We are all aware of copyright laws and trademarks etc., recently I have had need to explore ALL avenues of these laws - International (National - Australia) and would like to pass some of this information on to you, as it is very helpful and necessary for us who wander around the net thinking that because it appears to be "Public Domain" that we can right click and 'save as' or internal link to sites by, by passing the main page and even copying text from a site. You have to be very careful as to what is being used. In this site I have used verse (covered under the Berne Convention ) Under article 10 Fair Use. BERNE CONVENTION - For the Protection of Literary and Artistic Work *Article 10: 1) It shall be permissable to make quotations from a work which has already been lawfully made available to the public, providing that there making is compatible with fair practice, and their extent does not exceed that justified by the purpose, including quotations from newspaper articles and periodicals in the form of press summaries. 2) It shall be a matter for legislation in the countries of the Union, and for special agreements existing or to be concluded between them, to permit the utilization, to the extent justified by the purpose, of literary or artistic works by way of illustration in publications, broadsheets, or sound or visual recordings for teaching, provided that such utilization is compatible with fair practice. 3) Where use is made in accordance with the preceeding paragraphs of this Article, mention shall be made of the source, and of the name of the author, if it appears thereon. This is the latest turn in the between Disney and Slesinger over rights to Pooh. Slesinger, which bought the rights from the estate of Pooh creator A.A.Milne in 1929 and then licenced them to Disney in 1961, claims that Disney did not pay all the roylaties on the characters. Now Disney says the heirs to Milne and Shepard (Pooh's illustrator) estates came to it wanting to make a deal to get the character rights back and reassign in full to Disney. Slesinger thinks that the use of this copyright law is just a way to get around the issues at hand: that Disney owes Slesinger money and doesn't want to end the Pooh gravy train. The previous Pooh copyright is lengthy and will not go into public domain until 2026. In the meantime it makes Disney $4 billion a year.
