Webster’s New World Dictionary: en-clave (e’ klav’, An’-) N. [<L in +clavis, a key] |a territory surrounded by another country’s territory. An Apt definition or/interpretation of the situation in Shasta County today! The Leaders of Shasta County (Four Star Sheriff Pope and Legal Guru Benito), are desperately endeavoring to establish in Shasta County a lawless enclave beyond the reach and/or jurisdiction of any laws, be they California State Law; United States Law; or International Law and treaties (i.e.: ‘Planet Earth Law’). My problems with this subject are: (1) where to start? And (2) where to finish? Let us begin, then, with International Law, which includes International Treaties, UN Laws, etc. Now, as most everybody knows, there are many conventions, treaties, and, yes, International Laws that govern the treatment of Foreign Nationals detained within civilized nations. The country called THE UNITED STATES of AMERICA, prides itself on a creed of “Truth and Justice to All,” and instigated many of the current International Laws. Recently (excerpt from an Associated Press Articles by Anthony Deutsch, published in the “Redding Record Searchlight,” April 1, 2004.) State Department spokesman Adam Ereli, adding that, “The United States has tried to comply with the requirement that consular access be granted to Mexican and other citizens detained on U.S. soil” [Strangely though, he did not mention Shasta County, I wonder why not?? Hmmm????] To illustrate the manner in which the enclave of Shasta County chooses to ignore International Legal requirements let me please tell you a little story of Moshe Stein, Australian Citizen, and Australian National. On November 14, 2002, Mr. Stein was brought to Shasta County Jail like so much inanimate freight. In fact, he could not walk from the van to the reception room. After requesting medical aid, a nurse-practitioner examined Mr. Stein and declared him too ill to be admitted to the jail. One of the guards (Deputy Meek), over the wishes of others to place Stein in a holding cell, insisted that he be taken immediately to Mercy Medical Center, thereby saving Mr. Stein’s life. Upon arrival at Mercy Medical Center Stein’s blood pressure was 217/123! Eventually, after treatment Stein was admitted to Shasta County Jail. When Mr. Stein was admitted to Shasta County Jail he notified staff that he is a Australian Citizen and National, and that he needed to contact the Australian Embassy or Consulate, or have authorities notify his Country’s representatives of his plight. He was laughed at!!! Over the next few weeks Stein repeatedly asked and pleaded to be permitted to contact the Australian Government, as he is, in fact an Australian Citizen. Stein eventually circumvented the jail authorities by getting another inmate to prevail upon a visitor to contact the Australian Consulate-General in San Francisco on Stein’s behalf. A U.S. Mail carrier did so on Mr. Stein’s behalf. Letters to the Australian Government went unanswered until, on April 2, 2003, Stein asked another inmate to mail a letter for him-that letter was answered! On April 18, 2003, Stein was notified of an impending visit by Consular Official's. On the morning of April 19, 2003, at morning medication line, Stein was grossly over-medicated and nearly died. (But for the survival knowledge Stein possessed, and the “stash” of contraband salt, pepper and sugar, hoarded by inmate Alexander, he surely would have died. Again, on April 21, 2003, Jail Staff tried to over-medicate Mr. Stein, but he refused the suspect medication. Now, one attempt to over-medicate Stein could possibly be construed as an accident. But to call two separate attempts to over-medicate and kill Mr. Stein in conjunction with the warning note can only be taken to be the Machiavellian machinations of a local official attempting to avoid a meeting between Stein and his country’s representatives. Numerous complaints and grievances were filed, ignored and disappeared, but one was answered on 6-17-03. A Staff member allegedly speaking on behalf of Jail Management warned Stein: “If you continue to accuse Jail Staff of attempted murder, you will wake up one day and find yourself dead.” (Quoting Deputy Starrs.) Since then Mr. Stein now accused Jail Staff of “ineptly bungling an unlawful attempt to exterminate the spark of life he possesses.” Now, I fail to see how this treatment, or mistreatment of a foreign national comes within the scope of Mr. Ereli’s statement. So much for International Laws, Treaties and Conventions. (Now, as everybody knows Sheriff Pope of Shasta Enclave wears a General's Four Stars on his Sheriff suit. Is the polish on those Four Stars perchance a tad tarnished?) Shall we now venture into the realm of United States Law?? Now, readers will be conversant with “AbuGhraib of Shasta County Jail,” which demonstrates how Shasta Enclave not only contravenes laws of morality and decency, but contravenes the Fourth Amendment of the Constitution of the United States. There are numerous United States Laws and Constitutional Rules that
are routinely shattered in Shasta County.
