COME OUT TO THE COURT HEARING Monday November 26 and Tuesday November 27, 2007 at 361 University Avenue The hearing starts at 10:00am On Monday November 26 and Tuesday November 27, 2007 lawyers for Ontario's Attorney General will ask the Court to strike out a landmark class action lawsuit brought by severely disabled applicants for benefits from the Ontario Disability Support Program (ODSP). The class action demands compensation for the misery and deprivation the Province inflicted on ODSP applicants by administering the program in a way that the Ombudsman of Ontario found was "morally reprehensible". Sarah Shartal, a lawyer who acts for persons with severe disabilities says, " The Province created a quagmire that denied or delayed benefits for very poor disabled people ...benefits that they were entitled to receive by law. People have died waiting for months and sometimes years to receive ODSP benefits." The Attorney General has responded to the lawsuit by arguing that ODSP applicants should be denied the right to have their claim considered by the Courts. The Attorney General is not arguing that there is no evidence of negligence or that ODSP applicants were not harmed by the lengthy delays. They are arguing that ODSP applicants do not have the right to have this question considered by the Courts. It is vital that we have affected persons and supporters in the courtroom to show the judge that a lot of people care about this case and are watching what happens.
