No. The only thing that should be forbidden is bad driving. The reasons behind it shouldn't matter, I don't care whether the driver causes an accident because he was on the phone, or reading his e-mail on his Palm, or making dinner in his portable microwave oven, or caressing his girlfriend's legs. Forbidding mobile phones specifically is directly derived from the philosophy of need. This would mean basically "You don't really need to be talking on the phone to sell your stock options while driving, you can wait, you selfish bastard!", but also "Ah, you really needed to take the coin out of your baby's hands, then it's not that bad. You shouldn't have killed that other driver, but since we understand that your baby might have gotten injured had he swallowed the coin, we'll give you a lesser penalty". The promoters of this law are strictly motivated by the hate against the people who speak on the phone, not against the bad driving. If they were objective, they would see that all is needed is to enforce the existing laws and punish the drivers without passing a 'moral' judgment on what he was doing prior to the infraction.
