NJDEP: Just said "no", again

Photo: On Feb. 23, 2006, BTRA supporters board the van heading to Trenton for the public hearing with the NJDEP.
On March 28, the NJDEP just gave John DeSimone/Tilter Realty another "Nope" to the plans to build townhomes on the 5+ acres of mostly wooded land at the juncture of the Third River and Spring Brook, boardering the south side of Liongate. This is either the 4th or 5th rejection by the NJDEP. We hope to have the 3-page letter available soon on our website.
Some of the reasons stated in the letter for the rejection include:
"should have used Type III rainfall distribution, but instead used Type II."
"Time of concentration for woods is too low",
"Drainage areas used in the analysis were not show on the drainage area map submitted."
"Location of concrete channel is only 3 feet from property line...[not provided are] details of how these will be constructed so close to the property lines without disturbing off site..."
Note the letter says: "it is suggested you consider revising the application in order to meet the requirements of the Flood Hazard Area Control Act", so this is not a irrevocable denial.
You can see last year's (2006) 5-page rejection on our website (www.geocities.com/thirdriverbank).
