Bill of Economic, Social, and Cultural Rights. Spanish/Español

(Amendment XXVIII reserved for the Equal Rights Amendment.)

Amendment XXIX.

Section 1. The right of the people to work, to free choice of employment, to just and favourable conditions of work, to protection against unemployment, to equal pay for equal work of equal value, to renumeration adequate to maintain a decent standard of living, and to save and healthy working conditions, shall not be infringed.

Section 2. Congress shall have the power to enforce this article by appropriate legislation.

Section 3. The United States, in order to achieve the full realisation of these rights, shall institute technical and vocational guidance and training programmes, policies, and techniques to achieve full and productive employment under conditions safeguarding fundamental political and economic freedoms for the individual.

Amendment XXX.

Section 1. The right of the people to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay, shall not be infringed.

Section 2. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXI.

Section 1. The right of the people to a decent standard of living adequate to sustain their health and well-being, including adequate food, clothing, housing, and medical care, shall not be infringed.

Section 2. The right of the people to social security, including social insurance and other means to sustain a decent living, shall not be infringed.

Section 3. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXII.

Section 1. The right of the people to an education which shall be directed to the full development of the human personality and the sense of its dignity, the strengthening of the respect for human rights and fundamental freedoms, the enabling of all people to participate effectively in a free society, the promotion of understanding, tolerance, and friendship for all people, and the maintainance of peace, shall not be infringed.

Section 2. Education shall be free for all under eighteen years of age and compulsory for minor children, and shall not be denied anyone.

Section 3. In accordance with the aims expressed in section 1, parents have a prior right to choose the kind of education that shall be given to their minor children.

Section 4. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXIII.

Section 1. The right of intending spouses to marry with free consent, or of spouses which find further marriage intolerable, to divorce, shall not be infringed.

Section 2. The right of minor children to visit or reside with their parents shall not be infringed, provided exercise of this right would not result in abuse or neglect.

Section 3. The right of parents to provide support for their minor children, to paid leave during and after childbirth, and to resume their previous employment after such leave, shall not be infringed.

Section 4. No minor child shall be economically or socially exploited, or shall be required to secure gainful employment.

Section 5. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXIV.

Section 1. The right of the people to freely form and to join trade unions shall not be infringed.

Section 2. The right of trade unions to form and join national and international federations, confederations, or organisations, or to otherwise function freely and lawfully, shall not be infringed.

Section 3. The right to strike shall not be infringed, provided its exercise is not intended to resultant in the violation of this Constitution or of its Amendments.

Section 4. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXV.

Section 1. The right of the people to take part in cultural life, to enjoy benefits of scientific progress and its application, and to benefit from the protection of the moral and material interests resulting from any scientific, literary, or artistic invention or authorship, shall not be infringed.

Section 2. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXVI.

Section 1. The right of the people to the conservation of their natural resources shall not be infringed.

Section 2. The ownership and use of land in the United States shall be premised upon this right.

Section 3. Congress shall have the power to enforce this article by appropriate legislation.

Amendment XXXVII.

The laws and policies of the United States Government, and of the state, county, municipal, and other governments constituted therein, shall have as their aim the fullest enjoyment of human rights, prosperity, dignity, and happiness by all people.
