section 3 of Act 139 states that, "machinery" would include steam boilers, unfired pressure vessels, prime movers, gas cylinders, gas holders, hoisting machines & tackle, transmission machinery, driven machinery, and any equipment for casting, welding or electro-deposition of metals and for the spraying by the means of compressed gas or air of metals or other materials, but does not include:
a) any machinery used for propulsion of vehicles other than steam boilers or steam engines;
b) any machinery driven by manual power other than hoisting machines;
c) any machinery used solely for private & domestic purposes; or
d) office machines.
section 3 of Act 139 defines "unfired pressure vessel" as
any enclosed vessel under pressure greater than atmospheric pressure
by any gas or mixture or combination of gases
and includes any vessel under pressure of steam
external to the steam boiler
and any vessel which is under pressure of a liquid or gas or both,
and any vessel subject internally to a pressure less than atmospheric pressure
but does not include gas cylinders
section 56(1) of Act 139 states that, the Minister may make regulations
in respect of any matter which may be prescribed under this Act
and in particular _ _ _ _ _ _ _ _ _ _ _ _
clause 3 of the Factory & Machinery Act (Notification, Certificate of Fitness & Inspection) Regulations states that, the period validity of every certificate of fitness shall ordinarily be 15 calender months from the date of inspection or such longer period not exceeding three years as the Chief Inspector in his discretion may consider appropriate : Provided where any steam boiler, unfired pressure vessel or hoisting machine is out of service for a long period immediately subsequent to an inspection by reason of dismantling or repair of any defeat the Inspector may issue a certifcate effective from the date when such machinery is replaced in service. It implies that pressure safety valve is included.
clause 15(1) of the Factory & Machinery Act (Notification, Certificate of Fitness & Inspection) Regulations states that, _ _ _ _ _ _ _ _ or the owner
requests a postponement for some good and sufficient reason provided that the inspection shall not without the approval of the Chief Inspector be postponed
for a period of more than 3 months after the date due or _ _ _ _ _ _ _ _
clause 15(2) of the Factory & Machinery Act (Notification, Certificate of Fitness & Inspection) Regulations states that, an Inspector may in his discretion advance the date of the regular inspection of any factory or machinery provided that such date shall in no case be earlier than the first day of the 12th month following the month which the last inspection was made.
