this is not a forum to discuss their friendship. Harry tells Ellenor that they are a financial brokerage house, that they are in the business of soliciting investors o put huge sums of money not to mention their confidence in their hands. He says that becomes exceedingly difficult when you are saddled with the perception that one of the partners may or may not be a murderer. Scott says he was acquitted. Harry says he was found not guilty which is hardly proof of innocence. Jimmy says that the thing is fairness has to come into play here. Harry says he's aware of that and if he is innocent he can't even fathom how unfair this has been to him, but how fair is it to everyone else at the firm to have to suffer. Scott asks Harry couldn't he wait and see. 

He says "For God's sake, why let the facts interfere with your judgment." Ellenor tells Scott to please be quiet. She turns to Harry and tells him that it would be extremely difficult for Scott to find other employment at the moment. She says it would be a lot easier if he could look while still working... Harry says he can't do that. Ellenor says 3 months. Harry says sorry, that the other partners want him gone, now. Scott, glaring at him, says to Harry that he wants him gone. Ellenor cautions him again to be quiet. Jimmy says that certainly 18 years should be worth a little compassion. Harry says he'll offer him compassion, but not a position. Scott looks angry.

Back at D, Y, D and F, Jeannie is trying to convince Lindsay that Hinks is harmless. Lindsay says don't tell her he's harmless, she doesn't... Jeannie asks she doesn't what? Lindsay hesitates for a moment and then says she's telling her this as part of his legal team, privilege applies. Jeannie says yeah, yeah, yeah. What? Lindsay says William admitted to her and Jimmy that he totally played Jeannie. Lindsay says he knew he had to insist on being guilty for Jeannie to be convinced he was delusional. Lindsay says he played her too, that he knew she would revoke the insanity plea. She says he played both of them, that the guy did it. Jeannie tells Lindsay that he wants her to think that, that he will go to his grave trying to convince people he's the killer. 

Getting desperate to convince Jeannie, Lindsay says no. Jeannie says she's treated this man for a long time. Lindsay says he heard what Hinks told her. Jeannie says emphatically that the man did not kill anybody. Lindsay, just as emphatic, says he did. Out of nowhere comes a voice saying "Do I get a vote?" Its Hinks and it makes both Lindsay and Jeannie jump and scream. Jeannie yells "Damn it, William, you scared me! Lindsay says "Mr. Hinks I asked you to leave." Hinks says fine. Then he says "By the way, is there a decent park near here to walk a dog?" Lucy, who has been listening to everything and looking a might nervous, reaches for the phone. Hinks, staring at Lindsay says "You don't have a dog by any chance, do you?" Lindsay tells him again to get out. Jeannie tries to appeal to her but she is obviously unnerved by the whole thing. She tells Jeannie that if she wants to treat him fine, but she is not his lawyer anymore and she wants him out of here. 

Just then, Jimmy and Ellenor return. Jimmy starts to ask what's going on when he spots William. Hinks says hi to Jimmy and then tells him Lindsay won't take his business and he could just kill himself. Then, after a long pause he says "Or others" and he looks at Lindsay. Shakily, Lindsay tells Hinks that if he doesn't leave this office right now she will call the police. Lucy says she has already called them. Hinks says "What are you going to tell them - a man just charged in and tried to hire you?" Lucy says to him "Hey sicko, pick a fingernail." Hinks doesn't like that. He turns and stares at Lucy with those creepy eyes and says to her "702 Commercial Avenue, Apartment 13A. You really should try and buy you know. You're throwing money away by renting." 

Lucy is totally freaked. He knows her address. Jimmy pipes in and tells Hinks they represented him, they got him acquitted, that their business with him is over. Jimmy says "You will leave now or I will physically remove you." Hinks, not looking at all intimidated by Jimmy's threat, says "gee, you look like you've been working out too." Jimmy responds "Want to try me, Bill?" Hinks turns back to Lindsay for a moment, then turns and leaves, the door held open for him by Ellenor. Lindsay is clearly shaken.

In Richard's office, he and Helen are negotiating with Bobby and Eugene. Richard is saying if Francis gives the girl up and she's unharmed they'll give him kidnapping to extort with a sentencing recommendation of 10 to 15 years. Bobby says he's not going to accept that. Helen says if he pushes it he might. Bobby says he won't. He says this guy didn't just fall off the truck, that he knows their case is lousy, he knows the parents are putting the screws on you, they're going to have to offer straight kidnapping, 3 to 5. Richard and Helen look at each other. Richard thinks for a moment and says 5 to 7, but she has to be completely unharmed. Bobby says he can take that to him.

Back at the office, Ellenor and Jimmy are meeting with Scott. Ellenor says they could sue but its their feeling they wouldn't win. She says they probably couldn't even survive a motion to dismiss. She says we could go back into Judge Hiller and ask for an adjudication that you're innocent, innocent as opposed to not guilty. Scott asks do they do that? Ellenor says yes, in extremely rare circumstances. Jimmy says their feeling is if they could lift this cloud of suspicion off you then maybe.... Scott gets excited. He says yes, yes, yes, that's what he wants to do, absolutely. Ellenor cautions him that she's not confident that... Scott says just let's do it, Judge Hiller was at the trial, she heard the evidence, she knows. He says again, let's do it.

Bobby and Eugene are meeting with Francis in the jail. Bobby is telling him about the deal, telling him he'll be up for parole after 4. He tells him this is a good deal. Francis doesn't look too sure, but he says 5 to 7 he can deal with. Bobby says great, now they have to move, if he tells him where the girl is... Francis interrupts. He says to tell them he'll take the 5 to 7 but if that's if they find her dead or alive. Bobby and Eugene are both stunned. Bobby says what? Francis says what nothing - you heard me. Eugene says they aren't going to give him 5 years if he killed Alyssa. Francis says he didn't kill anybody. Bobby says then what the hell is going on in your head. Francis says figure it out, you lock up a 7 year old girl alone for 3 days who knows what the hell happens. 

He says if she's dead he didn't do it so he's not exactly eager to confess and throw myself to Walpole for the rest of my life, not while there is a chance I may get to skate on this. Bobby says he doesn't know what he did but if tells this to the D.A. he's going to think he murdered her. Francis says that's their problem. Bobby says that's Francis' problem. Francis says bring it to Bay. Bobby tries to object but Francis tells him to go and bring it to Bay. Left with no choice, Bobby calls for the guard. Just then his cell phone rings. He answers it. A man's voice on the other end says "Hello. I'm looking for Lindsay Dole?" We know its Hinks' voice. Bobby says "This is her husband." Hinks' voice says "Then I definitely have the wrong number then." Bobby says, sounding somewhat annoyed, "And you are?" but Hinks hangs up, leaving Bobby somewhat confused. The guard comes to let Bobby and Eugene out but before leaving Bobby glares at Francis, frustrated at his attempts to get him to tell where the girl is.

Commercial.

Back in the offices of D, Y, D and F, Lindsay, Ellenor, Jimmy and Lucy are discussing Hinks' little visit. Lindsay is saying with a frustrated and frightened tone in her voice that Hinks didn't really threaten her. Ellenor says he said I could just kill myself - or others - looking right at you. Lindsay says even if they could make an assault charge on that what could they really do? Ellenor says they might not give him bail? Jimmy says what about telling the police what he told us. Lindsay says privilege. Jimmy says but if they think he's about to commit bodily harm... Lindsay says they have no grounds on that. Lucy says, sounding very frightened, that the guy has her address. Then, turning to Jimmy, she says thanks for antagonizing him, by the way. Ellenor tells Lindsay she should talk to Helen. Lindsay says ethically... Ellenor cuts her off saying to hell with ethics and again tells her to talk to Helen. Lindsay looks scared.

Back at Richard's office, Bobby has just told him that Francis wants the deal whether or not the girl is found alive. Richard can't believe it. He says five to seven if he's dead? Helen says are you serious? Bobby says he knows what it sounds like but just give him a counter offer - voluntary, he'll serve 20 if she's dead. He says you have to give him something or he'll just go to trial and the girl will die. Richard looks up at Bobby and says she's dead already. Bobby says that's not what this means. Richard says he murdered her, he killed her days ago, this whole negotiation has been a rouse, he knew we were on to him, he wants to get out in 5 for murder so he pretends she's alive so you have something to bargain with. Eugene says they don't know that. Helen says that's what it looks like. Richard asks if they were in on this. 

Bobby says they weren't in on anything, he's just playing hardball. Richard tells them to get out of his office. Helen says wait a second. Richard says this negotiation is over. Helen says no it isn't. She says they all know their positions here but if that girl is alive, just the possibility that she is alive, however technically unethical it may be, we got to get on the same side here. Bobby says he's not going to give. Helen says then you make him give, and don't tell me you can't. She says nobody is better at this than you. Bobby sighs deeply. Eugene asks Bobby for a second. They walk a little bit away to talk, practically in whispers. Eugene says that this is good cop, bad cop, don't fall for it. Bobby says but she's right, we have to be on the same side a little here. Eugene says no we do not. He tells Bobby to put that girl out of his mind, think about his client or get off this case. Bobby looks at Eugene, thinks for a moment, then turns back to Helen and Richard and says softly that he needs something to take back to him. Richard says that there is no deal if the girl is dead - period. Bobby says then we're done, and he and Eugene leave. Helen turns to Richard, looking frustrated. Richard softly says damn it.

Jimmy and Eugene are in Judge Hiller's chambers meeting with her to discuss an adjudication to declare Scott innocent. Ellenor is telling her that its not unprecedented. Judge Hiller is saying that maybe not but on what basis does she declare him innocent. Ellenor says she would start with the fact that he's presumed innocent until proven guilty and he was never... Judge Hiller says if she wants a ruling that says she presumes him innocent she'll give it to them, but for her to make a finding of innocence... Jimmy says that he's losing his job, he's reapplying for a mortgage and the bank wants nothing to do with him, his neighbors are trying to bring a nuisance act against him... 

Judge Hiller says she's sure life is being very unfair to him, why don't they sue the police for arresting him to begin with. Ellenor says she doesn't think that would fly. Judge Hiller says of course it wouldn't because there is evidence against Mr. Wallace, they were heard fighting, she had a whack on the back of the head, for all she knows he could have killed her. Ellenor says he didn't. Judge Hiller says maybe not but she is certainly not prepared to make a finding of innocence. She asks did they really think she would? Ellenor and Jimmy look as if they didn't.

In a hallway at the courthouse, Lindsay and Helen are talking to Helen. They have filled her in on Hinks' visit. Helen says did he say anything else. Lucy says her address. Lindsay says that the tenor was a threat. She says she knows it will tough to make but he's scaring the hell out of her. Helen asks what does she want her to do. Lindsay says arrest him and scare the hell out of him. Helen says "Lindsay, your husband already has me scrambling over this kidnapping." Lucy says the guy is a psycho. Helen says you realize.... Lindsay, sounding desperate, says just scare him - please?

Back at the office, Rebecca is filling Bobby and Eugene in on Hinks' visit. Clearly upset, Bobby asks Rebecca where Lindsay is now. Rebecca says she went to see Helen. Bobby asks what exactly did Hinks say. Rebecca says it was very veiled, she's not sure Helen will actually be able to do anything but I would change your locks. Before Bobby can say anything the door opens and Mr. Engel, Alyssa's father, comes through the door. He asks Bobby if he knows where she is. Bobby says he knows he can't talk to him. Again, Mr. Engel asks him if he knows where his daughter is. Bobby quietly says no. Mr. Engel asks him if she's dead. Bobby, very quietly, says he doesn't know. Angrily, Mr. Engel says how can the two of them just sit back.... He says you have to be a little human. He is quite clearly getting to Bobby. He starts to speak with im, Eugene tries to stop him, but Bobby continues, saying to him is he willing to help him get her back. Mr. Engel says what kind of question is that. Bobby says with more public pressure on the D.A.'s office to make a deal they might be more willing to make a deal and you could help generate that pressure.

In Kate's office, Kate is reading something. Bobby and Eugene are waiting for her to finish. Finally, Kate says what the hell is this? Bobby says a press release, that at noon tomorrow he and the Engel parents will hold a joint news conference saying that his client has information on the kidnapping, that they'll blame her office, and her personally, for scuttling the only chance to save Alyssa by not making a deal with him. Richard and Helen are also there. Helen asks Bobby if his client supports him on this. Bobby says he told him to do whatever it takes to make a deal. Kate says his gun is pointed at his own head, if he does this he'll be admitting to every potential juror in Massachusetts that his client is the kidnapper. 

She says she has never heard of anything so stupid, or unethical, and they'll take away his bar card and she'll make sure of it. Bobby tells her to do what she has to do. Kate looks at him, trying to size him up. She then says she's already dead and this is just a lot of black marks on white paper. Bobby, unflinchingly, says she could be right, she could be wrong, and the adds "Glad I don't have to make that guess." As he turns to leave he says he'll give her 2 hours. Once Bobby and Eugene are gone, Kate asks Richard what happened when they searched his house. He says they came up empty. She ask what about the van. Richard says the interior had been washed and vacuumed which shows he was trying to destroy evidence. Kate says trying, he succeeded. 

Richard says they don't know that yet. Kate says fiber, hair, DNA, anything to tie him to the girl? Richard says as of now no. Kate says we have nothing? Richard says they are only 1 day into the case. Helen says they might lose the bail hearing in which case he goes free. Kate tells Richard to sign this plea agreement and fax it Bobby Donnell immediately. Appalled, Richard says we're negotiating with these terrorists? Kate tells him to sign it. Richard looks to Helen who doesn't appear to be offering him any support and so he says that he will not sign it. Kate picks up a pen and signs it herself. She holds it out to Richard and says firmly for him to fax this to Bobby immediately and get that girl back.

In the conference room at D, Y, D and F, Ellenor and Jimmy have just filled Scott Wallace in in what Judge Hiller had to say. Angrily, Scott pounds the table and pushes back is chair as he gets up so hard that it falls. He yells that its not right. He starts pacing. Ellenor tells him they're going to take more shot at Duvall, that he agreed to a meeting without his lawyer. Scott, much calmer now, says he's not going to change his mind, why would he? Jimmy says when he said you two were friends, are you two friends? Scott says yeah, they had lunch together everyday, our wives were even close, then after they all pulled away, everyone of them, they still think I'm... He says doesn't it mean anything, a jury hears all the evidence and they found me not guilty, doesn't that mean anything? Jimmy says unfortunately no. Scott says the police make a mistake and now he's discriminated against now and they're telling him that there is no existing legal remedy and he just has to just eat the bigotry and he just has to accept it and say that's life... Then very angrily he yells "I will not let that be my life!". Jimmy and Ellenor look at each other. Then Ellenor says to him let them take one last shot at Duvall, that he's going to be there tonight at 8:00.

Outside a small house, you can hear a dog barking. Mike McGuire and Helen stand amidst a SWAT team. Mike tells Helen he went in about 20 minutes ago and asks her if she's sure she wants to do this. Helen says favor bank, don't even knock. Mike says into his radio "go ahead." The SWAT team breaks down the door and barges in, yelling police! Hinks sits calmly at his kitchen table. The cops yell at him to get down on the floor. Hinks doesn't move, so the cops force him down on the floor and handcuff him. Mike and Helen enter. Helen looks at the walls of his living room. One wall is adorned with pictures of dogs, the other with newspaper clippings about the victims of the serial killer and of his own trial. 

Mike tells him he's under arrest criminal assault and starts to give him his rights. Hinks says he didn't do anything wrong. Helen says yes he did, that a threat constitutes an assault. She glances at Mike and then kneels down over Hinks. She says "For example, if I were to say to you if you ever go near Lindsay Dole again I will find a way to have you accidentally shot and killed by a police officer, something like that. That would be an assault." She stands, "so I would never say that. Then looking down at him she tells the cops to get him out of here. He is picked up and led away by Mike and the SWAT team as she watches him suspiciously.

Commercial.

In Bobby's office, Scott is talking with Bobby. Scott is asking Bobby to be there at the meeting with Duvall. Bobby tells him if he can he will be. Scott is obviously very upset. He tells Bobby he doesn't think these other lawyers are too good. Bobby tells him that Ellenor and Jimmy are excellent. Scott yells that he wants him. Bobby walks over to him and says that he doesn't seem to be doing too well and asks if he's still taking the medication. Scott says you want to give me my life back in a pill he'll swallow it. Again, Bobby asks him if he's taking his medication. Scott says yes, but this is rough. He says he didn't expect them to welcome him back, that he's not naive, but... Bobby says remember how he talked of going to Fiji, maybe he should go for a couple of weeks, get some rest. There is a knock on the door and Eugene opens it. He says they have to fly and walks away. Bobby says ok. He tells Scott he will do his absolute best to make the meeting but that he's in great hands with Ellenor and Jimmy. Scott nods his head.

In a room at the courthouse, Francis is looking over the plea agreement. Eugene is telling him that they'll go right in, enter the plea and then he'll reveal the location of the girl. Francis says they tossed his house yesterday and they didn't find anything. Bobby comes in and asks if he signed the plea. Francis says he's been suddenly thinking that he's going to trial, that he's not pleading. Bobby is shocked and upset. Francis says that Bobby said so himself, they have no case. Bobby tells him there is no statute of limitations on murder, they have his whole life to make the case. Smiling, Francis says that they aren't going to make it, he has a feeling. Pleading, Bobby says he's trusted him on 3 trials, trust him here. 

He tells him "This is the best deal we'll ever get." Francis says "We? You gonna do the time with me, counselor?" Bobby sits down at the table across from him. He says listen, forget all that. He says this is a little girl's life. He says to him that he's not a murderer, he knows him. Francis says that that little girl, have you ever seen her house off of Brattle? He says its like a castle, she's this little princess, that she's had 7 good years and that's better than he ever had. Bobby glares at him. Francis leans back in her chair and says no deal. Bobby can't believe it. He says you're letting her die? Francis says he said no deal. Go tell the D.A..

Bobby and Eugene are out in the hallway. Bobby says to Eugene now what? Eugene says he doesn't know, they just go tell them. Bobby says for him to go tell them that its going south and see if they will improve the offer. Eugene says there is no way... Bobby says for him to take the shot. Eugene asks him what is he going to do. Bobby says he's going to take another shot with Francis. Eugene says "Good, then we can compare cement walls." and he leaves. Bobby tells him to hurry then takes out his cell phone, hits speed dial and waits a second. Then he says into the phone "Rebecca, call me back in 30 seconds on my cell." There is a pause, then he says "Just do it." He obviously has a plan.

Bobby goes back in the room with Francis. Francis says so what now. Bobby says that Eugene is telling them, but he wants him to understand that they can hit him with life on the kidnapping alone. Francis says he understands that. Bobby says at some point this girl is going to be found. Francis says don't be so sure. Just then Bobby's cell phone rings. He answers it. We know its Rebecca calling back as requested, but Francis doesn't. Bobby pretends to listen. He says, sounding surprised, what? The he says "Where'd they say?'' Bobby looks upset. Francis is watching him. Then Bobby says "All right, I'll tell him." and hangs up the phone. Bobby tells Francis that was Bay. 

He says Francis told him that he had vacuumed his van. Bobby coyly asks him passenger compartment or the back? Francis says she wasn't in the passenger compartment. Bobby, pretending to be upset, says they found a long blonde hair off the driver's seat. Francis looks suspicious. He says they're lying. Bobby says they are giving him 10 minutes from right now to take the deal. Francis says he vacuumed it himself. Bobby tells him this changes things, that he has to run the odds again, that he says they should close the deal before its off the table.

In a courtroom, Helen is arguing for Hinks to be held. Hinks is there with an attorney. Lindsay, Lucy and Jeannie sit in the gallery. Helen is saying he asked Lindsay if she had a dog, that was how he met all his victims, walking dogs. She says he said he would kill himself or others. He stared at Lucy Hatcher and uttered her address. Hinks' lawyer says none of this rises to the level of assault. Helen says given the history of this man... Hinks' lawyer says his history isn't relevant, that they can only look at these specific facts and uttering an address doesn't in any way... Helen says the court would like to hear from Ms. Lindsay Dole or Ms. Hatcher. Hinks' lawyer says this is not an evidentiary hearing, but he also supposes the court could also direct questions to Ms. Jeannie Reynolds, Mr. Hinks' treating psychologist, that she is of the continued opinion that this is a harmless man who just wants people to think he's a killer. 

Helen says that Lindsay Dole is in fear for her life and the Commonwealth believes with good reason. The judge finally says that she doesn't see how she can bind him over on the facts alleged here but here's what she'll do. She says that the criminal complaint is dismissed but she's issuing a restraining order requiring Mr. Hinks not to contact, follow, or approach Ms. Dole or Ms. Hatcher and to stay at all times at least 1000 feet from them, their homes and their offices. She asks Hinks if he understands that, that there is no going near these women. Hinks says but is he free to visit Ms. Gamble? Helen looks at the judge who says she is now adding Ms. Gamble to the list, that he is to stay away from her, and then she adds "and me." She then adjourns the court. As Lindsay goes to leave, Hinks stops her. She looks at him with fear in her eyes. He says to her, I guess this is good-bye then. She stares at him for a moment and then leaves, followed by Lucy and Jeannie. Hinks watches them leave with a sly smile on his face.

In the darkness of night, several cars and an ambulance drive up to a place unknown. Out come the SWAT team running through some trees toward a building. Out of another car come the Engels and Richard who tells them to stay back. The SWAT team blows open the door and yell police as they enter the building. In another car sit Bobby and Eugene. Bobby says softly please God, let her be alive. As they wait in the car for the police to come out, Bobby tells Eugene that he lied to Francis, that he told him they found a hair of hers in his car. Eugene looks at him somewhat shocked. He doesn't say a word, just stares at Bobby. 

Bobby says that's how he got him to take the deal. He turns to Eugene and sounding like he's fighting back tears says he doesn't care, he wasn't going to let a little girl... His voice trails off. Eugene simply says to him that its time for him to get out of criminal law. Bobby just stares straight ahead. Just then the police inside the building yell that they're coming out. A policeman appears carrying a crying, but apparently unharmed. little girl. Bobby, seeing this, says thank God. The parents rush to her. Richard sighs a sigh of relief. The policeman puts the girl down and she rushes into her mother's arms. Eugene and Bobby watch from the car.

Back at the office, Mr. Duvall, Scott, Ellenor and Jimmy are in the conference room. Duvall is telling Scott that this isn't just his decision. Scott says don't tell him that, that they follow him, they take their cues from him. Duvall tells Scott he's not getting into that again. Scott says what, is that an inconvenience to have that discussion? Ellenor tells him to cut it out. Ellenor asks Duvall to forget about making him a partner, just let him trade... Duvall says its not that simple. Ellenor says why can't it be. Duvall says the employees don't want him around, not as a partner, not as a co-worker, they don't even want him in the building. Scott, looking pained, asks what about you Harry? 

Scott says doesn't their friendship even deserve an honest response? Harry, obviously trying to be as kind as possible, tells him that he doesn't want him around either, that he's not the same person he used to be friends with and whether he killed Karen or not, he's just not the same man he used to know. Scott, obviously hurt, says when all of this happened, he needed his friends more than ever. He says he needed him and to see him pull away, to see him recoil, at the idea that they had once been friends, like the idea was repugnant to him, does he think he's the same person? Harry tells him that Scott needs to move on with his life. Scott says his life his life has been taken from him. With that he stands up, opens his briefcase and pulls out a gun. Ellenor, Jimmy and Harry all jump out of their seats and out of the way. Scott holds the gun to his head and says that this is just the anesthesia, that it numbs the pain. Ellenor tries to reason with him, telling him to please put down the gun. 

Scott yells at her to shut up, that her powers of persuasion stink. Harry tries to reason with him. He tells him that this is not the answer. Scott says how the hell does he know, has he ever tried it? The last time he shot himself it didn't work out? Harry then tells Scott he can have his job back. Harry leans forward and tells Scott if he kills himself, people will think that he killed Karen, did he ever think about that? He says people will say see, he was nuts after all, he killed her, he killed himself. Harry asks if that is really the legacy he wants to leave. This seems to get to Scott. he shakes his head and starts to lower the gun, saying no. Ellenor sighs with relief. Scott says to Harry that he's right, he's absolutely right. Then, without warning, he picks up the gun, aims it at Harry and fires - 1, 2, 3, 4, 5, 6 times and he keeps pulling the trigger after the gun is empty. Harry lays slumped against a chair, quite obviously dead. Ellenor and Jimmy stand shocked against a wall. Scott turns to them and calmly says "I bet you're glad I'm out of bullets."

The police are in the office, taking pictures, looking over the scene. A detective comes up to Jimmy and tells him they'll need he and Ellenor to come down and make statements. Jimmy nods his head. Eugene is standing with Ellenor. He asks her how she's doing. She says ok, she guesses. All that is happening seems in stark contrast to the gay Christmas decorations that abound throughout the office. Lucy is sitting at her desk, Rebecca leans against it. Bobby and Lindsay stand next to her, watching. As Scott is lead out, Bobby tells him not to say anything to anybody. Scott doesn't even look at him. As they leave, Bobby tells the detective that Scott is represented. The detective says got it. When they wheel out the body, Bobby turns and goes into his office.

In his office, Bobby sits down on the sofa, his head in his hands. Lindsay comes in and shuts the door behind her. She goes over to him, sits on the arm of the sofa and rubs his shoulder, asking him softly if he's ok. He says I don't know. He says how could he... Lindsay tells him Scott was on the edge. His voice cracking, Bobby asks should he, should they, have seen this coming? Lindsay says no, how could anybody have... Just then she sees a package wrapped with a bow on Bobby's desk. She points to it and asks Bobby what is it? He says he doesn't know. He gets up and walks over to his desk, Lindsay following. He pulls off the card and reads it aloud "To Lindsay with affection." They look at each other, perplexed. Lindsay looks nervous. Bobby opens the box and pulls out a little puppy. He says its a little dog. He looks totally confused, Lindsay looks a bit freaked out. Bobby asks whose sending you a dog? Lindsay just stares at him and the dog, knowing who sent it.
