I (we) the undersigned, do hereby agree, certify, and promise as follows:

1. I understand that the sport of waterskiing is an inherently dangerous activity and a bodily contact sport; and I knowingly and voluntarily assume all risks inherent thereto, (including but not limited to the risk of drowning, of striking submerged, floating, or fixed objects including the lake bottom, shoreline, the jump ramp, bouys and anchor lines, docks, reeds, debris of all types, the risk of striking or being struck by tow boats or other boats and associated equipment such as skis and ropes, the risk of equipment failure, both mine and that supplied by others, towers and stands, and all other unspecified risks).

2. For good and valuable consideration received, including the use of this lake, its surrounding lands and facilities ( docks, boat ramp, jump ramp, bath house, parking space and roads) in Duval County ,Florida, I expressly release and discharge the landowners (Victory Lake Inc., Michael L. Harris, and James G. Cleveland) and all their agents, heirs and assigns, from any liability whatsoever they may owe to myself, my heirs or assigns resulting in any way from the ownership, maintenance, or operation of this lake or the surrounding lands or of any improvement or instrumentality thereon because of injury of any kind whatsoever to me or others or damage to my property or the property of others caused by any reason whatsoever, INCLUDING BUT NOT LIMITED TO ACTS OR OMISSIONS CONSTITUTING NEGLIGENCE BY MYSELF, THE LAND OWNERS, THEIR AGENTS AND ASSIGNS, OR ANY TOURNAMENT OFFICIALS, OR ANY OTHER PERSON OR PARTY WHATSOEVER.

3. I further covenant not to sue or to bring any legal or equitable action against said landowners or any of its agents for any reason whatsoever, INCLUDING ANY NEGLIGENCE ON BEHALF OF SAID LANDOWNERS OR ANY OTHER PERSON OR PARTY WHOMSOEVER which might stem from the ownership, maintenance, or operation of the lake, premises, or facilities or my participation in any activity thereon, and I expressly waive any legal or equitable claim that I might have thereby arising.

4. I further specifically agree to hold harmless and indemnify said land owners for any loss they may suffer, including but not limited to any settlement or final judgment, including costs and attorneys fees, arising out of any injury to person or damage to property of any kind and for any reason to myself, my family members, my guests or invitees, or damage to property of or personal injury to any other parties I may cause on said lake or premises, howsoever caused, WHETHER BY THE NEGLIGENCE OF MYSELF, SAID LAND OWNERS OR THEIR AGENTS, OR ANY OTHER PERSON OR PARTY WHATSOEVER.

I am of sound mind and have read the above and do sign voluntarily and freely.
