CHAPTER: 6 ARTICLE: 12 - THE WORLD CHAIRMAN |
(Clause 1) There shall be a World Chairman of the International Human RightsCommission who shell be the Head of Organization and shell represent the unity of the Commission. |
(Clause2) A person shall not be qualified for election as World Chairman unless he/she is a member of Commission of not less then 30 years of age and qualified to be an elected member of Supreme Council. |
(Clause 3)The World Chairman to be elected after the expiration of the term specified in Constitution, shall be elected by the members of Supreme Council or by the members of Council of Founders. |
(Clause 4)The validity of the election of the World Chairman shall not be called in question by or before any court of law or other authorities.The election to the office of World Chairman shall be held within the 90 days before or after the expiration of the term of the World Chairman in office. |
(Clause 5)Notwithstanding any thing contained in this article or any other article of the Constitution or any other law, Muhammad Shahid Amin Khan, shall become the World Chairman of this Commission on the day of adoption of this constitutionby the Council of Founders and shall hold the office for a term of 10 years from that day. |
(Clause 6)Before entering upon the office, the World Chairman shall make before the Chairperson of the General Assembly or the Chief Justice of respective country (oath taken ceremony held) oath in the form setout in the Constitution. |
(Clause 7) Subject to theConstitution, the World Chairman shall hold office for a term of 5 years from the day, he/she enters upon his/her office. Provided the World Chairman shall, notwithstanding the expiration of his/her term, continue to hold office until his/her successor enters upon his/her office. Subject to the Constitution, a person holding office as the World Chairman shall be eligible for reelection to that office, However, no person shall hold that office for more than three (3) consecutive terms. The World Chairman may, by writing under his/her hand addressed to the Chairperson of General Assembly, resign from his/her office. |
(Clause 8) The wife of the World Chairman shall be the First Lady of the Commission with all Privileges of the World Chairman and can act as the Senior Vice Chairperson of the Commission. |
ARTICLE: 13 : DUTIES |
(Clause 1) To direct the day-to-day operations of Commission. |
(Clause 2) To represent the Commission at all forums. |
(Clause 3) To perform any duties delegated or requested by the General Assembly, the Supreme Council or the Council of Founders. |
(Clause 4) To present reports on the matter of Human Rights Violation, Peace and on other subjects. |
(Clause 5) In exercise of his/her function, the World Chairman shall act in accordance with the advice of the Supreme Council and the Council of Founders; he/she is answerable before the General Assembly. |
ARTICLE: 14 :REMOVAL |
(Clause 1) Notwithstanding any thing contained in the constitution, the World Chairman may, in accordance with the provisions of this article, be removed from office on the ground of physical or mental in capacity or impeached on a charge of violating the constitution or gross misconduct. |
(Clause 2) Not less than one and half of the total members of either house may give to the Chairperson of General Assembly or, as the case may be the General Secretary Written notice of its intention to move a resolution for the removal of, or as the Case may be, to impeach, the World Chairman; and such notice shall setout The particulars of his incapacity or of the charge against him/her. |
(Clause 3) The Chairperson of the General Assembly or the General Secretary shall, within 15 days of the receipt of a notice under clause 1& 2, cause a copy of the notice to be transmitted to the World Chairman. The Chairperson of the General Assembly shall summon the all houses to meet in a joint sitting not earlier than 90 days and not later than 120 days after the receipt of the notice by him/her. |
(Clause 4) The joint sitting may investigate or cause to be investigated the grounds or the charge upon which the notice is founded. The World Chairman shall have the right to appear and represent him/herself during the investigation, if any, and before the joint sitting. If, after consideration of the result of investigation, if any a resolution is passed at the joint sitting by the votes of not less than 2/3 of total members of all houses declaring that the World Chairman is unfit to hold the office due to incapacity or is guilty of violating the constitution or of gross misconduct, the World Chairman shall stop to hold office immediately on the passing of the resolution. |
ARTICLE: 15 SECRETARIAT OF WORLD CHAIRMAN |
(Clause 1) The Secretariat shall consist of a Principle Secretary and the staff of the World Chairman appointed by the World Chairman. The members of the Secretariatneed not belong to the Commission. |
(Clause 2) The Principle Secretary shall hold office during the pleasure of the World Chairman and shall be entitled to such privileges as the World Chairman may determine. The World Chairman may make such provisions as he thanks fit for the discharge of the function of a Principle Secretary and following staff of the Secretariat; |
CHIEF OF STAFF PRINCPAL SECRETARY CHIEF SECURITY OFFICER CHIEF OF PROTOCOL CHIEF SECRETARY CHIEF OBSERVER FOR HUMAN RIGHTS VIOLATIONS PRINCIPAL INFORMATION OFFICER PRIVATE SECRETARIES ADVISORS , AMBASSADORS DIRECTOR GENERALS FOR HUMAN RIGHTS SPECIAL ASSISTANTS & PERSONAL ASSISTANTS, ETC.... |
(Clause 30 Notwithstanding any thing contained in this constitution, the World Chairman shall act in his/her discretion in respect of any matter in respect of which he/she is empowered by the constitution to do so and validity of any thing done by the World Chairman in his/her discretion shall not be called in question before any authority or any court of law in any state or country on any ground whatsoever. The World Chairman can terminate, dismiss, appoint and designate to any person according to this article. |
ARTICLE: 16 |
THE SENIOR VICE CHAIRPERSON |
(Clause 1) There shall be a Senior Vice Chairperson of the International Human Rights Commission, who shall be the deputy head of organization and shall act as the World Chairman, when the World Chairman, by reason of absence or any other cause, is unable to perform his duty or functions. |
(Clause 2) The term of the office of the Senior Vice Chairperson shall be 5 years from the day on which he/she enters upon his/her office. |
(Clause 3) When the Senior Vice Chairperson is absent or is unable to perform the functions of his/her office due to any cause, such other person as the World Chairman may direct shall act or hold the office as the Senior Vice Chairperson. |
(Clause 4) The Senior Vice Chairperson shall hold office during the pleasure of the World Chairman and shall entitled to such privileges as the World Chairman or the Supreme Council may determine. |
(Clause 5) The World Chairman or the Supreme Council makes such provisions as they thinks fit for the discharge of the functions of the Senior Vice Chairperson. |
(Clause 6) Before entering upon the office the Senior Vice Chairperson shall make before the World Chairman oath in the form setout in the Constitution. The World Chairman can direct or request any other person to administrate the oath of the Senior Vice Chairperson |
ARTICLE: 17 : THE VICE CHAIRMANS |
(Clause 1) There shall be a Vice-Chairman of International Human Rights Commission for each continent i.e. Asia, Europe, Africa, America and Australia, who shall be appointed by the World Chairman. |
(Clause 2)The Vice Chairman?s shall hold their office during the pleasure of the World Chairman and shall entitled to such privileges as the World Chairman may determine. The World Chairman make such provisions as he thinksfit for thedischarge of the functions of a Vice-Chairman in each continent. |
(Clause 3) When the Vice Chairman is absent or is unable to perform the functions of his/heroffice due to any cause, such other person as the World Chairman may direct act as the Vice-Chairman. |
ARTICLE: 18 :THE REGIONAL OFFICE |
(Clause 1)The Regional Offices shall be established for the purpose of supporting theCommission and its activities, including the solicitation of Funds. The statutes and by laws of each Regional Office shall ensure that they shall exist for no other purpose, and shall expressly in corporate this Constitution by reference or otherwise. |
(Clause 2) There shall be a Regional Chief of International Human Rights Commission for each Region, Who shall be appointed by the World Chairman. |
(Clause 3) The Regional Chief shall hold office during the pleasure of the World Chairman and shall be entitled to such privileges as the World Chairman may determine. The World Chairman may make such provisions as he/she thinks fit for the discharge of the functions of the Regional Chief. The Regional Chief and Regional office shall work under the supervision of the Vice-Chairman of Content |
ARTICLE: 19:THE COUNTRY CHIEF |
(Clause 1) The World Chairman shall in his/her discretion appoint the Country Chief in each Country of the World for the representation of the Commission, they shall hold the office during the pleasure of the World Chairman and shall be entitled to such privileges as the World Chairman may determine. The World Chairman may make such rules, as he/she thinks fit for the discharge of the functions of a Country Chief. |
(Clause 2) The Country Chief shall present his/her status reports annually to the Secretariat of the General Secretary. These reports shall include the following informations; |
*Situation of Human Rights in that Country *; Investigations of Commission on reported HR Violations *The names and addresses of all members *Activities of Commission in that country *Annual funding for the Commission and fund raising activities |
(Clause 3) There shall be a cabinet of Country Chief in the exercise of his/her functions in the respective country, members of cabinet shall be appointed by the World Chairman according to the needs of country and commission working, on the advice of Country Chief. They shall hold their office during the pleasure of the Country Chief and shall be entitled to such privileges as the World Chairman of Commission may determine. The Country Chief may makes such provisions as he/she thinks fit for the discharge of the functions of his/her cabinet with the approval of the World Chairman of Commission. The Country Chief will follow the Rules of Registration of respective Country and shell register IHRC as the National/International in that Country and the Constitutional Head shell be the World Chairman of the Commission in every country in case of registration in that Country as International NGO. |
(Clause 7) The World Chairman can appoint The Deputy Chairperson of the Commission, if he pass constitutional Order to replace the post of Senior Vice Chairperson. The all provision of this article shall apply for the post of Deputy Chairperson of the Commission |
