Report Date: 11-22-96

 

On this date I was dispatched to the above location in reference to a retail theft complaint at Albertson's.  However, it was told to us that the suspect had fled from the area and possibly had gone into Scotty's.

 

Upon our arrival, Deputy DiBruno and I met with Jeffery who had watched the suspect go into Scotty's after running from him and his manager, Todd.  While talking with Jeffery he gave us a description of a white male approximately 5'8" - 5'10", 180-190 lbs., wearing beige shorts, cream colored shirt which was a pullover with dark diamond designs.

 

While getting the description, Jeffery had pointed toward the front door of Scotty's and said there he is; however, my partner and I could not initially see him because of the pillars in front of the business.  After we ran to the far east of Scotty's, Deputy DiBruno and I were then shown by Jeffery the suspect running south across Walsingham from the Albertson's parking lot.  By this time, Deputy DiBruno and I were at Walsingham coming out of the parking lot, observing a suspect who matched the description given to us, who had looked directly at us and kept running south across Walsingham. Deputy DiBruno and I continued across Walsingham into the direction where we last saw the suspect running at which time we found him after he had hid himself in some bushes.  It was then that deputy diBruno and I ordered him to stop at which time he hesitated as if he was going to run again.  Deputy DiBruno and I then gained control of the suspect at which time we escorted him back to the cruiser where he was placed into custody.

 

Deputy DiBruno and I then took the suspect back to Albertson's where we made contact with Jeffery and Todd who positively identified the man we had in custody as the man who attempted to steal the food.  It was explained to us later that the suspect, later identified as William, had got a grocery cart, filled it with the listed items of property which totaled to $232.82 worth of goods and after getting change for a $100 bill, William then went and got two bags of ice at which time he left the store without paying for any of the merchandise.  It was then that Todd and Jeffery had followed William out into the parking lot and when they confronted him, William then left the cart and ran east toward Scotty's.  That is when Jeffery and another co-worker had gone to Scotty's to wait for us.

 

The other witness who watched William leave the store with the goods was Minda, who was the one who changed the $100 bill.  After talking with the witnesses and gathering their witness statements and a copy of the receipt of the goods taken, I then went and read William Miranda from card at which time William said he understood his rights and would answer any questions that I might have.  I asked William why he took the goods from the store and William at first was very nervous and hesitant; however he said, " I knew it was wrong but I stole the stuff so that I would impress my future employer."  Apparently, William had just been fired from his job and only had approximately $500 left to his name which was on his person while he stole the goods from Albertsons'.  After gathering William's statements, he was then transported to the PCJ without incident and charged with retail theft and resisting an officer without violence.

 

William had two items which were not accepted by the jail, one of which was a GTE cellular phone with a black leather case and one Swiss army knife which was taken to the Property and Evidence section for safekeeping.  A copy of the bulk property form along with the receipt for the goods taken and the witness statements were attached as ARMS Support Document.
