This is our newsletter that we publish to inform the residents of Nepean Park of happenings and information concerning the Nepean Park Community. If anyone would like to have something published please feel free to contact anyone on the Executive Committee.
Welcome to the new members of Nepean Park Community who have arrived since the last newsletter.
An information booklet for all members of the community is available. This booklet provides information on the important aspects of being a member of the Nepean Park community, correct some of the information provided by real estate agents and fill any knowledge gaps that you may have. If you would like a copy please contact any of the executive committee.

The issue of our liability for any accident arising from the unfenced dams on the estate has taken up most of the Committee’s time at our last three meetings. Our major concern has been that our insurance policy to protect us from a damages claim does not cover us for any of the unfenced dams. The fenced dam near the sewage treatment plant is covered by the policy.
Legal advice so far has told us that we should not lay the Association open to a claim due to an accident, since, in the worst case, a serious incident could expose us to a claim potentially in the millions. We cannot lay ourselves open to that level of risk, so we have to have insurance. Under Section 40 of the Community Lands Management Act, we are required to carry insurance for death or injury for which we could be liable for damages. Our insurers, CHU, will provide cover if we fence the dams.
Committee members have extensively explored other options to secure insurance without having to fence the dams, but so far none of these approaches have been successful. The matter will be reviewed again at our next meeting on June 8th.
Minutes of our meetings are placed in the noticeboard at the Community Centre and letters to the Executive Committee, addressed to the Secretary, Brook Lyons, may be left in the mailbox at the Community Centre or sent to the managing agent, MDM.
Members of the Association who wish to raise an issue can also telephone a member of the Executive Committee and are always very welcome to attend our meetings.

You will be aware that Sydney Water (www.sydneywater.com.au) has introduced Level 2 water restrictions from 1st June 2004. As the level of the recycled water is still very low, the Executive requests that association members show equivalent restraint with the recycled water. That is, only hand held watering from 5pm to 9am on Wednesday, Friday and Sunday. Level 1 restrictions still apply.
Grass is very resilient and will recover quickly after rain. Accordingly, Residents are requested to limit watering to gardens and shrubs and not to water their grass with recycled water. Please remember that the recycled water forms part of the fire and bushfire management plan for Nepean Park, therefore, if water levels become critical the recycled water may be rationed or shut off to provide water for use in fires, particularly bushfires.
There is also some debate about the status of tank water. According to an ABC radio interview with either the Minister for Utilities or Sydney Water, tank water that has been replenished by water carters is supplied from Sydney Water resources. Therefore, that water is subject to water restrictions! I don't know if a situation has been tested yet but water inspectors are on the increase.
Thanks again to everybody for showing restraint in their use of the recycled water. Despite remaining very low throughout the summer months water remained available. However, the forecast is not promising and voluntary water restrictions should still be applied.

The Black Swan

The Black Swan is distributed in suitable parts of continental Australia and Tasmania. Lives in pairs or flocks frequenting river, lakes, dams and swamps. The Black Swan is even happy in inner city ornamental lakes. When flying from one feeding spot to another it often does so in the evening or moonlit nights. They live on aquatic plants and animals. Breeding season is chiefly autumn and winter using nests of twigs, rushes and aquatic plants. Up to six lustrous pale green eggs are laid. (Picture courtesy Cayley's What Bird is That.) |
Where can we go sailing?
For those who are interested in sailing, the Penrith Lakes scheme is available, provided that there are no events that require the warm-up area next to the racing course. There are pontoons and a boat ramp for those than need one. Before leaving for the Penrith Lakes it is a good idea to check with the weekend ranger on 0409 535 760 or week days 4730 6790. There is also a small fee for using the lakes.
Any one want to form a running group?
There seems to be a few runners about Nepean Park. If any body wants to be in a running group let me know and I will advertise it through the Newsletter.
