PRELIMINARY PROGRAM

FAMILY MEDIATION:

1. Pre-mediation: Strategies and tectonics of approach to the couple's other member when the petition of information is only carried out for one. Doubts, ambivalence and discrepancies regarding the decision to separate, or the decision of solving it through mediation.
 
2. Family mediation applied in conflicts other than separation or divorce. Advantages and inconveniences of extending the pattern. Methodological and practical deference.
 
3. Marketing of family mediation. How “to sell” the product to the couples, to the Institutions, to the Society.
 
4. Standards of accreditation in family mediation: Formative systems and objectives of the mediator's training.
 
5. The place of the Law in the mediation: how the artificial information consents, in its case.
 

6. The influence of the juridical paradigm of conflict resolution in  Mediation. The presence of the couple's lawyers   in the mediation session.
 
7. The children in the mediation process: It is advisable that the mediator speaks with the children. In affirmative case, when, how and with which purpose. How to prepare parents and children for the chat. How to use the obtained information later.
 
8. The Family Mediation: Is it with the couple or is it with the family and in what extension? Techniques to manage the interviews with other relatives' presence and moment of the process in which include them, in its case. Special reference to the new couples.
 
9. The “caucusing” (individual meetings) is an useful tool? Can it be advisable to use it in certain circumstances. What should be done with the resulting information?

11. What to do when it appears in  mediation strong emotions in one or in the couple's members?.
 
12. The mediator's Impartiality/Neutrality/ Functional Equidistant: how  is it accomplished?, how  is it controlled in the dynamics of the interview and in the process. How to act when one of the couple's members feels that the Mediator is being partial, or when himself feels that  Special reference to gender problems between the mediator and the couple of the other sex..
 
13. The use of metaphors in the Mediation: is it advisable? If it is it, when and how?
 
14. Co- mediation: Specific training. Technical needs for its practice. Co- mediation for gender reasons.
 
 

COMMERCIAL MEDIATION

1. - Models in commercial mediation: The theory and its  practice. The role of Legal information. Should or not the mediator  give legal information?

2. - Ethical problems related to the different standpoints (models) in the practice.

3. -Lawyers' firms and the commercial mediation: experiences

4. - Mediation within the Public Administration and with the citizens.

5. -The multiparty commercial mediation.

7. - Comparison of courts and out of courts experiences of commercial mediation.

MEDIATION IN THE SOCIAL AREA

a)Mediation with young offenders:

b) Victim Offender Mediation with adults
 Difficulties and techniques of application. Effectiveness. Studies, statistics

c) school Mediation:
Programs in use. Difficulties in their application, Strategies for its implementation and studies of effectiveness
Techniques that helps the learning by the pears of  the win win paradigm

d) community or social Mediation: mediation among neighbors
Their popularization in the social structure
The training of the mediators: professional or volunteers.
Mediation houses: experiences and operation.

e) Are there limits to mediator's confidentiality if he gets to know about some criminal act or a fact that it should be denounced.  Violence, robberies, lesions etc.
 
 

Common to all areas.
