Lesson:                                  1             

OBJECTIVE:                       SWBAT understand the nature of what a tort is and how they can be affected by them.

PROCEDURES:                  

1.        intro to Torts

2.        difference between torts and crimes (where are cases heard?  How?)

3.        learn important terms like: tort, plaintiff, defendant, judgment, liable, remedy, liability, settlement, intentional wrong, negligence and strict liability.

4.        students are each given a word of two and must write an example for each term and share it with the class.  (they may not use examples already given)

5.        problem 18.1 & discuss as class

6.        The case of… The Lung Cancer Death (page 217) as a discussion in class.

Lesson:                  2

OBJECTIVE:                       SWBAT distinguish between criminal and civil lawsuits when filing charges.

PROCEDURES:                  

7.        collect & review homework 18.3

8.        How do you take your case to court?  Who pays?  What proof is necessary?  How is it different from a criminal court.

9.        the case of… 1. The Spilled Peanut Butter (page 220), 2.  The Airline Explosion (page 222) and 3.  The steering Wheel Failure.  Students are broken up into 3 groups to work on these cases.  They must answer them in writing to turn in and must present to the class their case and outcome based on their understanding .  (5 points)

HOMEWORK:                     responsible for reading chapter pages 219 -229.  answer problem 18.6, 18.7 & and 18.8 in writing (5 points each)

OBJECTIVE:                       SWBAT explain the purpose of liability insurance and its role in American Society.  They will also be able to evaluate its effectiveness.

PROCEDURES:                  

10.     Review homework 18.6, 18.7 and 18.8

11.     Discussion on Insurance (especially as it relates to NJ)

                                                                           i.      Who is affected by law suits? Premiums? Fraud?  What to do about it?  Should you carry it? How Much? Etc.

PROCEDURES:

Lesson:                         6         

OBJECTIVE:                       SWBAT define and explain what an intentional tort is.

PROCEDURES:                  

19.     complete case 19.1 when done with test

20.     Teacher intro to intentional torts and lectures briefly on the types of damages that can be awarded (compensatory and nominal and punitive)

21.     class builds a definition for the term battery

22.     students are given 10 minutes to write a story involving an unwanted “touch” or “battery”.

23.     stories are then read aloud.

24.     discuss which stories should be considered torts and which should not.

OBJECTIVE:                       SWBAT identify what an intentional tort is by learning the content and then applying it through analyzing example cases.

PROCEDURES:                  

1.        DEFINE: intentionally, compensatory damages, nominal damages, punitive damages, battery & assault

2.        case of the Mischievous child

3.        bullying when do you cross the line (page 234)

 

HOMEWORK:                     read chapter 19 and complete 19.3 & case of captured shoplifter

OBJECTIVE:       SWBAT identify what torts intentionally harm property.

 

4.        DEFINE: real property, personal property, intellectual property, trespass, attractive nuisance, conversion, patents, copyright, infringement, novel, derivative works, first sale, fair use

5.        case of the burglar who was bitten (page 242)

6.        DEFINE:  consent, privilege, self-defense, defense of property

7.        “you be the judge” on page 248 ‘intentional torts and legal defenses’
