Jakarta Post (5/21/2001 3:55:39 PM) JAKARTA (JP): Judge Samsul Ali of the South Jakarta District Court declared on Monday that the May 4th arrest on Commander of the Laskar Jihad Ahlus Sunnah wal Jamaah (Jihad Force) Ja'far Umar Thalib was unlawful. "The court decides that the arrest (on the plaintiff), which was made upon the instruction of National Police chief (Gen. Surojo Bimantoro) was unlawful," Judge Samsul said while reading his verdict. The judge also ordered the police chief to pay the plaintiff a compensation of Rp 1,000,000 (US$100). Speaking about the legal grounds for nullifying the arrest, judge Samsul said the police chief's instruction was not original as it was a facsimile copy. "A facsimiled letter is not a valid evidence" he said. A lawyer representing the police chief, Suyitno, said he would report the court's verdict to his client. Meanwhile, a lawyer of the plaintiff Wirawan Adnan said that if the judge declared the arrest as unlawful, so did the detention. He, however, said that the plaintiff accepted the verdict and would not pursue with other legal actions. (imn)
