Declarant, ___________________________________________ a native-born, white Man of sound mind and body, a National of the united States of America, and currently one of the People of California; is here by Special Visitation only and without the benefit of the Assistance of Counsel.

Declarant, with all due Respect and in full Good Faith, Declares and Affirms:

1.a. First, I feel I must apologize to the "court" because my understanding is that I should not need to be here.

1.b. I distinctly heard Mr. Darlington in open "court" on November 23, 1999, say/instruct[?]/order[?] that:
a. I did not need to come back to "court".
b. That I could periodically check with the OFFICE OF THE CLERK to detrmine the availability of the documents I had requested.
c. That said documents would be delivered to me there, at no cost, when they were next available.

2. For whatever reason, those instructions[?]/orders[?] which I KNOW I heard did not get transcribed into the docket/minute record (identified as: "CASE NO. M96-1292 DEFENDANT THOMAS M. THORNHILL, III PG NO. unknown", first entry dated 10/27/99).

3. On Thursday, December 9, 1999, I came to the OFFICE OF THE CLERK, ascertained that the case/document file (on microfilm) was currently available and had one of the clerks make the copies I needed.
Then Mrs. Casci informed me that I "needed" to go back to "court" to receive them.

4. So, lacking any written evidence of Mr. Darlington's instructions[?]/orders[?], I suppose I have to suggest that the sitting "judge" might want to help his employees by refreshing their collective memories.
To that end, I have attached and incorporated an "Administrative Notice of Applicable Law concerning the Oath of Office in California" for the attention of all to whom it may apply.

6. If there is(are) any Statute of Limitation(s) running which do/should affect me in this matter, I specifically Reserve a "tolling" of all the time that has been consumed by the actions of various members of the OFFICE OF THE CLERK.
