RE: FTB case number 2580119270088816.

Dear Miss/Ms./Mrs. Iwuchukwu:

1. All interested parties please take Notice that:

A. I am the only known Witness for my side of this proceeding.

B. I Declare that as of this date, October 27, 2000, I have not been properly Served by the Franchise Tax Board, either in person or by mail, with any verified Complaint (if this is supposed to be a criminal matter) nor with any valid Claim (if this is supposed to be a civil matter) in said FTB case number 2580119270088816. I do have any Notice of the nature or cause of this proceeding at this time.
The FTB may wish to correct this error before November 6, 2000.

C. I intend to electronically Record the proceedings scheduled for November 6, 2000, for my own use and recollection. I do not Object if the FTB also wishes to Record said proceeding. If the FTB does chose to Record said proceeding, I Reserve the right to obtain a copy of said Recording and/or a transcript thereof.

D. I Reserve the right to have visitors at this open hearing.

E. I hereby submit my Affidavit of Thomas Murrell Thornhill III to be included and incorporated into the Record.

F. I hereby submit my Memorandum of Points and Authorities concerning Due Process of Law and Discovery to be included and incorporated into the Record.

G. I Declare that as of 11 A.M. of this date, October 27, 2000, I have not been delivered any Discovery materials by the FTB.
If I have not received any Discovery information from the FTB in the mail by 11 A.M. of next Tuesday, October 31, 2000, I will, of necessity, physically visit your office to view and copy the case file and all related materials. I will have to bill the FTB for my travel time and mileage. Please reserve time for me in your schedule and have all said document(s) avaiable at that time.

I Certify, under the penalties provided for the crime of Perjury in the Law of the united States of America and in the Law of California, that I have read the foregoing and that it is true and accurate.
