Sir,
A. in the context of your no.G3-10223/05/DME dated 23.4.2007 i beg to submit the following-
1. i was NOT admitted to the MD course in physiology in the service quota as mentioned in your above letter. I got admission to the above post-graduate course strictly based on merit in the entrance examination of the corresponding year. I was later allowed to avail the lecturer trainee facility as permitted by law in the case of all regular lecturers who manage to get admission on their own.
2. at the time of admission I had executed a bond as in the case of all regular pg students. I have satisfied all the conditions as per the above bond wherein the question of appearing or passing the university examination is not at all a criterion.
3. I do not remember executing a fresh bond after getting the lecturer trainee appointment. However i clearly remember refunding the stipend I had drawn during the initial few months upon being allowed to avail the lecturer trainee facility.
4. I have paid the tution and other fees for the full duration of the course just like any other student.
5. I was drawing a salary for performing the duties of a lecturer in the department of physiology of thiruvananthapuram medical college.
6. I wonder what type of a liability the government has incurred on account of my joining the course.
7. also, I joined the course of my own accord and i would have loved to appear for the examination. i would only say that, if at all i did not appear for the examination, it was not due to any lack of enthusiasm on my part or due to any mistake of mine - that is putting it very Mildly; I can elaborate on the real reasons if need be.
8. I was in service for the next seven years after the completion of the course; but there was no effort whatsoever to recover the damages during all those years.
9. Even after my retirement the authorities waited for almost two years to fix the liabilities! The gratuity amount has been idling in the treasury all the time resulting in financial loss that adds up to a real big sum for a poor homeless individual.
B. If the director still feels that i have to pay the penalty i would request that -
1. i may please be informed of the grounds on the basis of which the penalty of Rs. 20000/- is accounted for and
2. taking into consideration the fact that the bond was executed more than ten years back i may be provided a copy of the same for verification.yours faithfully
