ATF cracks down on firearm law breakers

A.T.F. has not been present, in an official capacity, at gun shows for the last 17 years. In general, and with some exceptions, local agents have not aggressively participated in enforcement activities at gun shows. They have been under orders not to do so except in cases where there are specific vio-lations or there is a specific dealer they are investigating.

The exceptions have been cases where A.T.F. was actively pursuing a criminal investigation of one or more of the dealers who were participating in the show, or where some local agent or agents took it upon themselves to conduct surveillance or enforcement activities at a show.

All this has now changed. A.T.F. is now preparing to target gun shows. You should expect increased A.T.F. presence and activity at your shows. In the past, operations at gun shows have required a relatively high level of supervisory approval. Under A.T.F.'s recently issued internal law-enforcement directive, individual agents are free to attend gun shows and to aggressively enforce the law and A.T.F. regulations at shows. Under the new directive, all the local agent needs to begin enforcement activities is the approval of the S.A.C. or Special Agent in Charge of the local office. This change in the requirement for the level of supervisory approval required is expected to result in significantly increased enforce-ment activity at shows.

One of A.T.F.'s first priorities will be to reduce the number of private-party sellers at gun shows. Collectors with curio and relic or antique firearms will not be a high enforcement priority. However, unlicensed individuals with multiple tables of guns who are selling their "private collections" will have a lot of A.T.F. attention focused on them. It is expected that A.T.F. will increase its surveillance on them.

It is expected that A.T.F. will increase its surveillance/enforcement activities with dealers who do most or all of their business at gun shows. They will expand the enforcement activity in the area of dealers who sell at gun shows in a state other than where their license is issued. Expect the A.T.F.­imposed requirement that out-of- state dealers return to their licensed premises and ship guns to the transfer dealer from the show will be more aggressively enforced, and that out-of-state dealers who deliver guns to the transfer dealer at the show will be the focus of increased A.T.F. attention.

We should consider making sure that our dealers are aware of anticipated changes in enforcement activities so that they can avoid potential problems.
