TERMS AND CONDITIONS OF MEMBERSHIP
Due to the networking, or multi level nature of this agreement, and the typical misconception of multi-level or network sales, which is held by those who are unknowledgeable of the topics covered in this course material, it is necessary for us to make all terms of this agreement clear to the purchasing party, before accepting any consideration of payment for the products and services provided under this agreement.
The following is written in legal language for those of a legal mind set to derive necessary information to determine the validity of this agreement and understand the terms of the agreement by all parties before making fraudulent statements or filing frivolous actions against any party named in this agreement, for any reason whatsoever.
Please read and sign this form before sending funds in any amount to the Computer Center.
1. This is a wholesale purchase of educational material in the form of audio & video tapes and written text, as well as a retainer for personal and computer services provided by the author of the material. This material is written and provided by the author but the solicitation for the direct sale of said material is NOT being made by the author, but by a third party named as sponsor for the member making this application.
2. This agreement is protected under the interstate commerce clause of the Federal Constitution and membership and participation in this private membership organization shall not be restrained, restricted, or taxed by any state.
3. Members receive compensation in the form of legitimate payment for the expenditure of their personal services, time, and effort to sell the products made available through this offer, and are NOT being paid for the sole activity of soliciting others to participate in the marketing plan offered along with these products and services. Members must provide follow up personal services after the sale of this program to those from whom they receive commissions and bonuses. The computer center serves as a drop ship facility, on behalf of members, to place the products into the hands of the end user, so NO INVENTORY is being stocked by members for any STATE to tax or regulate. Members are NOT purchasing a distributorship, equipment, franchise, or any other legally identified entity.
4. Membership in this educational program is voluntary and not required to receive benefits from the study of the material. However, members are required to pay for any and all products or services provided by the computer center, prior to shipment of the material. The organization itself is NOT a company per say, but rather a privately funded institution receiving NO benefit or privilege from any local, state, or federal agency, and is NOT under contract with any local, state, or federal agency.
5. The primary function of the institution is to provide public information of personal, religious, political interests, and privately held social convictions concerning daily events which occur within commerce, the world around us, and to restore public confidence in the free enterprise system, The Constitutional and Christian values upon which the nation called “America” was founded.
6. The advertising of the agenda set forth in this offer, and solicitation of funds to support this institution are similar to those used by the two major Political Parties, Civic, and Religious Organizations, and are NOT false or misleading, or deceptive as members receive exactly what they pay for, and what the institution advertises to provide to the public sector, and all terms of the agreement are spelled out in detail and must be accepted by the person making application before funds are accepted.
7. This offer complies with Federal Law under the United States Postal Code, as the author of the material has a direct interest in distribution of the information provided, and is entitled to recover all expenses involved in distribution of the material and compensation for all products & services provided under this agreement.
8. Any and all illustrations of potential earnings provided by the sale of this material may be verified upon written request, but are not implied to be earnings of those who claim to be sales representatives, but do not perform under the terms of this agreement.
9. Risk is limited to purchase price of this material, and shall NOT be construed to be a condition of which the author or member does not have any personal control, nor is any party to.
10. Chance for success in marketing this opportunity is limited to the person’s desire, ambition, and ability, to learn to become a productive member of the general work force, and NOT a condition of potential saturation of the market.
11. GIFT: This is not a gifting program!
12. Consideration: Consideration is for payment of product & services.
13. Pyramid: The marketing structure of this program is linear step, not pyramidal in nature or structure.
14. Personal participation is not limited so the structure may in fact resemble a graphical design, and all commissions and bonuses flow upline naturally above any and all sales, NOT to the top of the proverbial pyramid scheme where only one person receives the money.
15. Advertising or providing this offer does NOT constitute a violation of public policy or law, and shall NOT be construed to do so. Many years of study of public policy and law have in fact determined the design of this promotion and all rights held by the author or members of the organization affectionately called Life Without Debt, are reserved without prejudice under 1-207 of the Uniform Commercial Code, and Article 1:sec 10 United States Constitution.
