the fact that my third petition on the same matter was admitted by the court was a big shock to the authorities and every effort was made from the very beginning to stall the proceedings.
my hunch is that from then on, the police man who calls himself CBI "officer" and his stooges from the "special" branch took the matter in their own hands and they got real busy . a whole lot of criminal elements from all walks of life were roped in and the plain clothes men were rushing me inside the court room even.
incidentally it was on 03 march 04 shortly before i was to present the case in the court that my brief case was "picked up" by the "special" branch in ernakulam.
the notice issued to the respondents who all have their offices in trivandrum which is only a few hundred kilometers from ernakulam where the kerala high court is located was not acknowledged by the respondents even after three months!
things got stuck and i had a difficult time putting them back on the rails! ultimately after more than four months, a counter affidavit was filed by the dme.
i came to know of the existence of the affidavit only in the court. when i demanded a copy the govt. pleader refused saying that it has been sent to me by post.
copy of the counter affidavit was finally delivered to me on 12 july 04 - just in time for a (female) govt pleader to present it in another completely unrelated case.
incidentally this legal document was sent by the govt. pleader under certificate of posting (and not by registered post) which means there is no record of the date of delivery and as to when it was delivered. in short the delivery may or may not be effected at the discretion of the police men "managing" my affairs in trivandrum.
the false affidavit the so called counter affidavit filed by the dme can simply be described as a false affidavit.
in this false affidavit, the documents are listed in english alphabetical order and after letter "h" the next letter is "l". - either the govt pleader who prepared the counter affidavit probably does not know the english alphabet or it could be that some documents are being kept away from me ( for reasons to be explained later).
even other wise the false affidavit of the dme is a real mess. the documents have been numbered variously at least three times. obvioulsy it was not at all a straight forward affair.a doctored document i am certain that one of the exhibits of the above affidavit at least is a fake; i can vouch for this because i have seen the original document once in 1998 and in retrospect remember certain facts which are not there in the copies certified by the dme as true.
am i surprised? not at all; this is typical of the set up.
if one document is a fake or, more aptly in this case, a "doctored" one, others could as well be. but who is bothered?! the culprits here are highly influential people and can get away with anything.
there was nothing new to justify the adverse remarks in the CR in the false affidavit and it was just a repetition of whatever nonsense was being dished out as the excuse on earlier occasions.
on the other hand there was a serious exercise in mud-slinging and character assassination basically meant to deviate the attention of the court from the original issue. later developments proved that the bait was swallowed hook, line and sinker!

govt. pleadergovt. pleader by the way is a political appointment. some one who is a govt pleader during a k antoney's time is most unlikely to remain as govt. pleader when achutanandan comes into power and vice versa.

" lady "during the same time i had filed a petition against the police harassment that i am facing. this case was to he heard on july 16 in another court. the harassment was a fact and there was no way the police men could have got away under normal circumstances.

as usual the "insanity" plank was played here as well. the "lady" govt pleader presented all the documents produced by the dme in the court and for the rest of the time the judge was busy reading the jucy details provided in the dme's false affidavit - i did not have to say anything at all!
the decision in this case was not in my favour. it was a covert operation and i had no material proof. that way kon may ke lal will dare to give evidence in the court against the natan police man let alone the CBI "officer" police!
one interesting fact that i have noticed is that the judgement says "govt pleader assures the court there is no harassment": am i to believe that the govt. pleader is supposed to tell the court that her clients are harassing me ? !
another interesting fact was that this female desperately wanted my home address; what could be the idea!?
