A brief overview of what has happened to

since he was sentenced to 33 years in prison



In July of 2002, Scott was sent to High Desert State Prison in Susanville, CA.  Because he was falsely accused of attempted murder, Scott was placed on a level 4 yard with all of the murders and lifers.  Scott has never been in a major fight in his life, and had no idea of what was about to happen to him.  He was not used to being around people like this, let alone the threatening, disrespectful, intimidating guards.
 

Scott was joking about “his pet mouse (in his cell) having his cell mate in a head lock.”  One of the correction officers said “and you’re telling me because you like to tell.”  This was dangerous for Scott because it was like putting a red flag in front of a bull.  Prisoners will kill or beat a “snitch.” We’re sure that this officer knew this, so for her to do this in front of 30 prisoners was very wrong for Scotts safety.  Scott immediately told her “ that’s wrong to say.”  Scott was in between a rock and hard place.  On one side are the guards who seek out their own retribution against prisoners, especially ones that stand up for their rights.  Then the prisoners have their own style of retribution which is beating or killing.  If Scott is known as a “snitch,” he could easily be killed by the prisoners.
 

Scott tried to remedy this situation 6 times, but the guards refused to do anything.  Scotts cell mate also tried to remedy the situation to no avail.  Scott tried to get a 602 form, but the law office wouldn’t allow him to copy it to file a complaint. Scott had no choice but to file a lawsuit against the guards for his own protection.  It is filed in United States District Court of the Eastern District of California.  Case No. 02CV2075MCPAN-P 
 

Now, Scotts life is in danger from the guards because of this action.  Scott wrote me a letter stating that he was being retaliated on by the guards. He said that he was in great fear for his life, and to get him some help immediately. 
 

I contacted Chris Weaver, ombudsmen for High Desert State Prison.  He said “ he didn’t see the problem, and Scott needed to adjust to prison life.”
 

I went to visit with Scott, and he didn’t look well.  He didn’t want to say much, as our conversations were being recorded.  He just said to look for a letter from him.  I did receive the letter.  It was folded so that the guards couldn’t read it, and it said that he was in great fear for his life. He said “do something before I get killed.”  The guards were harassing and threatening Scott. 
 

I got another letter the next week, and Scott said the guards are accusing Scott of being in a certain crowd. If he’s a member of the crowd and anything happens, he’s going down. Scott said he had no idea of what they were talking about.  Scott had witnesses to all of this.
 

I sent many e-mails to High Desert State Prison, Mr. Presley, Prison Law Office, and many others trying to remedy this, but got no where.  They just said that Scott needs to get adjusted to prison life.  All of this happened while Scott was in reception.
 

On Oct. 3, 2002, facility B counselor Wilborne witnessed that when Scott was brought before the I.C.C. comity, Scott was threatened 2 times by Captain Cook that if  “Scott didn’t have his mother stop calling outside agencies, that he would bring heat on himself.”  There were approx. 10 other witnesses there, but Scott wasn’t sure who they were.  Officer Bunn was one of the witnesses, as he told my husband and I  that he was in the meeting when he was checking us in for a visit with Scott.
 

On Oct. 10, 2002, Scott was transferred from reception to the “B” yard facility. Officer Gingle, officer Craig, and officer Clament witnessed what happened next.  Scott was brought first into Sgt. Vanlairs office.  Other officers were there, a total of 5.  As Scott was handcuffed, Scott was threatened by an officer to his left to have his jaw broken.  Sgt. Vanlair threatened to have Scott beat up.  Scott was then sent to the B yard.  Officers Wagner and Arnold were stationed in B5 building.  They witnessed that Sgt. Vanlair ordered Scott not to be given his bedding and personal belongings.  After Scott was threatened to have his jaw broken, and be beat up, Scott  spent the night in a cold cell, with no bedding, mattress anything. He only had his underwear for clothing. Scott was curled up in a ball freezing all night long with no sleep, begging God for help.  Officers Wagner and Arnold commented that this was not normal routine when someone gets placed on a yard. 
 

I did contact the Inspector General.  They did an interview with Scott on Oct. 30, 2002.
 

The threats and harassment just continued.
 

On Nov. 11, 2002, my husband and I drove up to visit with Scott.  During the visit we saw  Gary Foreshee.  I knew Gary, as his mother and I have been working on our sons cases together from Shasta Co.  My husband and I gave Gary a fast hug.  We didn’t think anything of this, as we were friends.  That evening after our visit, Scott’s and Gary’s cells were searched and ransacked.  Out of 100 cells, only Gary’s and Scott’s cells had this problem.  They believe this was in retaliation to Scott.  After the search, Scott asked officers Look and Harper why this was happening, and they said that it was “confidential.”
 

Many other harassments occurred, and they are included in the report that follows.  The officers tried to harass Scott and provoke Scott into doing something to the officers so that they would have something against Scott.  Scott always remained calm.
 

I got to the point that when ever I would visit with Scott, I warned Mr. Presley and the Inspector Generals Office of my visit, so that the guards wouldn’t retaliate against Scott.
 

Scott was incarcerated in Shasta Co. Jail for 2 years during his trial and sentencing.  Scott was always known as a peace maker, and taught other inmates how to strive for peace. Scott also led Bible studies while in Shasta Co. Jail.  He was given time off for good behavior.  These problems just started happening when Scott was sent to prison.
 

Scott was continuing his lawsuit against the guards, and the courts were asking Scott to give them the names of the witnesses.  Just as Scott was about to get the names out, Scott was beat up in the gym. 
 

Scott was a MAC rep.  On Dec. 20, 2002, Scott was entering the gym trying to see what was happening, as he heard that a riot was about to happen, and he wanted to try to stop it.  Scott was attacked by 3 men in the gym.  We believe this was a set up by the guards, as Scott was in the process of getting the names of the witnesses to the courts.  Scott was beat up. He remembers going in and out of consciousness as he was beat and kicked in the head several times, and pepper spray was burning his eyes. Scott regained consciousness  in a wheel chair, and he couldn’t remember who he was or why he was there. Even then, Scott remembers a guard harassing him telling him he was telling lies, and that he could remember who he was.  Scott was very upset at this guard, as he was in bad shape, blood everywhere, and he didn’t know who he was, or why he was there. Scott was taken to a hospital, and had a CAT scan.  Thank God he was o.k., just lost his memory.   It took a while, but Scott has fully regained his memory.  He had a big boot mark on his face when I went to visit him.
 

When Scott recovered from his injuries, he was placed in ad.seg,-- “For his protection.”  We didn’t understand why this was happening, as Scott didn’t do anything.  He was the one that was beat up.
 

Now Scott is in Ad. Seg for “his protection.”  What a joke.  All of his legal books and papers were kept from him, and the guards had access to the witness list.  Scott was able to sneak the witness list out to me, from memory, and I got it into the courts.  Was Scotts beating an accident?  I don’t think so.
 

My husband and I went to visit with Scott, and there was more retaliation after our visit.  He said after our visit, the officers went through all of his papers and read everything.  He had legal papers there (they were given back to him).  The guards commented on several things.  Officer (J. female) harassed Scott “severely” and she assisted in endangering Scotts safety in ad. seg., she yelled out loud that Scott got beat up.  Then she passed Scott up when she passed out supplies, and later passed Scott up when she passed out dinner.  She maliciously did this on purpose.  Scott’s sure that she told the ad. seg. shot caller that he was no good.  She purposely got vengeance on Scott.  What kind of protective custody is this?
 

Scott told me about a day in ad. Seg where he and the other inmates are kept for “their protection.” They’re not protected from the guards.  This is what happened to the inmate in the cell next to Scott.
 

Guards have lifers do favors for them, so I guess the guards didn’t like the inmate in the cell next to Scott. One night, the guard in the tower opened the door to the inmate next to Scott.  Another inmate doing favors for the guards raped this man, the door closed.  This happened 3 more times in the same night, one right after the other.  Door opens, man was raped by another different inmate, the door closes.  On the 5th time, after the man was raped, he was stabbed 6 times.  Scott had night mares for weeks after this, not sleeping, thinking the guards were going to do this to him.  He stayed awake at night prepared to attack someone coming into his cell. 
 

Scott said that body bags went by him all the time. 
 

The Inspector General said that Scotts case is closed, as Scott signed some kind of paper stating that these things didn’t happen.  Scott told me that he had to do this in fear for great retaliation from the guards, and fear for his life.
 

Scott was transferred to Pleasant Valley State Prison in Coalinga.
 

Scott was doing well in Pleasant Valley State Prison.  We had many wonderful contact visits.  Scott started a Bible study with approx. 50 men in it.  The guards broke it up, but Scott was trying to get it continued.
 

Nov. 4, 2003.  Scott called me and warned me that a officer Guerra was harassing him and he wanted to warn me in case something happened to him.  Scott said this guard especially hates MAC reps. Scott is a MAC rep.  Scott has witnesses to the threats and harassments, and this officer is known for this.  Officer Guerra apologized to Scott and we thought all was well.  A few days later some inmates went up to Scott and told Scott that officer Guerra wanted them to find some “dirt” on Scott, so he could do something to Scott.  Instead, the inmates went to Scott and told them what officer Guerra wanted them to do.  Officer Guerra was seeking revenge.  Later that day, Scott was at chow, and his friends told Scott to look up.  There was officer Guerra, up in the gun tower, pointing his gun at Scott, harassing Scott some more.  Scott told me that he thought for sure that officer Guerra was going to kill him. This officer is known for harassing and threatening inmates, and civil suit was filed against him in 2000.  The names of the witnesses to all of this are in the report.  They include a Sgt., officer and inmates.
 

Once again, Scott is placed in ad. seg. --“for his protection.”
 

The guards are retaliating once again, because Scott complained about one of them.  They all stick together, and have their code of silence.  Same story, just a different prison.
