September 28, 2001 To: Chancellor; Provost; Vice Chancellor for Information Technology Systems; Vice Chancellor for Student Affairs; Dean of Students From: Rosa T. Fuller I, as a student enrolled at the University of North Carolina at Wilmington, submit this complaint, which alleges that a University faculty member, Edwin H. Wagenseller, has violated my rights, as a member of the University community, by sending me an e-mail message, to my University address, that is abusive, threatening, profane, defamatory, and a violation of the Universitys sexual harassment policy. Mr. Wagenseller, sent me this e-mail message, dated September 26, 2001, with the use of the Universitys central computing facilities and services, from the address: wagensellere@uncwill.edu, which in part states: "get the fuck out of our country"; "if she values her safety, she should be careful what she says"; "you bloody idiot"; "I . . . reserve the right to tell you and the rest of the world to fuck off!"; "American and fucking proud of it!" The intent of such a message is intimidation, defamation, sexual harassment and the communication of a threat. No student should ever receive such a message from a University faculty member. (It should be noted that my original message was addressed "To the students and faculty of the University of North Carolina at Wilmington." The copy of my message that was forwarded to Mr. Wagenseller, by an anonymous person from the address: uncw seahawks uncw55@hotmail.com, addressed him as a member of the faculty. He responded, as someone who had been addressed as a faculty member, to someone with a student address, with his vile e-mail message.) I ask the appropriate administrative offices and officers of the University to investigate my allegations and, if warranted, hold Mr. Wagenseller accountable for his conduct under all applicable university policies and procedures. I also ask the appropriate University offices and officers to stop the entry into the Universitys central computing facilities and services of messages from both addresses cited in this complaint. I also ask the University to communicate immediately with all members of the University community and remind them of the provisions of the Computing Resource Use Policy. Rosa T. Fuller |
