Michael Kelly Commander 5th Division MMCW. I am currently the Senior Officer 9th Brigade 5th Division Mecosta County MI & 8th Brigade 5th Division Newaygo County MI. I am responsible for organizing, training & supervision of Mecosta County MI 9th Brigade 5th Division which consists of the Brigade Headquarters, Service Support Sections, Sniper School, Sniper Section, & Rifle Company. As of December 2003 I am also responsible for organizing, training & supervising Newaygo County Michigan 8th Brigade 5th Division which consists of a Brigade Headquarters Section, Rifle Company, & Sniper Section as senior officer of both Brigades within MILITIA 5th Division MI. The dual purpose of this is to conduct regular joint training exercises to standardize tactics & ensure proper discipline of both Brigades. With emphasis that The purpose of the unorganized militia is to protect life, liberty, community, local, state, & national infrastructure & to ASSIST the lawful authorities of the state & nation in time of crisis. To accomplish these tasks I am assisted by the Executive Officer, Headquarter Element Leaders, Rifle Company-Platoon Leaders, & Section Leaders. All of my men & women are highly capable citizen(s) which adds to the 8th & 9th Brigade`s effectiveness. I encourage all MILITIA 5th Division MI Brigade Units & members to participate with the 9th Brigade & 8th Brigade in conducting joint training exercises with the approval & knowledge of your Brigade Commander & Brigade Headquarters Staff this "call to train" has the approval of the MILITIA 5th Division MI Commander & staff. Purposes & Authority of the Militia: The purpose of the militia as defined by the Constitution is to: 1. Enforce the laws of the Union (The Constitution) 2. Suppress insurrections 3. Repel invasions CONSTITUTION OF THE STATE OF MICHIGAN OF 1963 ARTICLE I. DECLARATION OF RIGHTS MCL Const. 1963, Art. 1, | 6 (1992) | 6. Bearing of arms. Sec. 6. Every person has a right to keep and bear arms for the defense of himself and the state. These provisions affirm the right of the people to defend themselves & their republican form of government from all enemies, both foreign & domestic. That means that the people, as the militia have the right to fight, if necessary. To be "well-regulated" the group must be organized, have an effective means of communications, transport & logistic support. Unit & individual effectiveness, & perhaps even survival, depends upon consistent, frequent training, group familiarity, & the ability to work together as a unit. A regular established program is essential in effective organization at the state & county level. All of Michigan`s 83 counties are identified as a Brigade regardless of size with tactical organization varying in each MILITIA Brigade. Brigade means "A tactical unit & administrative unit composed of a headquarters with supporting units." Each of the 83 MILITIA Brigades in Michigan is commanded by a Major - Lt Colonel in the MILITIA rank system. The 83 MILITIA Brigades are organized into 9 MILITIA Divisions each MILITIA Division is commanded by a Colonel in the MILITIA rank system. Michigan`s 83 MILITIA Brigades 9 MILITIA Divisions also known as MILITIA Corps are commanded by a State Command. The militia embodies the spirit, ideals of our forefathers & is comprised of men & women who are committed to defend our Constitutional Republic, Nation, state & county. An unquenchable patriotic spirit compels us to stand for the individual freedoms, liberty, & sovereignty guaranteed by our Constitution. The militia must stand for what is moral, lawful & right if it is to prevail in adversity. Though the militia does not stand alone. Whenever possible units should work to enlist the support of the community, auxiliary members, & law enforcement. Militia units should in turn support their local elected officials, sheriff, or police force in the lawful exercise of their authority. A Militiaman is simply any citizen in his capacity as a defender of the community, who is obliged to do so within his or her ability. Being a Militia is a role which citizens may fulfill, as the situation requires it is not a permanent condition. But just as each citizen has a duty to defend the community, he also has the duty to prepare himself to fulfill that role effectively, and to join with others in his community to train and to function as organized forces; and the elected officials of his community have the duty to facilitate that organization and training. If those officials fail in their duty, the Militiaman must carry on without their participation. A citizen may be required to fulfill the duties of a militiaman doing so of their own free will. It is suggested that each militiaman train him or herself to conduct actions in this role & train with their County & State Militia. There are many different roles a militiaman can fulfill from information cell, organizing, training, support, to conducting action. Two militiamen are considered a rifle team & should be friends or close acquaintances whom work well together. A fire team is 2 rifle teams whom train together to conduct actions. Their training consist of more than just basic & advance marksmanship. It covers current events, fitness, first aid, means of communication, reporting, observation, cover, concealment, camouflage, movement, land navigation, tracking, tactics, employment, mission planning, survival preparedness, all season camping & community roles in leadership. The citizen's private life is where these skills will be used the most. Since the militiaman is the leader of their "family unit" he or she is responsible first to him or herself their home & work life in defending their personal freedoms through peaceful personal conflict resolution & legal action. It is only in the most "extreme case scenario in defense of ones own life or the immediate life of another person(s)" that a person(s) would have to take the role of armed citizen militia. This must be practiced & prepared for to develop the necessary skills to defend oneself, family, team member(s) & community. Seek out and join the MILTIA in your state and county. The classes of the Militia are (1) the organized Militia, which consists of the National Guard and the Naval Militia; and (2) the unorganized Militia, which consists of the members of the Militia who are not members of the National Guard or the Naval Militia." 32.555 Unorganized militia; power of the governor. Sec. 155. The governor may order into the defense force any members of the unorganized militia in case of riot, tumult, breach of the peace, resistance of process, or for service in aid of civil authority, whether state or federal, or in time of public danger, disaster, crisis, catastrophe or other public emergency within this state. 32.655 State defense force and unorganized militia; determination of emergency. Sec. 255. In case of war, or a national emergency, when the national guard may be in the military service of the United States, the defense force shall be ready and able to protect the state in case of insurrection, invasion, disaster or other emergency, actual or imminent. In such case the governor, as commander in chief, may use the defense force augmented if necessary by all or a part of the unorganized militia not responsive to orders of the president for the time being. The determination of the governor that an emergency exists or is imminent is conclusive. Prohibited Discrimination against Members of the State Militia MCL 750.398. Depriving or obstructing employment of one because he is a member of state militia; dissuading from enlisting. Sec. 398. Any person who shall either by himself or another deprive a member of the organized militia of this state of employment or prevent, obstruct or annoy any such member of his employer in respect of such employment because such member is commissioned or enlisted in the organized militia of this state or because such person performs military duty under orders from competent authority; and any person who shall dissuade any other person from enlisting in the organized militia of this state by threats of injury, in case he shall enlist, in respect of his employment, trade or business, shall be guilty of a misdemeanor. MCL 750.399. Discrimination by associations, etc., against a member of the state militia. Sec. 399. Any association or corporation constituted or organized for the purpose of promoting the success of any trade, employment or business of the members thereof any association whose membership is confined to persons of a particular race, which shall, by any constitution, rule, bylaw, regulation, vote or resolution discriminate against any member of the organized militia of this state in respect to the eligibility of the officer or soldier to membership in such association or corporation, or in respect to his right to retain his membership in such association or corporation, and any person who shall aid in enforcing any such provision against any officer or soldier of the organized militia of this state with intent to discriminate against such member on account of his membership, shall be guilty of a misdemeanor. MCL 750.400. Molesting or abusing member of state militia because of such membership. Sec. 400. Karl K Wilcox Cpl USMC 81-86 Karl K Wilcox Lt Col MMCW 02-03 Karl K Wilcox Spc MI ARNG 03- _____________________________ My Personal History I was appointed the official contact for Mecosta County MI 9th Brigade 5th Division December 2002, & WAS listed on www.michiganmilitia.com links I was in the USMC 1981 - 1986 as a reservist & active duty as a mortarman spending 3 years as a Scout Sniper in an Infantry Battalion on Camp Lejeune NC with two 6 month rotations to Camp Schwab Okinawa. The last position I held in the USMC was Chief Scout in my unit. I attended Infantry Training School CAMPEN CA Dec 81 US Army Airborne Course Ft Benning GA Nov 82 Scout Sniper Instructor Course, MCDEC Quantico, VA June - August 85. I was Honorably Discharged from the USMC July 86 as a Corporal. Sept 87 - Nov 94 I walked, hitchhiked, & rode freight trains throughout the lower 48 states developing the ability to blend in among the poor & homeless in urban areas & live, camp, survive in rustic rural areas. Nov 94 - May 00 I lived in the Heartside Neighborhood in Grand Rapids MI studied & completed various college level correspondence courses. Worked as a volunteer at Degage Ministries helping to distribute food to approx 40 needy individuals & families on a twice monthly basis. May 00 - Current date I have lived in Big Rapids MI & have been conducting Scout Research. Dec 02 I was appointed the official contact for MILITIA Mecosta County MI 9th Brigade 5th Division & assigned the rank of Lt Col in the MMCW. Dec 03 I enlisted in the MI Army National Guard advancing from unorganized militia to the organized militia. I look forward to serving in the MI Army National Guard from 2003/12/06 - 2006/12/05. UPDATE Currently I am waiting discharge as a Specialist E-04 from the Michigan Army National Guard E Co 1-125th INF (M) Big Rapids MI. The MI ARNG never completely issued me my uniforms between January 2004 - April 2004 due to no fault of my own causing me not to be prepared for duty or MOSQ school increasing my stress levels. My unit chain of command was not pleased I had notified MI ARNG JFHQ Lansing MI as to my situation.
