Court Case of Henry of Eliza Ann Myers

Petitioner is trustee for Eliza Ann Myers , wife of Henry Myers, and Littleton Myers, a minor son of Henry and Eliza Ann. It is alledged that on Nov. 6, 1820, said Henry Myers made a trust deed to petitioner for 173 acres in B.D, on Hollow Creek, and nine slaves and that on Feb. 8, 1821, Myers and wife contracted to sell the land to Isaac Bailey and he was to apply the purchase price to the satisfaction of certain judgments against Myers, but instead, he, Bailey, has had the judgments levied on some negroes. Trustee refused to join in sale until Bailey had performed his contract. Answer of Bailey refutes main allegations of plaintiff, and says 100 acres of the land belonged to Mrs. Myers which she received in a division of estate of her father (unnamed) and that 50 acres more of the land was in fact the property of Tobias Brooks, son of Thomas Brooks, under a deed given him my Mrs. Myers' mother (unnamed), and for these reasons he had refused to pay the judgments.
