Dear the honorable Judge Mohamed Kamtab and the Judge for the Case:

I am writing to request you to order the plaintiff to immediately stop harassing people on the Metro trains for Metro Train Fare Evasion because the plaintiff broke Federal and Calfornia state laws. I also request the Superior Court of Los Angeles County to dismiss the two Metro fare evasion charge cases againt me without prejudice. I list the following:

(1) In the 29 law codes of California, the words "fare evasion" can not be found. In other words, there is no law against Fare Evasion.

(2) California Public Utilities Code Section 7653-7661 and Civil Code Section 2180-2191 stipulates:

If any passenger refuses to pay his fare, or to exibit or surrender his ticket, when reasonably requested to do so, the conductor and employees of the corporation may, on stopping the train, put him and his baggage out of the cars, using no unneccessary force, at any usual stopping place, or near any dwelling house.

(i) Hence, the plaintiff broke the above California law by taking custody of the defendant and issuing a $114 fine ticket.

(ii) The defendant was prevented to use a Metro fare token to buy a ticket at the Long Beach transit station when boarding the train. The defendant promptly exhibited a valid Los Angeles Metro fare token and offered again to buy a ticket but was refused. Hence, the plaintiff broke the above California law the second time when he took the defendant off the train.

(3) Past case decisions become law. The defendant knows for sure that a fellow homeless man Mr. Avin was granted "No Payment" for Metro Fare Evasion by a judge. The defendant had obtained free Metro bus rides for one month prior to the ticket. This is also a case law.

(i) The government law enforcement agency, LA Sheriffs, broke the California law the third time.

(ii) The Long Beach Court House, as represented by M. Vandeman and John A. Clarke, broke the California law by refusing the defendant's written request letter to dismiss the Fare Evasion charge.

(4) The current practice of the Metro train authority to contract the LA sheriff to issue $114 fine tickets is not only against the above California law but also the US Declaration of Independence of 1776, i.e., contrary to "Equality, Reason and Conscience, etc.".

(5) The United States Civil Rights Act of 1964 bans discrimination because of a person's color, race, national origin, religion, or sex. It includes the freedom to seek employment, vote, and use hotels, parks, restaurants, and other public places (contact the Equal Employment Opportunity Commission established by the act, consult US Civil Rights Commission).
