Many will say about the thief on the stake or pole, that he was never baptized or filled with the Spirit with the evidence of speaking in tongues, so if he didn't need it why should we? |

Let's go to the scriptures and find out why he didn't need it: |
Luke 23:32-43 |
32: |
And there were also two others, malefactors, led with him to be put to death. |
33: |
And when they were come to the place, which is called the Skull, there they crucified him, and the malefactors, one on the right hand, and the other on the left. |

34: |
Then said Immanuel, Father, forgive them; for they know not what they do. And they parted His raiment and cast lots. |
|
35: |
And the people stood beholding. And the rulers also with them derided him, saying, He saved others; let him save himself if he be the Messiah, the chosen of Yahweh. |
|
36: |
And the soldiers also mocked him, coming to him, and offering him vinegar, |
|
37: |
And saying, If thou be the king of the Jews, save thyself. |
|
38: |
And a superscription also was written over him in letters of Greek, and Latin, and Hebrew, THIS IS THE KING OF THE JEWS. |
|
39: |
And one of the malefactors which were hanged railed on him, saying, If thou be the Messiah, save thyself and us. |
|
40: |
But the other answering rebuked him, saying, Dost not thou fear Yahweh, seeing thou art in the same condemnation? |
|
41: |
And we indeed justly; for we receive the due reward of our deeds: but this man hath done nothing amiss. |
|
42: |
And he said unto Immanuel, Master, remember me when thou comest into thy kingdom. |
|
43: |
And Immanuel said unto him, Verily I say unto thee today, shalt thou be with me in paradise. |
|
Now to show you why he didn't need the infilling of Yahweh's Spirit. In order for the new covenant to be established, the Messiah had to first be sacrificed. |
Hebrews 9:14-28 |
14: |
How much more shall the blood of the Messiah, who through the eternal Spirit offered himself without spot to Yahweh, purge your conscience from dead works to serve the living Yahweh. |
15: |
And for this cause he is the mediator of the new covenant, that by means of death, for the redemption of the transgressions that were under the first covenant, they which are called might receive the promise of eternal inheritance. |

16: |
For where a covenant is, there must also of necessity be the death of the testator. |
|
17: |
For a covenant is of force AFTER MEN ARE DEAD: otherwise it is of no strength at all while the testator liveth. |
|
18: |
Whereupon neither the first covenant was dedicated without blood. |
|
19: |
For when Moses had spoken every precept to all the people according to the law, he took the blood of calves and of goats, with water, and scarlet wool, and hyssop, and sprinkled both the book, and all the people, |

20: |
Saying, This is the blood of the covenant which Yahweh hath enjoined unto you. |
|
21: |
Moreover he sprinkled with blood both the tabernacle, and all the vessels of the ministry. |
|
22: |
And almost all things are by the law purged with blood; and without shedding of blood is no remission. |
|
23: |
It was therefore necessary that the patterns of things in the heavens should be purified with these; but the heavenly things themselves with better sacrifices than these. |
|
24: |
For the Messiah is not entered into the set apart places made with hands, which are the figures of the true; but into heaven itself, now to appear in the presence of Yahweh for us: |

25: |
Nor yet that he should offer himself often, as the high priest entereth into the set apart place every year with blood of others; |
|
26: |
For then must he often have suffered since the foundation of the world: but now once in the end of the world hath he appeared to put away sin by the sacrifice of himself. |
|
27: |
And as it is appointed unto men once to die, but after this the judgment: |
|
28: |
So the Messiah was once offered to bear the transgressions of many; and unto them that look for him shall he appear the second time without transgression unto salvation. |

As you can see the New Covenant was not yet established, until the Messiah died. |
|
The Spirit of Yahweh was not yet given as you will see by the next scripture: |
John 7:38-39 |
38: |
He that believeth on me, as the scripture hath said, out of his belly shall flow rivers of living water. |
39: |
(But this spake he of the SPIRIT, which they that believe on him should receive: for YAHWEH'S Spirit was not yet given; because that Immanuel was not yet EXALTED.) |

This person on the stake or pole, would have still been considered to be under the Old Covenant. |
