Notice is hereby given that Joel Brown, petitioner in the above named case, appeals to the United States Court of Appeals for the Ninth Circuit from the final judgment in this action on the 13^th day of November, 2002. 

This appeal is taken, and believed necessary, for the following reasons: 

1. The Judge seeks to narrow the scope of the grand jury statute by limiting what issues a grand jury may receive and investigate. If that truly is the case (and I assert that annotation to the statute prove otherwise) then the Judge could have recognized the equal protection deficiency and declared the statute Unconstitutional and ordered that "One Federal Grand Jury per each Circuit should sit for a one year period every year" for citizens to lodge complaints against government officials when government officials charged with all prosecutions will not prosecute their own peers; 

2. The District Court's "Order denying petition for writ of mandamus" violates the equal protection clause of the United States Constitution. The District court places an assumption that the Grand Jury Complaint seeks indictment against the judge whom sentenced me to prison--this is untrue, Judge Grover is in no way listed in the complaint. I believe that is a tactic to discredit me as some prisoner that is complaining about being sentenced to prison--that is not so, I turned myself in to face Constitutional process; to determine what my actions meant under the law and what punishment I might suffer as a result. And when I challenged that process--of juveniles being tried as adults--I now allege judges have obstructed justice and abused their power to avoid the truth of that challenge upholding a political agenda rather than the Constitution, in every court except the sentencing court. And I've had to do this since no official will prosecute a judge (or one of their own)--unless they piss-off one of their own. So, I now seek grand jury indictment of judges whom are now (and I assert judges will go to any length, even as in this mandamus) blocking my complaint from reaching the citizen's that comprise any given grand jury--Convenient, judges can decide, that way, whether or not they themselves (or any other government officials) will face and answer to the citizen's of the U.S. on criminal allegations. 

3. Since judges will not hold themselves and other government officials accountable to the laws they pass and enforce, then, I must wage this battle in the court off public opinion as I have been: I will fight as I have for the past 10 years--in compiling the evidence of government corruption, in stealing the taxpayers money, in the court's helping those actions along by covering it up by their rulings, all a matter of public record in various courts. So, even if I lose (Because judges can cover all this up by simply denying officially and legally filed papers) it is preserved for History in that way, plus it is on the Internet (a Google-Search of "Joel Brown" I was informed should bring it up). I just wish that the 50% of the population that is disgusted with the government and its politics, that doesn't even bother to vote anymore, would fight to get placed on the ballot an option that in every election "a box appear on the ballot form that would bar the two major candidates from running in any future election or from being appointed to any government position" if the voters feel the candidates have served their political interests over the public's while in office, have run negative campaigns, or are just plain fed up with the "party system," that way people's votes would really mean something and officials would realize they serve the public not their party. 

4. I believe the District Court was served a copy of the petition for writ of habeas corpus I filed with the California Supreme Court, or, was contacted by phone about the petition which caused this court to deny the instant mandamus because the Supreme Court sent a copy of said habeas corpus to the prison officials I claim are retaliating against the prison population for CDC's being exposed in the Corcoran Shootings, and the possibility of murder charges that the Attorney General and Governor Wilson wouldn't prosecute. That is blatant and patently unethical if not also against the law. 

Lastly I leave the Court, and People who may see this, with a thought: Life, Liberty, and the Pursuit of Happiness is very narrowly regarded by the government--majority of families or persons can ill afford to lose their jobs without financial ruin (threat of losing their home or being able to feed themselves/family, or they work long ass hours--away from their loved ones or time they might use for themselves--just so they can try and carve out a meager slice of the American Dream); the politician has no vision for the welfare of its people--a nationalized food purchasing system to ensure no kid or family goes without being fed even one single meal one single day (a tax taken from every paycheck or income to bulk buy food at its cheapest price for the good of the People), similarly, a home and land buying program to ensure every person or family has shelter, safely built, at its cheapest price for the American citizen's Liberty (no person or family should ever face losing a roof over their head); and, the same pay with half the hours so the American person has the basic liberty to pursue happiness and be apart of the family again to raise kids up with the family values that seem to be eroding. 

But no, the politician allows big business to lie, cheat, and steal (Enron, etc.) Form the public while lining the Campaign pockets so they can get elected and look out for Big Business interests to line the campaign pockets again (politicians pay lip service that they will fight to get what money they can back that Big Business stole for those affected. Well, I don't see the politician's parties recognizing those contributions were the fruits of Big Business's illegal activity and therefore illegally donated and due back to the victims of those illegal activities--political parties should be made to return all donations made over the span of time it is determined those Big Business's were engaged in illegal activity); allows Big Business to rape the American Patriots (in all the above mentioned ways), whom, if called up, is sent to war to protect political America's interests (too often Big Business's interests); and the politician (whom I feel I should say here appoint and confirm federal judges blocking my grand jury complaints I allege they are covering for) doesn't force business to make its money on the foreign markets rather than the regular American--Big Business shows no loyalty to the American People, only loyalty to the Dollar, in cutting jobs to increase or maintain a profit margin. 

Government, and these courts, they can keep protecting their own interests and cronies--but heaven help them when the American People get fed up--The enemies of America are quaking in their boots right now, not from our government, but form the ire of the Collective American People. There can be no true "Equality" of persons in America until a "National Payment System" is utilized: where every American Citizen is paid $200.00 a week for just being alive; a National Work Payment Scale" is adopted setting a salary scale for every job from $200.00 to $2,000.00 a week for minimum work performance for those various jobs; and a performance scale that encourages productivity so that even a $200.00 job scale can perform and make and equal amount to the $2,000.00 job scale, which can only be doubled to $4,000.00 on the performance scale that, so an ambitious person can work eight hours at the top performance scale and equally make the same $4,000.00. Free food, Free housing, and Free education for all that want it and participate--if you don't work, the $200.00 a week for just being alive goes to food and housing (no furnishings, cars, tv's, gasoline, extra electricity, going out to nice places to eat, etc. that work performance pays for). It's all for the People's National best interest. 

Petitioner was granted "in forma pauperis" status and wishes it continued in the Court of Appeals.
